Adj ournm nt CITY OF RANCHO CUCAMONGA CITY PLANNER MINUTES Regular Meeting October 11, 1994 Brad Buller, City Planner, called the Regular Meeting of the City of Rancho Cucamonga City Planner to order at 2:00 p.m. The meeting was held in the Planning Division Conference Room at Rancho Cucamonga Civic Center, 10500 Civic Center Drive, Rancho Cucamonga, California. STAFF PRESENT: Dan Coleman, Principal Associate Planner Planner; Alan Warren, ANNOUNCEMENTS None MINUTES The September 13, 1994 minutes were approved by Brad Buller, City Planner. PUBLIC HEARINGS A. CONDITIONAL USE PERMIT 94-27 - CLIFFORD AND PATRICIA JOHNSON - A request to establish a health spa with ancillary massage services in a lease space of approximately 3,168 square feet at 9135 Archibald Avenue, Suites "B" and "C," under the recreational facilities provisions of the Industrial Area Specific Plan, Subarea 4 - APN: 209-211-48 Alan Warren, Associate Planner, presented the staff report. Brad Buller, City Planner, opened the public hearing. He then asked if the applicant had any questions. Mr. Mark McErlean, represented the owner of the center, who stated the parking lot would be restriped before the end of November. He stated that the lighting in the lot was originally three pole lights and three wall-pack lights; they have since added another 20-foot pole with two heads, five more wall-packs, ten flood lights (under the canopies) and ten additional lights in the sofet areas. City Planner Minutes -1- October 11, 1994 Mr. Warren stated he would check out the lighting again because he did not observe the lighting mentioned by the applicant on his previous inspection of the site. Mr. Buller asked for a copy of the lighting information. Ms. Patricia Johnson, owner, stated that they have been in the USA for ten years and this project has been a goal of theirs and that they feel Rancho Cucamonga is the perfect area for their business with good visibility and access from Archibald. She stated that their business is quite unique with its toning table which is new in this area. Mr. Buller asked what age group normally utilizes their services. Mr. Clifford Johnson stated that it would cover all age groups. Ms. Johnson stated that people use the toning table technique when they can't go to a regular gym to workout. Mr. Buller asked if people were referred by their doctors. Ms. Johnson responded that their clients are not referred by their doctor and if they wish to use the table, they will have to make an appointment; facials, manicures, pedicures, and massages will also be by appointment. Mr. Buller asked if the applicant understood that the massage use was ancillary to their primary business and that specific rules and regulations are applicable by the Business Licensing Department. Ms. Johnson responded affirmatively. Mr. Buller stated that the Sheriff's Department was unable to comment on the application as the investigation they need to do is part of the massage permit application. Ms. Johnson stated she had already been approved as a massage technician in 1991. She further stated that there will be two additional massage technicians and they also have received their permits. Mr. Buller asked if the applicant had read through the conditions on the resolution. Mr. McErlean stated they had not received a copy of the conditions in the mail. (Mr. Buller gave the applicant a copy of the resolution and they read through the conditions.) Mr. Johnson asked what would be required if they wished to have more than five employees at their facility. City Planner Minutes -2- October 11, 1994 Mr. Buller responded that the issue mainly concerned adequate parking for the corresponding number of employees and should they increase the number of employees, they would need to file for an amendment to their Condition Use Permit. Additionally, Mr. Buller told them that they would need to apply for an amendment if the expanded their facility. He stated that a Conditional Use Permit is mainly to ensure compatibility of business uses within the same district. He asked if they were familiar with the City's Sign Ordinance and the specific sign program for that center. Ms. Johnson responded negatively. Mr. Buller explained that there is a sign program for every business center within the City that explains where signs may be placed, size, etc.; also, specific restrictions apply to temporary signs. He asked that they read over and become familiar with both sign regulations to prevent future code violations. Mr. Buller closed the public hearing and asked that the applicant read and comply with their conditions of approval; stripe the parking, check with Business License staff or the Police Department to ensure compliance with their business license, prior to establishing the massage portion of their establishment. Mr. Buller approved Conditional Use Permit 94-27. B. CONDITIONAL USE PERMIT 94-27 - WRIGHT - A request to allow a medical office within a lease space of approximately 1,120 square feet in an existing Industrial Park on 9.2 acres of land in the Industrial Specific Plan Subarea 7, located at 11010 Arrow Route, Suite 103 - APN: 208-352- 41. ANALYSIS: Ao Background: Conditional Use Permit 91-17, granted to Willows Community Church on June 26, 1991, allowed for a church use to occupy approximately 9,000 square feet of one of the buildings within Terra Vista Business Park. Subsequently, CUP 91-17 was modified to include a private school, Wise Oak School. Since that time, Willows/Wise Oak closed and Water of Life Community Church leased the facilities and have operated in accordance with CUP 91-17. General: The applicant is requesting a Conditional Use Permit to expand their church facility, in particular their sanctuary, as explained in detail in Exhibit "A" and as shown in the floor plan in Exhibit "D". In addition to expanding into two adjoining suites, the church also is requesting permission to lease a suite in the future, approximately 80 feet away, for additional offices and sunday school classrooms (see Exhibit "C"). Land Use Compatibility: The Office/Professional District of the Terra Vista Community Plan allows or conditionally permits a wide variety of uses, including but not limited to office/professional functions, light warehousing, light commercial, recreational uses and public assembly. Currently, the Terra Vista Business Park incorporates all of the mentioned uses. All uses within the Business Park (with the exception of Family Fitness Center) operate primarily during regular weekday business hours. The Central School Districts' administrative offices are located next door. The church will continue to hold public assembly on weekends and weeknights and will have a maximum of eight employees working during weekday office hours (9 a.m. to 4:30 p.m.). The church entrance and parking area is physically separated from the Family Fitness Center parking area by two buildings (see Exhibit "C"). Therefore, staff anticipates no compatibility problems to arise between adjoining land uses or any parking conflicts to occur with the expansion of the existing church facility. Life Safety Issues: The Building & Safety Division has reviewed the proposed expansion of the sanctuary and determined that it would increase the occupant load to approximately 350 persons. An occupant load of 300 or more would require modifications to the building to address building and fire code requirements. The applicantTs architect should meet with Building & Safety prior to this hearing to review building plans to determine whether the building can be modified to comply with code requirements for an A2.1 occupancy. An oral update will be given at the heating. Environmental Assessment: The application is exempt per Section 15061 of the California Environmental Quality Act. RECOMMENDATION: Staff recommends that the City Planner approve Conditional Use Permit 94-33 through the adoption of the attached Resolution. Water of Life Community Church continues to grow. Therefore, we request a modification to condi- tional use permit 91-17 that would allow us to increase the areas fro assembly, classrooms and offices. We use the facilities as a church with public assembly primarily on weekends and week nights, outside of the normal business hours for most of the Terra Vista Business Park (except Family Fitness Center). The total square footage will be approximately 12,000 square feet. We desire to increase the size of our sanctuary to accommodate approximately 350 people in approximately 3200 sq. feet.' The balance of the space will be used for classrooms and offices. At the present time, we have four full-time pastors, two part-time pastors, one Administrative Assistant and one part-time secretary on staff. The church offices are open from 9:00 A.M. to 4:30 P.M. Monday through Friday, with occasional hours on Fridays. Services are held on Sundays with additional meet- ings primarily occurring on week nights. At present, parking at the Terra Vista Business Park has not been a problem since our services are held during non-business hours. The approximate 48 parking spaces are adequate during regular business hours. Any additional signage displayed on the exterior of the building will be in accordance with the Terra Vista Sign Program. Thank you for your consideration. This approval will allow our church to continue to grow as we continue to provide spiritual guidance to the people of Rancho Cucarnonga and surrounding areas. However, because of the nature of the center most businesses, with the exception of Family Fitness Center, will be closed evenings and weekends when church services will be held. A RESOLUTION OF THE CITY PLANNER OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT NO. 94-33 FOR WATER OF LIFE COMMUNITY CHURCH IN THE OFFICE PROFESSIONAL TERRA VISTA COMMUNITY PLAN, LOCATED AT 10601 CHURCH STREET, SUITES 109 and 118 THROUGH 124, AND MAKING FINDINGS IN SUPPORT THEREOF - APN: 1077-421-31. 1. Water of Life Community Church has filed an application for the issuance of Conditional Use Permit No. 94-33, as described in the title of this Resolution. Hereinat~er in this Resolution, the subject Conditional Use Permit request is referred to as "the application." 2. On the 8th day of November, 1994, the City Planner of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing on that date. 3. All legal prerequisites prior to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined, and resolved by the City Planner of the City of Rancho Cueamonga as follows: 1. The City Planner hereby specifically f'mds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to the City Planner during the above-referenced public heating on November 8, 1994, including written and oral staff reports, together with public testimony, the City Planner hereby specifically finds as follows: a. The application applies to property located at 10601 Church Street, Suites 109 and 118 through 124, with a Church Street frontage of 397 feet and lot depth of 394 feet and is presently improved with a Business Park and all required public improvements; and b. The property to the north of the subject site is multiple family dwellings, the property to the south is a commercial shopping center, the properties the east and west are vacant. c. The application contemplates the expansion of a church, previously approved under Conditional Use Permit 91-17, including expanding seating within the sanctuary, and adding offices and classrooms. Based upon the substantial evidence presented to the City Planner during the above- referenced public hearing and upon the specific findings of facts set forth in paragraphs 1 and 2 above, the City Planner hereby finds and concludes as follows: a. That the proposed use is in accord with the General Plan, the objectives of the Terra Vista Community Plan, and the purposed of the district in which the site is located. b. That the proposed use, together with the conditions applicable thereto, will not be detrimental to public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity. c. That the proposed use complies with each of the applicable provisions of the Development Code and the Terra Vista Community Plan. 4. The City Planner hereby finds and determines that the project identified above in this Resolution is exempt from the requirements of the California Environmental Quality Act of 1970, as amended, and the Guidelines promulgated thereunder, pursuant to Section 15061 (b)(3) of the State CEQA Guidelines. 5. Based upon the findings and conclusions set forth in paragraphs 1, 2, 3, and 4 above, the City Planner hereby approves the application subject to each and every condition set forth below: Planning Division 1) Approval, shall expire, unless extended by the City Planner, if building permits are not issued or approved use has not commended within 24 months of this date. 2) Approval of this request shall not waive compliance with any sections of the Industrial Area Specific Plan, State Fire Marshal's regulations, Uniform Building Code, or any other City Ordinances. 3) If operation of the facility causes adverse effects upon adjacent businesses or operations, the Conditional Use Permit shall be brought before the City Planner for consideration and possible termination of the use. 4) This approval is for the expansion of an existing church facility only, in particular expansion of the sanctuary, offices and classrooms. Any intensification of use beyond that requested by this application shall require modification to this application. 5) The facility shall be operated in conformance with the performance standards as defined in the Development Code including, but not limited to, noise levels. CUP 94-33 - WATER OF LIFE CHURCH November 8, 1994 Page 3 6) Any additional signs proposed for the facility shall be designed in conformance with the Comprehensive Sign Ordinance and the Uniform Sign Program for the complex and shall require review and approval by the Planning Division prior to installation. 7) Church services or other public assembly (i.e., 50 or more persons) shall be allowed only on weeknights after 5:30 p.m. and on weekends. 8) Any classes associated with the church use shall be limited to a maximum of 29 students and faculty members between the hours of 8:00 a.m. and 5:30 p.m., Monday through Friday. This limit need not apply to evening (after 5:30 p.m.) and weekend classes. In no event shall any other class offered exceed the available parking for this lease space. 9) Assembly shall be limited to 350 persons or the maximum occupancy as specified by the Uniform Building and Fire Codes, whichever is more restrictive. 10) Expansion of the sanctuary to an occupancy of 300 or more persons requires plans to be submitted to the Building and Safety Division for review and approval prior to construction of tenant improvements related to the sanctuary expansion. 6. APN 209-021-39 ANALYSIS: General: The applicant, Jan Edwin Hartz, on behalf of Platt College, is requesting a Conditional Use Permit to operate a private junior college offering associate degrees in the vocational areas of graphic design and paralegal within an existing multi-tenant industrial complex of 18 acres. Operating hours are to be from 8:00 A.M. to 10:00 P.M., Monday through Friday. Under Industrial Area Specific Plan (ISP) provisions, schools may be conditionally permitted within the General Industrial (Subarea 3). Parking: It is anticipated that the school will have 12 staff members and 40 students during its maximum shift at 8 A.M. to 12 P.M.. The other class period shifts are to be 1 P.M. to 5 P.M. and 6 P.M. to 10 P.M. Staff recommends that parking be required at a rate of one space per student and staff. The complex has ample parking spaces in the southwest comer of the complex (behind the structures) which staff has determined are significantly under utilized during the work day. This area shotfid easily accommodate the parking needs of the students and faculty. It is recommended, however, that the college direct its students to use these parking spaces to free up the more visible front spaces for infrequent visitors of the neighboring businesses. Land Use Compatibility: The premise of all Conditional Use Permit reviews is to ensure the compatibility of adjacent uses and separation of potential nuisance activities. The industrial center in which the proposal is located was designed with the characteristics of an office/industrial park. The activities one would anticipate with a small adult school should not cause any conflict with the surrounding businesses. Platt, San Diego was established in Septem- ber of 1972 by Marshall Payn who began the Platt system in St. Joseph, Missouri in 1963. The Platt campus in Ontario opened in its present location with two offices, one classroom, a staff of four and a curriculum devoted to Graphic Design. The original 2500 square feet has been expanded four times over the past seven years to almost 10.000 square feet, which includes six classrooms and two labs, eleven offices, a staff of eight full time and eleven part time employees with curriculum offerings in Graphic Design, Computer Graphics, Interior Design and Paralegal Studies. The original curriculum in Graphic Design was designed to allow anyone who was looking for a career in Graphic Design regardless of educational experience to enter and be trained in six months for an entry level position in the field. Today Platt College, as a private degree granting school, is approved by the State of California and the U.S. Department of Education to grant Associate of Occupational Science degrees to all students in the Graphic Design and Paralegal programs. Applicants to Platt must now have at least a high school diploma or its equivalent to be eligible for admission. Platt College was originally established in 1987 as a California Corporation with Marshall Payn as President. Jan Edwin Hartz was hired as Executive Director to open and build the school. In July of 1987 Mr. Hartz was made a Vice President of the corporation and a member of the Board of Directors. The school expanded in 1988, adding a curriculum offering in Computer Graphic Design to complement the Graphic Design program. Additional curricu- lum offerings in Interior Design and Paralegal Studies were added in 1990, 1992. In Novem- ber of 1989 Platt College, Ontario applied for and was recognized by the State of California and the U.S. Dept. of Education as a main campus and no longer a branch of San Diego. On December 19, 1989 Marshall Payn resigned as President of Platt College, Ontario, Inc and sold the school to Jan Edwin Hartz, who now retains the title of President/CEO. Platt College remains a California corporation with Mr. Hartz owning 100% of the stock. As a private degree granting college Platt falls under the authority of the California State Dept. of Education, the U.S. Dept. of Education and the Career College Association, a nationally recognized accrediting body. By virtue of its accreditation with these entities, Platt College is eligible for all of the student loans associated with higher education. Platt students are also eligible for PELL grant funding. Students using the federal student loan programs for funding comprise approximately 60% of the revenue generated. 5% of the students attending Platt pay cash and the other 35% are funded by vocational rehabilitation training either through workman's comp, insurance claims or federally funded programs for the retraining of dis- placed workers. Platt College is in an ideal geographical location in the Inland Empire. Its location near Interstate 10 at the Archibald exit makes it convenient both for students and prospective applicants. By locating in a large low rise business park the atmosphere provides a campus like setting with outdoor seating areas and shaded walkways. The uniqueness of Platt's programs provides a measure of long term assurance that down turns in the economy will not affect the overall well being of Platt College. Platt is the only Graphic Design school within a 30 mile radius. Chaffee College has a small graphics program which now takes almost 30 months to Complet.e, while the Platt program is only 11 months long, with students receiving a much stronger technical background upon graduation. Phillips College in Riverside provides the only challenge for the paralegal program and again their course takes nearly 15 months to complete while Platt's takes only 11 with the same material being covered in all cases. The U.S. Dept. of Labor Statistics rates the legal assisting field as the number two growth field for the next ten years. The Graphic Design field is rated fourteenth. Platt College has a strong reputation in the Inland Empire as a training institution with placement rates for all programs in the high 80% area. The overall drop rate at Platt is less than 10% which indicates that the curriculum, instructional staff and facilities are conducive to retention and learning. Presently Platt College is located in 10,000 square feet but there is an immediate need to occupy an additional 3000 square feet so that the full range of student services may be provided. The additional space is equally divided into four categories: Library, Lab, Student Services and Administrative. Presently students who attend Platt and are funded by federal retraining agencies, workman's comp or insurance rehabilitation present a steady cash flow that enables Platt to use revenue earned through the Federal Financial Aid program as incre- mental revenue to its profit and loss statement. These funding agencies include the Cities of Riverside, San Bernardino and Ontario as well as the Counties of Riverside and San Bernar- dino. The agency with the largest receivable due to Platt College is the State of California. After Platt College completes its present expansion and meets expected student quo- tas the student population will reach approximately 130. There are no further plans to expand either the curriculum or enroll above the 130 mark. To reach 130 students, there will not be a need to increase either faculty or administrative personnel, only physical space and equip- ment requirements must be addressed. This expansion will require only a small increase in .overall expenses, with a rather large incremental gain in gross revenue, resulting in a propor- tional gain in profit and loss. The overall expansion of the facilities, will enable Platt College 'to remain one of the most viable educational training facilities in the Inland Empire. RESOLUTION NO. A RESOLUTION OF THE CITY PLANNER OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT NO. 94-34 FOR A PRIVATE COLLEGE, LOCATED AT 9521 BUSINESS CENTER DRIVE, IN SUBAREA 3 OF THE INDUSTRIAL SPECIFIC PLAN, AND MAKING FINDINGS IN SUPPORT THEREOF - APN: 209- 021-39. A. Recitals. 1. Jan Edwin Hartz has filed an application on behalf of Platt College for the issuance of Conditional Use Permit No. 94-34, as described in the title of this Resolution. Hereinafter in this Resolution, the subject Conditional Use Permit request is referred to as "the application." 2. On the 8th day of November 1994, the City Planner of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing on that date. 3. All legal prerequisites prior to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined, and resolved by the City Planner of the City of Rancho Cucamonga as follows: 1. The City Planner hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to the City Planner during the above-referenced public hearing on November 8, 1994, including written and oral staff reports, together with public testimony, the City Planner hereby specifically finds as follows: a. The application applies to property located at 9521 Business Center Drive which is an 18-acre site presently improved with the Cucamonga Business Park, a multi-tenant industrial park, located on the southwest comer of Archibald Avenue and Arrow Highway; and b. The property to the north of the subject site is a single family residential neighborhood, the property to the south is partially developed with multi-tenant industrial complex, the property to the east is developed with a fastfood restaurant and offices, and the property to the west is vacant; and CITY PLANNER RESOLUTION NO. The application contemplates the operation of a private college with curriculum including, but not limited to, graphic art design, computer graphics, interior design and paralegal studies with 40 students and 12 staff members during its largest class shift. The proposed hours of operation are 8 A.M. to 10 P.M., Mondays through Fridays, with three separate classroom shifts; and d. There are 60 spaces to the south and west of the proposed lease space which are currently not utilized by other tenants within the Cucamonga Business Park. 3. Based upon the substantial evidence presented to the City Planner during the above- referenced public hearing and upon the specific findings of facts set forth in paragraphs 1 and 2 above, the City Planner hereby finds and concludes as follows: a. That the proposed use is in accord with the General Plan, the objectives of the Development Code, and the purposes of the district in which the site is located. b. That the proposed use, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity. c. That the use complies with each of the applicable provisions of the Development Code. 4. The City Planner hereby finds and determines that the project identified above in this Resolution is exempt from the requirements of the California Environmental Quality Act of 1970, as amended, and the Guidelines promulgated thereunder, pursuant to Section 15016 (b)(3) of the State CEQA Guidelines. 5. Based upon the findings and conclusions set forth in paragraphs 1,2, 3, and 4 above, the City Planner hereby approves the application subject to each and every condition set forth below: Planning Division 1) Approval shall expire, unless extended by the City Planner, if use has not commenced within 24 months of this date. 2) Approval of this request shall not waive compliance with any sections of the Industrial Area Specific Plan, State Fire Marshall's regulations, Uniform Building Code, or any other City Ordinances. CUP 94-24 - PLATT COLLEGE November 8, 1994 Page 3 3) If operation of the facility causes adverse effects upon adjacent businesses or operations the Conditional Use Permit shall be brought before the City Planner for consideration and possible termination of the use. 4) This approval is for a private adult college only. Any change or intensification of use shall require modification to this application. 5) A complete set of improvement plans shall be submitted to the Fire Safety Division to include, but not limited to, the following items; interior finishes, existing and/or modified fire sprinklers and/or alarms, existing and/or locations and types of portable fire extinguisher. 6) Prior to occupancy, plans shall be submitted to the Building and Safety Division and the Fire District for approval and inspection shall be completed. 7) The college is limited to 12,960 square feet of building area, and hours of operation from $ A.M. to 10 P.M., Monday through Friday. 8) The number of students, college faculty, and employees is limited to a total of 52. 9) Students shall be required to park behind the building so as to flee up the parking spaces in the front of the complex for infrequent business visitors. 10) Additional lighting shall be provided to illuminate the parking areas to the south and west to the satisfaction of the City Planner.
