~%EAS, Sectic~ 10012 of the Elections (k~e of the State of
California provides that the ~ body of any city may adopt a charge
municipal election, including costs of the candida~ statem~c.
NOW, THEREFORE, the City Council of the City of Rancho O~a~x~a does
hereby resolve, declare, determine and order as follows:
S~CTION 1: General Provisions. That pursuant to Sectic~ 10012 of
the Elections Code of the State of California, each candidate for elective
office to be voted for at the General Municipal Electio~ to be held in the
City of Rancho (~ on November 8, 1994, may ~re~k%re a candidate's
statement on an appropriate form provi_d~d___ by the City Clerk. Such statement
may include the name, age and occupation of the candidate and a brief descrip-
tion of no more than 200 words of the cam4~date's education and qualificatic~
include party affiliation of the candidate, nor membership or activity in
partisan political c~ganizations. Such statement shall be filed in the office
of the City Clerk at the time the caDd4date,s n~nination papers are filed.
Such statement may be withdrawn, but not changed, during the period for filing
n~nination papers and until 5:00 p.m. of the next working day afte~ the cloee
of the nc~/nation period.
S~CTION 2: S~anish ~. A candidate may elect to have said
candidate statement translated into Spanish at an additional cost to be
d~tmrmined by the Registrar of Voters.
S~CTION 4: Payment. The City Clerk shall estimate the total ooet of
~rintir~, handling, translating, and mailing the candidates sta~_nts filed
pursuant to the Elections Code, including ooets incurred as a result of
cc~ply~ with the voting Rights Act of 1965 (as amended), and require each
candidate filing a statsmerit to pay in advance b~ or her pro rata share as a
oondition of having his or her statement included in the voter's pamphlet.
The estimate is just an approximation of the actual cost that varies frc~
election to another election and may be significantly more or less than the
estimate, depending on the actual number of candidates filing statement.
Acoor~ly, the clerk is not bound by the estimate and may, on a p~o rata
basis, bill the candidate for additional actual expense or refund any exoess
paid ~ on the final actual cost. In the event of underpay, the
clerk may require the candidate to pay the balance of the cost incurred. In
the event of overpayment, tb~ clerk shall prorate the excess amount among the
candidates and refund the excess amount paid within 30 day~ of the election.

S~CTI~ 5: That the City Clerk shall provide each candidate or the
candidate's l~tive a copy of this Resolutio~ at the t/me n~inating
petitic~ are issued.
S~CTIG~ 7: ~hat this ~esoluticn shall apply only to the election to
be held on November 8, 1994, and shall then be repealed.
