Adjournment CITY OF RANCHO CUCAMONGA CITY PLANNER MINUTES Regular Meeting October 25, 1994 Brad Buller, City Planner, called the Regular Meeting of the City of Rancho Cucamonga City Planner to order at 2:00 p.m. The meeting was held in the Planning Division Conference Room at Rancho Cucamonga Civic Center, 10500 Civic Center Drive, Rancho Cucamonga, California. STAFF PRESENT: Nancy Fong, Senior Planner; Beverly Luttrell, Associate Planner; Shelley Petrelli, Secretary ANNOUNCEMENT S None PUBLIC HEARINGS A. CONDITIONAL USE PERMIT 94-29 - PRIMERICA FINANCIAL SERVICES - A request to establish a financial services office in a leased space of approximately 2,362 square feet in an existing building at 9229 Utica Avenue, Unit %140, in Subarea 11, General Industrial, of the Industrial Area Specific Plan - APN: 209-411-17. Beverly Luttrell, Associate Planner, presented the staff report. Brad Buller, City Planner, opened the public hearing. He asked the applicant for comments. Tom Amini, Primerica representative, stated that the office would be used primarily as a training center, similar to their office currently located on Acacia Street. He stated classes would be held on Thursday evenings and Saturday mornings. Mr. Buller asked if the normal workday would be regular office use. Mr. Amini responded affirmatively and stated that approximately seven people would be working in the office during the week. Mr. Buller asked if there was anyone else who wanted to comment on the project. As there was no one who wished to add comments, Mr. Buller went on the explain the City Planner's new streamlining process. Mr. Buller closed the public hearing. City Planner Minutes 1 October 25, 1994 Mr. Buller explained that Primerica would need to come back to amend the resolution if they wanted to make any changes to the original conditions, including changing the day of the week, or taking over the hours that the church now has. Mr. Amini asked what the church's hours were. Mr. Buller stated he believed that they were operating on Wednesdays and Sundays. Mr. Buller approved Conditional Use Permit 94-29 by adoption of the revised resolution which shall state that the hours of operation will be limited from 6:30-8:00 PM on Thursday evenings and 8:00-9:30 AM on Saturday mornings. B. CONDITIONAL USE PERMIT 94-47 MODIFICATION - SAM'S PUB AND GRILL - A request to add 10 amusement devises to an existing arcade in conjunction with a restaurant, located at 6620 Carnelian, in the Neighborhood Commercial District - APN: 208-811-56. Nancy Fong, Senior Planner, presented the staff report. She stated that she had received one letter from a resident objecting to the project. Mr. Buller opened the public hearing. He asked the applicant if he had any comments. Mr. Sam Pellegrino, owner, stated he was just trying to keep his business going. Mr. Buller asked how he felt adding video games would help his business. Mr. Pellegrino responded that it would keep people there a little longer and that having the machines produced additional revenue. Mr. Buller asked what different types of machines would be installed. Mr. Pellegrino responded he was adding pool tables, and poker and basketball machines. He asked if the fire department had reviewed his project or if he needed to take care of that. Ms. Fong stated that Mr. Pellegrino still needed to bring his final plan and occupancy load count to the Fire District. October 25, 1994 -2- City Planner Minutes Mr. Buller stated that he would like Ms. Fong to send a letter to the resident, who registered the complaint, indicating the action taken today and asking that they let staff know if they experience problems or issues related to the business. He commented that gambling was not permitted at the facility and that none of the devices were to be placed near any of the entrances or exits. Mr. Buller closed the public hearing. Mr. Buller then approved CUP 93-37 with the adoption of the resolution. PUBLIC COMMENTS There were no further public comments. Petrelli Secretary City Planner Minutes -3- October 25, 1994 CITY OF RANCHO CUCAMONGA STAFF REPORT DATE: TO: FROM: SUBJECT: December 13, 1994 Brad Buller, City Planner Dan Coleman, Principal Planner CONDITIONAL USE PERMIT 94-37 - RANCHO CHRISTIAN CENTER - A request to establish a church within a leased space of 14,610 square feet in the General Industrial District (Subarea 4), to be located at 9477 Archibald - APN: 210- 071-56. ANALYSIS: General: Rancho Christian Center has outgrown their present location in the Rancho Pacific Business Park (approved Conditional Use Permit 87-23). The proposed location would increase their sanctuary size from 150 seats to 650 seats in order to allow the entire congregation to be together in a service (see Exhibit "E"). The church will conduct services on Sunday momings and evenings, and a midweek service on Wednesday evening at 7:00 p.m. The church also hosts tri-annual day conferences which typically run Wednesday through Saturday. Land Use Compatibility: The General Industrial District (Subarea 4) is intended for light industrial and commercial support users, including but not limited to, light manufacturing, light wholesale, storage and distribution, business supply retail, restaurants, and banking and real estate services. All uses within the Crescent Business Center operate during regular weekday business hours. Staff does not anticipate any compatibility problems to arise between adjoining land uses because the church is occupying a freestanding building and has offset operating hours, provided that the tri-annual conferences are limited to 75 persons (including church staff) based upon the spaces available to the church during the daytime. Parking: The church requires 120 parking spaces based upon 4,200 square feet of seating area in the sanctuary. A total of 131 parking spaces are available within 300 feet of the church as required by Code (see Exhibit "F"), including parking along the 40-foot wide private drives. Therefore, no parking conflicts are foreseen. However, additional lighting is needed along Crescent Center Drive and Dover Way for the safety of motorists and pedestrians attending evening activities at the church. ITEM A CITY PLANNER STAFF REPORT CUP 94-37 - RANCHO CHRISTIAN CENTER December 13, 1994 Page 2 Life Safety Issues: The Building & Safety Division has reviewed the proposed church floor plan and determined that it would increase the occupant load to approximately 650 persons. An occupant load of 300 or more would require modifications to the building to address building and fire code requirements. The applicant's designer has met with Building & Safety to review the necessary modifications for an A 2.1 occupancy rating. Environmental Assessment: The application is categorically exempt per Section 15301 of the California Environmental Quality Act Guidelines. RECOMMENDATION: Staff recommends that the City Planner approve Conditional Use Permit 94-37 through adoption of the attached Resolution. This new location will accommodate our present congregation and allow for future expansion. The facility will be used for regular church services held on Sunday morning and evening. We will have midweek services at 7:00 p.m. on Wednesday. There are also bible studies and youth meetings at various other times during the evenings. We also have some day activities periodically but would have minimal attendance. The present parking in the front and rear of the facility would be sufficient to handle these day activities. Tri-annually we would have day conferences which would typically run from Wednesday through Saturday. Since we are presently in a business park we are very sensitive to not interfering with the operation of adjacent businesses. The number of employees on our largest shift would be around 10. Having been in Rancho Cucamonga for 17 years, we believe that we have shown ourselves to be credible and a service to our community. A RESOLUTION OF THE CITY PLANNER OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT NO. 94-37, FOR A CHURCH LOCATED IN THE GENERAL INDUSTRIAL DISTRICT, AND MAKING FINDINGS IN SUPPORT THEREOF - APN: 210-071-56. A. Recitals. 1. David Cunningham has filed an application for the issuance of Conditional Use Permit No. 94-37, as described in the title of this Resolution. Hereinafter in this Resolution, the subject Conditional Use Permit request is referred to as "the application." 2. On the 13th day of December 1994, the City Planner of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said heating on that date. 3. All legal prerequisites prior to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined, and resolved by the City Planner of the City of Rancho Cucamonga as follows: 1. The City Planner hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to the City Planner during the above- referenced public hearing on December 13, 1994, including written and oral staff reports, together with public testimony, the City Planner hereby specifically finds as follows: a. The application applies to property located at 9477 Archibald Avenue with a street frontage of 170 feet and lot depth of approximately 920 feet and is presently improved with a multi-tenant industrial park; and b. The property to the north of the subject site is industrial, the property to the south consists of industrial, the property to the east is developed with industrial, and the property to the west is vacant. 3. Based upon the substantial evidence presented to the City Planner during the above- referenced public heating and upon the specific findings of facts set forth in paragraphs 1 and 2 above, the City Planner hereby finds and concludes as follows: a. That the proposed use is in accord with the objectives of the Industrial Specific Plan, and the purposes of the district in which the site is located. b. That the proposed use, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity. That the application contemplates the operation of proposed use complies with each of the applicable provisions of the Development Code and Industrial Specific Plan. 4. The City Planner hereby finds and determines that the project identified above in this Resolution is categorically exempt from the requirements of the California Environmental Quality Act of 1970, as amended, and the Guidelines promulgated thereunder, pursuant to Section 15301 of the State CEQA Guidelines. 5. Based upon the findings and conclusions set forth in paragraphs 1,2, 3, and 4 above, the City Planner hereby approves the application subject to each and every condition set forth below: 1) Approval shall expire, unless extended by the City Planner, if building permits are not issued or approved use has not commenced, within 24 months of this date. 2) Approval of this request shall not waive compliance with any sections of the Industrial Area Specific Plan, State Fire Marshal's regulations, Uniform Building Code, or any other City Ordinances. 3) If operation of the facility causes adverse effects upon adjacent businesses or operations, the Conditional Use Permit shall be brought before the City Planner for consideration and possible termination of the use. 4) This approval is for a church use only, and no commercial preschool/day care/school operation shall be permitted. Any intensification of use beyond that requested by this application shall require modification to this application. 5) The facility shall be operated in conformance with the performance standards as defined in the Industrial Area Specific Plan including, but not limited to, noise levels. 6) Any signs proposed for the facility shall be designed in conformance with the City's Sign Ordinance and the Uniform Sign Program for the complex and shall require review and approval by the Planning Division prior to installation. 7) Church services or other public assembly (i.e., 50 or more persons) shall be allowed only on weeknights after 5:30 p.m. and on weekends. 8) No church activity during the daytime on weekdays shall exceed the 75 parking spaces available for the building (including 41 parallel spaces.). 9) Public assembly occupancy of this facility shall not commence until such time as all Uniform Building Code and State Fire Marshal's regulations have been complied with. Prior to occupancy, plans shall be submitted to the Building and Safety Division to show compliance. The building shall be inspected for compliance prior to occupancy. CITY PLANNER RESOLUTION NO.
