MILLS ACT AGREEMENT 94-02 - MR. & MRS. DENNIS PARKER - A request
to implement the use of the Mills Act to reduce the property tax on Historic
Landmark property, the Demens-Tolstoy House, located at 9686 Hillside Road -
APN: 1061-561-04.
BACKGROUND: On September 10, 1989, the City Council approved the Demens-Tolstoy
House, at 9686 Hillside Road, as an historic landmark. Mr. and Mrs. Dennis Parker, owners of the
residence, now wish to enter into a Mills Act agreement with the City.
The concept of the Mills Act program is to provide an incentive for the property owner to protect and
preserve the property so as to retain its characteristics of historical significance. This intention is
encouraged through the reduction of property taxes, thus enabling the property owner to reinvest the
money saved from the reduced property tax for improvements. The properties that enter into the
agreement are to be inspected by City staff on an annual basis to determine whether notable progress
has been made in rehabilitating the property. Staff estimates the property tax savings to the owner
could be as much as $5,559 and the reduction in tax proceeds to the City would be $244. The exact
amounts are dependent upon the County Assessor's property valuation based on income potential and
the capitalization rate at the time of assessment.
Mr. and Mrs. Parker have indicated their intent to rehabilitate the structure with the following
improvements over the next 10 years:

- Repaint house - outside

- Replant/restore rock garden

- Complete Community fences/trails adjacent to the property

RECOMMENDATION: Staff recommends the Historic Preservation Commission forward its
recommendation for approval of Mills Act Agreement 94-02 to the City Council by minute order.
