A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO
CUCAMONGA, CALIFORNIA, ORDERING THE WORK IN CONNECTION
WITH ANNEXATION NO. 36 TO LANDSCAPE MAINTENANCE DISTRICT
NO. I AND ACCEPTING THE FINAL ENGINEER'S REPORT FOR TRACT
NO. 10349
WHEREAS, the City Council of the City of Rancho Cucamonga did on the
1st day of July, 1987, adopt its Resolution of Intention No. 87-347 to order
the therein described work in connection with Annexation No. 36 to Landscape
Maintenance District No. 1, which Resolution of Intention No. 87-347 was duly
and legally published in the time, form and manner as required by law, shown by
the Affidavit of Publication of said Resolution of Intention on file in the
office of the City Clerk; and
WHEREAS, after the adoption thereof, notice of the passage of said
Resolution of Intention, headed "Notice of Improvement", was duly and legally
posted in the time, form, manner, location, and number as required by law, as
appears from the Affidavit of Posting said notices, on file in the office of
the City Clerk; and
WHEREAS, after the adoption thereof, notices of the adoption of the
Resolution of Intention were duly mailed to all persons owning real property
proposed to be assessed for the improvements described in said Resolution of
Intention No. 87-347, according to the names and addresses of such owners as
the same appears on the last mailing or as known to the City Clerk of the City
of Rancho Cucamonga, which.said copies were duly mailed in the time, form, and
manner as required by law, as appears from the Affidavit of Mail ing on file in
the office of the City Clerk; and
WHEREAS, said City Council having duly received considered evidence,
oral and documentary, concerning the jurisdiction facts in this proceeding and
concerning the necessity for the contemplated work and the benefits to be
derived therefrom and said City Council having now acquired jurisdiction to
order the proposed work.
SECTION 1: It is hereby resolved by the City Council of the City of
Rancho Cucamonga that the public interest and convenience requires the
annexation to the District and the ordering of the work, and said City Council
hereby orders that the work, as set forth and described in said Resolution of
Intention No. 87-347, be done and made; and
SECTION 2: Be it further resolved that the report filed by the
Engineer is hereby finally approved; and

SECTION 3: Be it further resolved that the assessments and method of
assessment in the Engineer's Report are hereby approved.
SECTION 4: Be it finally resolved that said assessments shall not
begin until after 60 percent of said tracts have been occupied.

Engineer's Report for
Landscape Maintenance District No. 1
ANNEXATION NO. 36 for
Tract 10349
SECTION 1. Authority for Report
This report is in compliance with the requirements of Article 4, Chapter
1, Division 15 of the Streets and Highways Code, State of California
{Landscaping and Lighting Act of lg72).
SECTION 2. General Description
This City Council has elected to annex all new subdivisions into Landscape
Maintenance District No. 1. The City Council has determined that the areas to
be maintained will have an effect upon all lots within Tract 10349 as well as
on the lots directly abutting the landscaped areas. All landscaped areas to
be maintained in the annexed tracts are shown on the recorded Map as roadway
right-of-way or easements to be granted to the City of Rancho Cucamonga.
SECTION 3. Plans and Specifications
The plans and landscaping are as stipulated in the conditions of approval
for the development and as approved by the City Engineering Division.
Reference is hereby made to the subject tract map or development plan and the
assessment diagram for the exact location of the landscaped areas. The plans
and specifications for landsGaped improvement on the individual development is
hereby made a part of this report to the same extent as if said plans and
specifications were attached hereto.
SECTION 4. Estimated Costs
No costs will be incurred for street lighting improvement construction.
All improvements will be constructed by developers. Based on available data,
it is estimated that maintenance costs for assessment purposes will be as
indicated below. These costs are estimated only, actual assessments will be
based on actual cost data.

Assessment shall apply to each lot as enumerated in Section 6 and the
attached assessment diagram. Where the development covered by thts annexation
involves frontage along artertal or collector streets, which are designated
for inclusion in the maintenance district but wtll be maintained by an active
homeowners association, these assessments shall be reduced.
SECTION 5. Assessment Oilgram
A copy of the proposed assessment diagram is attached to this report and
labeled "Exhibit A", by this reference the diagram is hereby incorporated
within the text of this report.
SECTION 6. Assessment
Improvements for the Dtstrlct are found to be of general beneftt to all
lots wtthln the Dtstrtct and that assessment shall be equal for each untt.
Where there is more than one dwelltrig unit per lot or parcel of assessable
land, the assessment for each lot or parcel shall be proportional to the
number of d~elltng untts per lot or parcel.
The Ctty Council wtll hold a INbltc hearing tn june, to detemtne the
actual assessments based upon the actual costs tncurred by the City during the
prevtous fiscal year whtch are to be recovered through assessments as required
by the Landscape and Ltghtlng Act of 1972.
SECTION 7. Order of Events
1. CIty Counct] adopts Resolution of Preliminary Approval of Ctty Engtneer's
Report.
2. City Counctl adopts Resolution of Intention to Annex to Otstrlct and sets
publ tc hearing date.
3. Ctty Council conducts publ tc heart rig, considers all testimony and
detemtnes to Annex to the District or abandon the proceedings.
4. Every year tn May, the City Engtneer ftles a report wtth the CIty Counctl.
5. Every year tn June, the City Counctl conducts a public hearing and
approves, or modifies. and approves the t rid1 vt dual assessments.
