December 5, 1990 in the Council Chambers of the civio Center, located at 10500
civic Center Drive, Rancho Cucamonga, California. The meeting was called to

year for sales tax revenues which would benefit the City at practically no cost.

project.
Linda Daniels, Deputy Director, stated it wan part of this project

the City of Rancho Cucarocga.

SUWECI` APPROVAL OF PROFESSIONAL SERVICES AGREEMENT
WITH WOLF LANG CHRISTOPHER FOR DESIGN SERVICES
FOR CIVIC CENTER LOWER LEVEL
RECOMMENDATION. Authorize the Chairman to execute a
Professional Services Agreement with Wolf Lang Christopher, in an
amount not to exceed $40,390, to prepare construction documents to
complete the Civic Center lower level work area.
BACKGROUND: Included as part of the design and construction of the
Civic Center is an 8500 square foot space which has been
programmed to house several City and Fire District functions. During
construction of the Civic Center, this area was used for storage of
materials and furniture while installation was being completed. Now
that construction is complete this area can be designed and finished
for nccupancy.
ANALYSIS: In 1990, The City Council authorized staff to prepare
preliminary space planning designs of how the lower level area could
best be utilized. The intent has been to provide space for several
different functions so that better service to the residents can be
achieved. The primary services that are to be located in this area of
the lower level are as follows: I Fire Safety division, which is
currently located at the headquarters -cation on Amethyst Avenue:
2. Community Services (special events section), which is currently
located at the old City Yard site on Grove Avenue; and 3. Code
Enforcement, which has been temporarily located on the upper level
pending completion of the permanent space. Other uses which will
be designed into the space Include restrooms, storage areas and an
exercise room. .oi
The estimated time frame for design and
preparation of the construction documents

• is approximately six weeks. Bidding and start of construction Is
expected to be In March. Construction of this urea Is estimated at
approximately 3.5 months. Both the lower level construction costs
and the architects fee will be paid from the Civic Center fund which
was established in 1987 for the construction of the main facility
(Fund 13- 51000).

Dear Linda:
I out writing this letter to submit our proposal for all necessary architectural design
services for Interior Impruvements to the Rancho Cucamonga Civic Center. We
understand that the scope of work generally consists of the addition of a
gymnasium /exercise room, restrooms with minimal sbower/locker facWtIM building
maintenance storage room, data processing storage space, and office space for Rancho
Cucamonga Fire Safety and Fire Prevention functions. The size of the project equals
approximately 9,500 square feet of floor area with a tentative anticipated budget of
5275,000.00 to 5300,000.00 for constmctlnn. The City desires to utilize a Construction
Management process and has tentatively selected Berry Constructiou for tilts purpose. It
has also been suggested that electd;l and mechanical engineering design could possibly
be augmented and /or performed by the following subcontractors: Strcech Electrical,
Triangle Mechanical (HVAQ, and JCS Plumbing.
My Interpretation of CAC Title 24 Energy Compliance requires that all plans and
specifications be preyed and signed by a professional engineer registered In the State
of California. Your Building and Safety Division concurs. Mde 24 calculations should
also be prepared and submitted In the same manner. At this time, it Is unclear whether
or not the suggested subcontractors have these available resources. Consequently I have
included fees for these services under the assumption that we will have to provide tL•em.
If the opposite occurs, then we can simply deduct these fees from our overall scope of
senices.
We understand that the most critical consideration pertaining to this project 15 the time
schedule for completion. The City desires construction to commence duriog the last

3. Special Requirements:
a. The open office area for Fire Safety and Fire Prevention requires pr,vate
offices for the following: (1) Fire Marshal, (1) Deputy Fire Marshal, (2)

walls between privnte offices and open office area shall be glazed to permit

will require a total of six (6) calendar weeks In order to complete all preliminary and
final plans, specifications, and cost estimates. At approximately 50% completion, we
propose to submit the final approved floor plan, reflected ceiling plan, and partial

plancheck. While these documents are being reviewed, we shall Sinalize the remainder
of the construction documents and incorporate all plancheck requirements into the
project At tine time we submit a progress set of drawings for plancheck, we feel that the

Council. He stated Almond Street, in him opinion, ham been the
-stepchild- of the ceasunity for some time. He stated the residents in
him area would like to see the street remain 36 foot fr= curb to curb
Dan French, 0380 Almond, stated he agreed with Mr. Woodring and did not
fool the street ahould be widened He suggested the Torso trail be done
like it In supposed to be to beautify the eras, not enlarge it.

Ccuncilmambar Wright stated that part of the staff report reform to the fact
that the City Attorney has stated the City cannot stop the Rodin& Company from
widening the strea , and asked for him to explain how this could g- back to the

Rick Occur, Community out elopment Director, stated it was staff -a intent that
with that recommendation `hey would look at those undeveloped portions that
still remaLl, because there were large contiguous areas that have not boon
improved. He stated those areas that are being improved by the developer are
currently to the aslating standards of 66 foot right- of-way with a 44 feat curb
to curb. He stated what staff is saying is that if the Council des!roe changing
that, they would retrofit theme other scene that have not been built to the 60
foot, 36 feet curb to curb sections
Councilmember Wright stated she agreed with Mayor Stout and would like thin
investigated further, and if needed, to go back to the Planning Commission.

II, who stated there is a correction to the contract, that the.a is an amendment
that changed some of the insurance language. she stated SCS does not want to
change this now so it would be the contract without the amendment. She stated
it has boon reviewed by the City Attorney and was acceptable to him.
James Markman, City Attorney, stated staff Is recommending approval ignoring
pages 122 and 123 of the contract within the agenda packet.
Joseph Miller, Project Engineer of SCS Engineers, stated they have mot
with the f .r cities end County Task Force and have outlined tho Memo for
discuxoio... He stated too project should take about eleven mntho. He
stated the City's recycling element plan was to be submitted by July 1,
1993, and they planned to submit a draft to the State at that time in
order to met the intent of the law.
Mayor Stout asked where the funds required for this would came from.
Diane O'Neal, Management Analyst II, stated that in July 1990 tha County
included a $1 00 charge for creating this element regionally and thone funds are
collected on behalf of cities and agencies She added the payment for thin
contract Would be paid out of theme funds.

REC0.1MATION:
Approve use of Laird Construction under the Emergency Maintenance Repair
Contract with Public Works Maintenance Section for the Resurfacing of
Church Street West of Havei, Avenue to Center Avenue.
BACKGROUND /ANALYSIS
The portion of Church Street from Haven Avenue west to Center Street has
deteriorated considerably in recent months. The C1t1 maintenance crews
have made weekly trips to patch and fill potholes to d point of patching
patches
nelays to completely reconstruct this portion of the road way, to
ultimate width, have been caused by the City's inability to obtain• a
permit from the County Flood Cuntrol, which owns the Basin on the south
side of Church Street at this locattun.
Staff has determined that further d lays will create a public hazard and
a temporary ove -lay is needed before the next rain season.

It is recommended that the City Council adopt the attached resolutions
approving DR 87 -20, accepting the subject agreement and security, ordering the
arinexation to Landscape Maintenance District No. 3 and authorizing the Mayor
aid the City Clerk to sign said agroersent.

guarantee the installation of the off -site landscape improvements in the
following amounts:
Faithful Performance Bond: $2,000.00
Labor and Material Bond: $1,000.00
Copies of the agreement and security are available in the City Clerk's Office.
The Consent and Waiver to Annexation form signed by the Developer 1s on file

WHEREAS, the City Council of the City of Rancho Cucamonga,
California, has for its consideration an Improvement Agreement executed on
January 2, 1991, by Indumar Investments as developer, for the improvement of
public right -of -way adjacent to the real property specifically described
therein, and generally locatrd on the northeast corner of 6th Street and
Hermosa Avenue; and
WHEREAS, the installation of sucH improvements, described in said
Improvement Agreement and subject to the tens thereof, is to be done in
conjunction with the development of said real property ao referred to Planning
Coamissfon, Oevelopoert Review No. 87 -20; and
WHEREAS, said Improvement Agreement, is secured and accompanied by
good and sufficient Improvement Security, which is identified in said
Improvement Agreement.

It is recommended that the City Council accept the Haven Avenue Gateway

Engineer to file a 'Notice of Completion', retain the Faithful_
Performance Bond in the amount of $183,087.95 to be used as tha
Maintenance Bond, and authorize the release of the Labor and Materials
bona and the retention in the amount of $9,154.40, 35 days after the
recordation of said notice if no ciatms have been received. Also,
approve thfi final contract amount of $255,483.43.
BACKGROUND /ANALYSIS
The subject project has been completed in accordance with the approved
plans and specifications and to the satisfaction of the City Engineer.
The final contract amount, based on project documar,tation, is $256,483.43
which includes five contract change orders as follows: Palm Tree Drains,
Pull Boxes, Grouting of Granite Me, installing extra Granite Tile and
change from annual to permanent plants.

It is reeommendeJ that the City Council adopt the attached resolution for
implementation of the following specific conditions prior to designation of a
portion of Cottonwood Hay as a private street and exempting the abutting
properties from requirements set for in Chapter 12.08 cf the Municipal Code.
A. Remove and replace failed portions of existing pavement with 34
asphalt concrete over compacted native soil as determined by
Engineering and Fire Division Widen pavement to 26 feet wide with
3" asphalt concrete over compacted native soil for full length of
street. Overlay 10 thick of asphalt concrete over remaining existing
asphalt concrete.
B Provide documentation indicating minimum of 26 feet •wide private
access easement for the full length of that portion of Cottonwood Way
which extends from Hellman Avenue to approximately 665 feet west of
Hellman Avenue.
C Provide for additional private access essrxent for an emergency
vehicle paved turnaround in accordance with Section 10.207(g) of the
Uniform Firt Code at the westerly terminus of tl above mentioned
portion of Cottonwood Way.
D Barrier protection for existing fire hydrants.
E CC and R's or egjivalent covenant agreement approved by the City
Attorney concerning proper maintenance of Street, signed by all
property owners, within a period of 6 months from City Council
designation of private street.
F. Roadway width to have a height clearance of 14.5 feet.

The above conditions need to be in place, prior to the designation of streets
as private becoming effective, within a period of six (6) months. Ordinance
58 and the requirements for dedication and improvements will still be required
until such tine as all conditions are met and the declaration of private
street becoming effective.
Should the property ormers not comply with the conditions within the Liam
specified, Engineering staff will return to Council at the expiration to
remove the street from the private street list.
BACKGROUND/ANALYSIS
Property which are adjacent to private streets (designated in the County prior
to incorporation) that have not previously been validated by the City as
private are required to dedicate aqw needed right -of -way for the construction
of public improvements mud, unless exempt due to project size or type, are
required to construct needed improvements within these public rights -of -way.
These requirements have become the focal point of objections by owners of
prope-ty�on certain residential streets, particularly in the Alta Lama section
of t.a City, as they developed their property. Their contention was that,
because these streets were unique in nature and are of substandard design and
construction, that the improvement of the street would have a negative effect
on the abutting property and the streets should retain p.ivate.
The Public Safety Commission has recoeeended general guidelin: conditions for
private street designation. The conditions set forth for Cottonwood Way are
consistent with the Public Safety Commission guidelines.
Because of these concerns, on July S. 1989, the City Council adopted an
Ordinance which established a mechanism for the review and determination of
whether a street could be designated as a Private Residential Street. This
would thereby exempt the abutting properties to these streets from the
requirements set forth in the Municipal Code for the dedication of public
right -of -way and the construction of public improvements.
This action regarding Cottonwood Way was triggered by a property owner who.
when applying for a building permit was informed that an offer of street
dedicat Gn, off -site street improvements and other engineering requirements
will be required prior to building permit issuance. The owner contended that
Cottonwood Way, which their property abuts, was private and that tie above
asitloned requirements should not pertain. The proper �r owner was given an
option of riling an application to the City Clerk's office per Ordinance No.
68 -C for the review and determination If the street is pricote and eventually
setting up a public hearing date for the City Council review.
The owner subsequently submitted a petition of owners of property abutting
Cottonwood '.lay (85% of the total parcels affected) requesting that the City
Council make a determination.

Several offers of street dedication exist and are recorded but were not
accepted by the City. Vacation proceedings would have to occur in order for
any declaration of private street to be finalized.
The referenced subject has been sent to the Fire District for review and
comment. Tho main concerns of the Fire District are 26 feet vide emergency
fire access, street capaoility to handle 70 000 lbs of emergency equipment,
roadway width to have a clear height of 14.5 feet and barrier, protection fo;
existing fire hydrants.
The aforementioned conditions need to be in place prior to,the designation of
streets as private, becoming effective. Ordinance 68 and the requiraaents for
dedicatton and improvements will still be requirod until such time as all
conditions are met and the declaration of private street beccmfng effective.

dated November 36, 1990, enclosed is the extension fee amount of
$251.00 and the Improvement Agreement Extension form, executed anti

Dear Mr. Reeder:
This letter is to formally challenge the post census housing unit and
Population counts for the City of Rancho Cucamonga. The official State
census estimate for Rancho Cucamonga as of January 1, 1990 was
114,954 This figure shows a 15 percent discrepancy between th; Federal
count and the State. In looking at the surrounding titles, your count
and the States figure were remarkably close in every instance except
PopulationonCo nteNthe CityPhas1found allopatternnot into siste ciesein
regards to dwelling unit counts and vacancy rates. For example, the
census count indicates that there are no dwelling units in the following
census blocks and we have no evidence that they have been counted:
Tract 20,01, blocks 309 b 310; Tract 20.02, blocks 130 d 134; Tract
20.03, block 101; and Tract 21.00, block 217. Aerial photographs and
field surveys conducted by City staff indicate that there are at least
completed and occupied from n from fourotot twelve These e

believe that there are many more units not counted because they were
recently completed.
Another example of these inconsistencies is the unusually high dwelling
unit vacancy rates in four of our census tracts. Vacancy rates in these
tracts (26.61, 20.02, 20.66, 21.00, d 22.02) range from 8 to 17 percent,
which is substantially higher than the California Department of
Finance's estimate of 7,21 percent for the City (Exhibit "B "), These
high vacancy rates occur in an area of our City where there is mostly an
older housing inventory which, like the older dwelling units that were
not counted, leads us to believe that the census did not provide an
accurate count. A comparison o preliminary census counts with other
titles In our vicinity Indicates 'hat Rancho Cucamonga has the highest
dwelling unit vacancy rates In the area, as much as 5.06 percentage
Points higher than the other cities IExhiblt "C "1, With a person per
dwelling unit averaoe of 3.018, this difference in vacancy rate could
;4 result in an undercounting of at least 5,000 to 7,000 people.

the City has been told by the U.S. Postal Service that a large portion
of the 91701 zip code did not receive census forms in the mail which lea
to door -to -door enumerators being sent to survey and collect the census
forms. Census tracts 20.01 and 20.02, which have unusually high
dwelling unit vacancy rates of 17.1 percent and 6.95 percent
respectively, are located within the 91701 zip code. The City has also
rcc^ived numerous calls from residents within tract 20.01 reporting that
entire blocks did not receive census forms in the mail. Again, the
91701 zio code area is one of the oldest sections of our City where the
housing 15 mostly twenty to thirty years old and we know that there is a
low housing vacancy We have learned that many of the enumerators
working in the City were not from this area and were not familiar with
Rancha Cucamonga. This is another case where we are certain that the
census counts are inaccurate.
Considering that dwelling units for entire blocks vere not Counted and
given the unusually high. duelling unit vacancy rates in areas where we
know that there are low housing vacancies, ee feel confident that the
census counts are inaccurate and we formally reouest that the Department
of Census recount census tracts 20.01, 20.02, 20.06, 21.00, and 22.02.

available. We view the financial imp,ct of the undercounting very
seriously because It could result in an annual loss of revenue of three
quarters to one million dollars which in turn would result in lost

Bureau to correct these inconsistencies in the preliminary census.

WHEREAS, tha preliminary Census counts understated the population of
Rancho Cucamonga, by an estimated 14,9941 and

impact upon the nations urban areas such as Rancho Cucamonga) and
WHEREAS, the Census Bureau has developed a statistical methodology for
correcting the undercount but the Commerce Department has refused to use thin

SUBJECT- REPORT ON EXPANSION OF THE PLANNING C(MMISSION
RECOMMENDATI0N: That the City Council consider the policy question of
We—TY'Re—WEFe Planning Commission and give staff policy direction for
implementation.
BACKGROUND: The City Council established the first Planning Commission
roil . Since its inception it has been a five- member commission. At
the November 21, 1990 meeting, the City Council raised the issue about
the appropriate size of the Planning Commission. This discussion was
continued to this meeting to allow staff thr opportunity to prepare some _
background information on the matter for O..e Council's consideration.
The Planning Commission's role is to deliberate on planning and
development matters of the City and make land use decisions that are
consistent with the policies and plans formally adopted by the City
Council. The Commission also makes recomiendatlons on matters that are
referred then to the Council.
Staff has completed
a survey of
the cities within San Bernardino County
and found that eleven titles
have five- member
(or less) Planning
Commissions and nine
titles have
six Cmntssion members or greater.

The following is a list of issues that may be considered when
determining the appropriate C". issimn size for Rancho Cucamonga:
• The number of Commissioners and the composition of those
Commissioners should reflect objectivity and consistency
• The larger the membership, the greater the potential for a
broader scope of opinion•., expertise, and interest; however,
theoretically this broader scope may also result in longer
meetings and a longer hearing process.
• The larger the membership, the greater the demand on staff time
and resources (i.e., agenda preparation, meetings, orientations,
and training).
• The 'arger the membership, the greater the expense (i.e., agenda
preparation, salary, meetings, and travel). The 1990••91 Planning
Commission budget 1s $18,070.00 or $3,614.00 per Commissioner.
• The larger the membership, the greater the difficulty in
coordinating Commission activities (i.e., special meetings,
workshops, etc.)
• The larger the membership, the greater the flexibility for
rev!ewing more issues through sub - committee and special task
force assignments, as directed by the City Council or Planning
Commission as a whole. However, this too may require more staff
time.
CONCLUSION: Staff was unable to locate a statewide or regional basis
or a size of a Planning Commission. From our investigation, we found
that it simply comes down to a policy question that each cormunity must
resolve. Therefore, staff recommends that the City Council consider your
philosophical perspective and give policy direction either reaffirming
the current number of menbers on the Planning Commis ion or revising tha
size of the Commission.
