Regular Meeting
CALL TO ORDER
The regular meeting of the Planning Comminsion of the City of Rancho Cucamonga
wan held in the Lions Park Community Center, 9161 Base Line, Rancho Cucamonga
on Wednenday, April 9, 1900.
Meeting was called to order at 7:00 p.m. by Cliairman Rempel who led the meati.ng
with the Pledge of Allegiance.

MINUTES
The Planning Cominission minutes of March 12, 1980 were approved upon a motion by
Commissioner Jones, seconded by Commissioner Garcia and unanimously carried.
ANNOUNCEMENTS
Joan Kruse was introduced.
Jack Lam reminded the Commission of the Irvine tour on April 3.2, 1980, 8:00 a.m.
at the Lions Park Community Center.
Mr. Mogan informed the Commission of the Alta Loma Cable TV completing their
requirements.

Chairman Hempel naked for questions from the Commission of the staff. There
being nine, the public hearing wall opened.
Wayne Hendrycku, Krcuper Engineering and Aanociatea of San Bernardino, repre-
senting Josey Barkan (applicant), questioned the utocking of vehicles. The appli-
cant naked for 14 foot high stacking, n minimum of 150 feet from the wall. The
applicant also questioned the width of the opening from Whittrnm Avenue.
Mr. Vairin explained the zoning ordinance requirements in addition to the fire
district requirements.
Chairman Rempel naked for questions of the applicant.
Camainaioner Tolutoy asked what the type of vehicle storage in proposed.
The applicant explained it will be auto dismantling specializing in foreign
cars.
Commissioner Tolutoy asked how the stacking would be done.
The applicant explained it would be done stacking in the rack.
Chairman Rempel naked if there are any other questions. Chairman asked if
there are any others in the audience wishing to speak in favor or opposition
of the request.
There being none, the public hearing wns closed.
Chairman Rempel asked for additional comments f -,om the Commission.
Commissioner Dahl made a motion to adopt Resolution No. 80 -19 with the change
to Section 3, Item 2 to change that auto bodies shall be stacked no more than
14' high within the line of site of the 8' fence to a maximum of 14'. Jones
seconded the notion.

Barry 11agan, Senior Planner, reviewed the staff report, and reported thnt tho
request in consistent with the General Plan.
Chairman Rempel opened the public hearing for all shone who wuuld like to "peak
on the zone change request.
There being, none, ttie public hearing wns closed.
Commisnioner Junes recommended adoption of the Resolution which was seconded
by Commlabioncr Garcia. The motion was unanimously carried.

Chairman Rempel asked for questions from the Commission of the staff. Chairman
naked what the size Lot 1 was in the Staff Report that was 20,000 square feet.
5tcff indicated that the parcel map would return to the Planning Commission for
consideration and Lot 1's configuration would be reviewed at that time.
Chairman Rempel asked whether the applicant was present. They were not. Chairman
Remepl then asked whether or not these were any in the audience wishing to speak in
favor of or opposition to the zone change.
There being none, the public hearing was closed.
Chairman Rempel asked for comments of the Commission.
Commissioner Tolstoy asked what the size of the lots were on Amethyst.
Paul Rougeau replied they were half acre or greater.
Commissioner Bahl expressed his desire that the applicant be notified of the
Commissions' concern on the site layout with particular consideration to the
configuration of Lot Ill.

Mr. Vairin explained that tl +is in preliminary to subdivisions which might occur
when the Growth Management Allows the filings on August 1.
Chairman Rempel asked if thle applicant w.ahed to add anything to this report. Aft

Chairman then asked if there was any opposition to the report.
Cindy Craig on Teak Way asked what would be built on that property, alld asked
whether one or two Story buildings could be allowed. She felt that some of
the privacy could be lost if two story homes were allowed.
Chairman Rempel assured Mrs. Craig that the City would look into the development
of the property very closely. Chairman Rempel then naked tf there were any others
wishing to speak.
There being none, Chairman Rempel closed the public hearing.
Commissioner Garcia moved for recommendation of approval of the zone change to
the City Council, seconded by Dahl. There being no further discussion, the motion
was unanimously approved.

NEW BUSINESS
TENTATIVi: TRACT NO. 11428 - DATA DESIGN_ Located north of Foothill Blvd.
between Center and Haven.
Thin item was presented by Jack Lam, Director of Community Development.
Commissioner Tolutoy naked n question relativu to the building oet -bnck from
Door Creek. Ile was concerned that there may not be enough land available.
Paul Rougenu explained that there was enough land since the channel itself was
35' to 45' wide.
Chairman Rempel naked for comments from the applicant.
Carlton Lockwood, spoke for the applicant and requested thnt sidewalks be struck
from conditions of approval. Ile also asked that Condition 03, Section 3, that
additional statement be added tht would ullow tither means of flood protection to
minimize building net-back now required by the condition.
Counniunioner Tolstoy expressed some concern regarding amendment to Condition 03
because of the flow during storm periods. Ile expressed concern that we might
be creating a dangerous situation for the structures.
Mr. Lockwood felt that the City would be protected if the flood control had to
approve the alternative measure also.
® Commissioner Garcia asked if the condition might read: A 100' building set -back
line from the flood control right -of -way shnll remain In force until permanent
drainage facilities are installed-in Deer Creek or other alternative measures
acceptable to the San Bernardino County Flood Control Department.
After much discussion over whether or not the condit:iona should be allowed, Chairman
Rempel recommended approval of Resolution No. 80 -15 subject.to amendmenta to Section
3, Condition U3 as stated by Co:mniasioner Garcia with the addition of "and to the
satisfaction of the City Engineer ". Also sidewalks should be deleted. Seconded
by Commissioner Garcia.
The Planning Commission vote was 3 -2 with Commissioner Tolstoy and Commissioner
Dahl in opposition due to the flood control problems.

Report presented by Michael Vairin.
Commissioner Garcia asked if this was an out - pntient clinic or would there be
overnight staying.
Staff referred the question to the applicant.
The Chairman asked for questions or presentation by the applicant.
Ron Payne, of Sigma Share, stated in answer to the question that it was an out-
patient and in the evenings there would be classes and seminars no later than
10:00 p.m. There would be no weekend activity, seminars or classes. Traffic
presents no problem. The people that come to them would not be intoxicated.
If they are, they would be arrested.
Commissioner Tolstoy asked if the service was treatment and education. Alk
Mr. Payne replied that they are both.

Mr. Payne replied the amount of uparu of aren available and secondly the coot.
Cmtunionioner Tolotoy exprooned his concern with the request and wondered whether
or not the M -it zone should contain these kinds of uses which do not operate
within the industrial area but to the greater community.
Mr. Lam explained that there is a brondar conaiderntion. The General Plan indi-
caten the area for industrial use. One of the key issues that is under conaidern-
tion by the 7nduatrinl Committee of the Chamber of Commerce in the whole issue of
what• arc appropriate uses in the industrinl area. The concern in twofold; one is
that the gateways to the industrial area seem to be developing in a commercial
strip and that is looked at no undesirable and the second point in given the stnto
of the market now, the more non -basic industrial uses that are put in the industrial
area take away from the acbnlniatrative•.profenoional areas primarily because of
coot. The matter before the Couunivaion tonight is not only whether it i.s consis-
tent with the M -R zone but also how the General Plan no interpreted by the Plan-
ning Commission.
Commissioner Dahl made a motion that the partciular use be allowed on the baoi.a
that it is similar to the other allowable uses in the M -R zone district subject_
to Site Approval. Seconded by Commissioner Jones.

There being none, Chairman Rempel closed the hearing.
Motion 4 -1. Commissioner Tolotoy wanted th.n_ record to show that he is not against
the project but feels it in an inappropriate use in the industrial zone.

TENTATIVE TRACT MAP NO. 11434 AND ENVIRONMENTAL. ASSESSMENT - R. R. WILCOX - The
division of 8.10 acres of land zoned MR into 10 lots located on thP. northwest cor-
ner of Seventh Street and Hellman Avenue.
Paul Rougeau, Associate Engineer, reviewed the staff report in detail. Upon con -
clusion of the staff report, the staff recommended issuance of a Negative Declara-
tion for the map and approval of the map with the standard Engineering conditions
and special conditions listed in Resolution No. 80 -20.

Chairman Rempel asked for questions from the Commission to staff.
Commissioner Tolstoy asked what the existing uses were to the north of the subject

Paul Rougeau stated that '.hero was a mixture of residential and industrial with
three single family rasidential dwellings located on the northeast corner of the
subject property.
Chairman Rempel asked if the applicant was present and whether or not they would
like to add to the staff report.
Bob Mim Mack of Mim Mack Engineering, stated that they would like the Planning Cohn -
mission to consider changing condition three of the Engineer's report to Pitlher
require non - vehicular access to Hellman on lots 1 and 2 or lot 1 only. Oated
that the main entrance would be from lot 10.
Chairman Rempel asked for any further convents from the applicant or au0t:r.i•..
There being none, Chairman Rempel asked for further discussion from the Planning
Commission. The Commission discussed the idea of limiting access to Hellman and
whether that access should be limited to lots 1 or lots 1 and 2. The consensus
of the Commission was that limiting access to lots 1 and 2 would make more sense
and be more compatible with the present access policy previously approved by the
Planning Commission.
A motion was made by Commissioner Tolstoy, seconded by Commissioner Garcia, to
approve Tentative Tract Map No. 11434 and issue a Negative Declaration based upon
the conditions and findings listed in the Resolution No. 00 -20 and changing con-
dition 3 to prohibit access from Hellman Avenue to lots 1 and 2.

conformance with the General Plan and Zoning Ordinance pending adoption of the

ration based upon review of the Initial Study and approval of the project based

In addition, it was recommended that the condition listed to require the removal
of the illegal uses on the front of the property be done prior to the issuance of
building permits.
Commissioner Rempel asked the Commission if they had any questions of staff regarding
the staff report. The Commission asked several clarification questions which were
responded to by staff. Commissioner Rempel then asked if the applicant was present
and whether or not he had anything to add to the report given.
Cary Ocumura, the project architect, made further clarifications to the project
and answered questions for the Planning Commission.
A motion was made by Commissioner Tolstoy and seconded by Commissioner Garcia, to
approve Director Review No. 80 -16 and issuance of a Negative Declaration based upon
the findings and conditions listed in the Resolution of Approval with the amendment
by staff.

Michael Vairin, Associate Planner, reviewed the staff report in detail which is on
file in the Planning Division. Ile reported concerns relative to the park not meet-
ing the existing code standards for n mobile home park. Further, lie stated that
substantial revisions will be necessary in order to bring the park into conformance
with the present standards as set forth in the Zoning Ordinance.
The Planning Commission discussed the different types of improvements they felt
were necessary in the mobile home park to portray the character which the community
would like to see in such developments. The majority of the Commission felt that
the proposed design did not meet the present standards of the City Code and would
require substantial redesign.
Commissioner Rempel felt that enough time had already been spent on the review of
the project and significant revisions have already been made to the project and
that mobile home parks are an entirely different kind of development providing a
different kind of life style..
A motion was made by Commissioner Dahl and seconded by Commissioner Garcia to re-
turn this item to the Design Review Committee for their review and recommendations
on design considerations and brought back to the Planning Commission for tindl review.

Commissioner Rempel stated that he voted no because he was opposed to the additional
time constraints placed on the project.
APPEAL OF PARCEL RYAN 5893 - BARTON - Dividing a lot into two parcels for the
property ocate on the north side of Victoria between Etiwanda and East Avenue.
Paul Rougeau, Associate Civil Engineer, presented the staff report in detail, which
is on file in the Engineering Division. He reported that the applicant is opposed
to the installation of street improvements which is a requirement that has been
established through Ordinance by the City Council. He further reviewed for the
Commission the technicality that the Commission cannot overturn an Ordinance re-
quirement and an Ordinance amendment would be required in order to allow deviation
from the Ordinance policy.

Chairman Rempal asked the Commission if they had ruestions of the staff regarding
the report. There being none, Chairman Rempal asked the applicant if he had a pro -
sentation to make.
Mr. Bob Barton addressed the Commis, ion, stating his concerns for the appeal. Ba-
sically, Ire reported that installation of street Improvements at this time would
not be warranted given the fact that either side )f iris parcel was not improved and
that such improvements may destroy trees in the area and that a sidewalk would lead
from nowhere to nowhere.
The Commission responded to Mr. Barton by statinl that it is the City's policy to
require the installation of improvements and that we could be flexible on the in-
stallation of the sidewalk and trying to save thr existing trees.
A motion was made by Chairman Hempel and secondeli by Commissioner Dahl to deny the
appeal and direct staff to estahlIsih a bond for ,lie construction of the sidewalk
at a later time and work with the applicant to s;ive as many trees as possible.

review of the Master Plan for the Ranc o ucamonla Business Park generally located
on the southeast corner of roothill Boulevard ant; Haven Avenue.
Michael Vairin, Associate Planner, presented the staf' report in detail, which is
on file in the Planning Division. lie reported tlat this is a review of the concep-
tual master plan for the entire Business Park development. This review will also
include review of the Environmental Impact Report and whether or not the EIR is
adequate in terms of its contents and findings. 4dditionally, Mr. Vairin stated
that two actions would be necessary for this item, one being the finding that the
EIR is adequate, the other being approval of the : onceptual master plan. Mr. Vairin
reported that a master plan is generally consistent with the overall goals and po-
licies of the City for this area and that the EIR, is adequate in terms of the re-
quirements of the State Environmental quality Act and Local City Environmental Or-
dinances. Mr. Vairin reported that detailed pampllets and brochures have been de-
veloped by the applicant and are included in the Commissioner's ppackets for their
review and consideration. A further detailed presentation wi11 be done by the ap-
plicant and questions may be addressed to the applicant for detailed explanations.
Chairman Rempet asked the applicant to present his material.
Jack Corrigan, of the Dacin Corporation, addressed 1,,he Planning Commission and intro-
duced his development staff. lie stated that the is available for any questions or
comments that needed to be clarified and that he would turn over the presentation
program to the project planner, Gil Martinez.
Gil Martinez approached the Planning Commission and presented a detailed exhibit
with slides, sketches and narration.
Chairman Rempel asked the Commission if they had ani questions of the applicant.
Commissioner Garcia asked the applicant to give a more detailed description of.their
concept of water carrying streets and how flood con•.:rol and drainage of the project
will work.

Mr. Gil Martinez outlined the various aspects of flood control within tile project
and how the design of the project and the streets were done for drainage and flood
control purposes. Further, he explained that the phasing of the project is duo to
the timing of improvements to 7cer Creek and other flood control measures. The
perimeter of the project area will be developed first with the central region of
the project area developing last as tiie central area of the project is most suscep-
tible to flooding.

Commissioner Garcia requested that the applicant discuss the traffic circulation
concepts and how the circulation system will function.
Paul Wilkinson, traffic engineer for the applicant, approach the Commission and
in detail outlined the circulation system proposed for the prnjoct, including sig-
nalized intersections, traffic volumes, stop signs, and projected street capacities.
Commissioner Garcia was concerned about the projected air pollution impacts that
may be caused as a result of this project.
Sandra Gaffney, representing the EIR consultant for the applicant reviewed the air
quality aspects of the project with the Planning Commission. She reported that
the EIR lies incorporated mitigating measures as requested by the South Coast Air
Quality Management District.
Commissioner Garcia asked if there is any analysis within the EIR relative to fis-
cal impacts of the project to the City.
Sandra Gaffney, the EIR consultant, reported that the fiscal impacts of this project
to the City are very positive. Long range analysis indicates that the City would
gain a revenue of approximately $161,000 per year.
Chairman Rempel asked if there were any other questions from the Commission to the
applicant. There being none, he asked if anyone in the audience had any comments
to make. There being none, the Chairman asked the Commission if there were any
further questions or discussion on this project.
There being no further discussion by the Commission, the motion was made by Com-
missioner Dahl and seconded by Commissioner Tolstoy to approve Director Review No.
80 -12 and find that the EIR for the project is adequate.

Mr. Michaol Vairin, Associate Planner, reported in detail the findings of the staff
report to the Planning Commission. Ila reported that this phase of the project has
been designed in accordance with all apilicable zoning ordinances, General Plan
and other development standards. Ile reported that the Design Review and Develop-
ment Review Committees both have reviewed them and had the sonic concern that the
single lot /single building portion of the site is too rigid and not flexible in
its design nor site planninq. Ile reported that the applicants are providing sonic
additional information this evening that would hotter show what kind of develop-
ment will be done as a result of this proposed design and that the Commission has
the opportunity to review 'those additional plans and -Iecide whether or not the pro-
posed development is one which meets the standards of the City.
Chairman Rempel asked for questions of the staff report from the Commission to staff.
Some questions were asked relative to clarification on the access policy which were
clarified by staff. There being no further questions from the Commission to staff,
Commissioner Rempel asked if the applicant had anything to add to staff's presen-
tation.
Jack Corrigan of Doan Corporation, reported to the Commission that they have changed
the project to reflect sonic of the concerns of the Design Review Committee. In
addition, lie reported that they have prepared additional graphic representations
of the project as it may look when constructed. lie stated that any further ques-
tions or details of the architectural design of the project can be referred to his
design team.
Commissioner Dahl asked if there were areas intbis phase that could incorporate
the use of benches or seating areas to create a better atmosphere within the park.
Gil Martinez responded by indicating that there are mounded areas and landscaped
areas where such furniture could be incorporated. Me further reported that the
designs of the f+.cility would be low key park -like settings with high quality and
a significant amount of landscaping. Ile further reported that this site contains
approximately 18 percent landscaping which is somewhat higher than even the stan-
dards used by Irvine.
Commissioner Garcia voiced concern to the applicant that this phase of the project
is so significantly different thatn the rest of the project in that the denZity
of the building is extremely high and the amount of open space and site design is
much less.
Mr. Corrigan of Doan Corporation stated that they have done several market studies
in the area which have indicated that there is a great need for a small industrial
business complex. Phase I of this project is not intended to be repeated through-
out the rest of the project and Doan is willing to comply with all landscape stan-
dards and zoning ordinance requirements.
Commsisioner Garcia stated that some focus on main entrances into the project would
significantly increase the aesthetics of the project and asked whether or not such
could be accomplished.

Mr. Corrigan stated that increased landscaping and designs can be applied to those
main entry arras to hole accomplish this.
After no further discussion, it was moved by Commissioner Garcia, seconded by Com-

The Planning Commission discussed the appropriateness for the use of flags. Much
discussion centered around the idea of developing a pilot program to see whether
or not the flags would be an appropriate use for attracting potential tenants to
this particular site. After considerable disucssion, it was finally decided that
a pilot program of something along that line should be developed by the Design
Review Committee and brought back to the Planning Commission for their review and

explained the reason for the requested change to 10,000 square foot lots in thin
area. lie further explained that the property to be developed would be properly
buffered to ensure computability with existing properties with animals.
Mr. Floyd Herman, 9446 Banyan, Rancho Cucamonga, addrenacd the Commission and ex-
presned concern that rezoning to a smaller lot size than presently exists would
precipitate complaints from future residents about smells from adjacent animal
properties. Mr. Berman also indicated that lie felt the existing water line would
be a better place to start 10,000 square foot lots than +ghat was propelled by the
developer.
Mr. Al Haven, resident on Banyan Street expressed hill concern that down sizing
lots in this area would result in problems for current reuidento who have animal
property. lie also cited that increased density would result with lot size changes.
Commission discussion ensued relative to lot oizca to preclude a "cookie cutter"
look.
There being no further comments from the audience, Chairman Hempel cloned the
public hearing.
Motion: Moved by Garcia, seconded by Dahl, carried unanimously, to approve
Resolution No. 80 -27, with the condition that all prospective buyers in this
proposed tract be made aware of the adjacent animal properties.

Mrs. Charlotte Wykoi'f, Administrator of the California Learning Centera, addruaned
the Comminuion. She explained the number of students and parents her enterprise
nerves in both Upland and the City of Hancho Cucwnongn at the present time. In
antiwar to Commission quentions regarding the number of nquara feet required per
preschool child, she indicated that state codes require between. 20 -25 square feat.
Chairman Hempel asked if anyone wished to speak in opposition to this proposed
site approval.
Mr. Del Ilubbard, 7234 Hallman .Avenue, indicated that he represented a large rnmr-
ber of property owners in the surrounding area who were opposed to thin preschool
and who had signed petitions citing their disapproval. Of concern to Lire oppos-
ing property owners was alteration of the rural atmosphere; noise, increased traf-
fic and the possibility of displacing those residents with animal property.
There being no other comments, Chairman Hempel closed the public hearing.
Planning Commission discussion ensued relative to provision of a block wall around
tlse proposed preschool, a corner cut -off on the northwest corner of tlse wall to
allow proper vision by oncoming traffic, and a condition that children in the play
® arcs, be impeded from entering the parking lot and street.
Following discussion, the Commission felt that the items of discussion should be
left to staff for decision.
It was moved by Dahl, seconded by Tolutoy, carried unanimously, to approve Hcs-
olution No. 80 -28, subject to the conditions of approval and correction to con-
dition No. 8, amending the hours of operation.

Chairman Hempel requested that Item K, Carnelian Street Landscape Demonstration
Project be moved up in the agenda.
CARNELTAII STREET LANDSCAPE D174ONSTRATION PROJECT - from Church Street to Beachwood
Drive.
Mr. Jack Lam, Director of Community Development introduced the report, and Harry
Mogan, Senior Planner, discussed the item.
Mr. Stephen Long of Genge and Associates, consultants for this project, introduced
Mr. Alan Fishman and Mr. Nark Drennan, who had worked on this preliminary report.
The consultants reviewed for the Planning Commission, the existing conditions and
® urban framework of Carnelian Street, citing drainage, view, image of the community,
and the plan goals and design objectives. Following the explanation of various
conceptual designs for Carnelian Avenue, slides were shown to the Planning Com-
mission, depicting proposed landscaping alternatives.

The Planning Commission questioned the spread of tress that would form canopies
over the strooLn and whether considerable maintenance would be required after ma-
turity of the tress wan reached.
Mr. Alun Fishman of Gongs Consultants, answered that the trees would roach it height
of 30 -h0' and would not require pruning. The trees would form an umbrella that
would cover the entire street.
The Commission spoke to the issue of coots of landscaping. The consultant stated
that the cist of Concepts A and B, which were presented, would be about the name.
In toduy's dollars, approximately 3 -1/2 miles of landscaping would coat about
$600,000.
Barry Hogan, Deals]- Planner, asked the Commission to make a determination of prior -
itiea and concepts to forward to tltc City Council for action.
Commissioner Rempel asked if there were a possibility of working out a cooperative
agreement for development of the commercial node lundscaping and also requested
that the planting of pecan tress be investigated because of their easy care and
attraction to birds.
Chairman Hempel asked if there wan any discussion from the audience.
Gharon Romero, member of the Citizens Advisory Committee, stated that the majority
of the CAC recommended thrt work on Carnelian Avenue landscaping proceed from Foot-
hill Boulevard, north. Bile stated that the Commission also recommended that one
variety of treen be planted. It wan the feeling of the Commission that this pro -
ject would have immediate positive impact on the community.
Motion: Moved by Tolstoy, seconded by Dahl, carried unanimously, that the Planning
Commission recommended adoption by the City Council of Concept D, alternates 1 and
2. The Planning Commission fur:;hcr recommended that the project start at Foothill
Boulevard and proceed northerly. They also requested that consideration be given
to the flood Control project at the Cucamonga Creek to avoid any conflict in chan-
nel construction and the landscaping project.
ADOPTION OF INTERIM RECREATION I:LI21ENT'TO THE GENERAL PLAN
Mt. Tiro Beedlc, Associate Planner, reviewed the staff report and provided the Plan-
ning Commission with information relative to the adoption of the interim Recreation
Element to the General Plan.
Brief discussion ensued among the Commissioners concerning urbanization factors
contained in the draft element.
Community Development Director, .Tack Lam, advised the Commission of the urgency
of providing the Interim Recreation Element to the General Plan and stated that
Serlway /Cooke, the City'r consultants, were in the process of developing one.
Following discussion by the Planning Commission on the interim nature of this ele-
ment, it was moved by Tolotoy, seconded by Dahl, carried unanimously, to adopt

Community Development Director, Jack Lura, gave an introduction to the Planning Com-
mission on the concornu relative to the condominium conversion ordinance. ,
Barry ilogun, Senior planner, briefed the Conuniunion, stating that what the Cormnis-
sion had before them was the reault• of their comments and those of tare City Attor-
ney, at the last Planning Conunianion meeting. Ile indicated that; tho number of
dwelling units was left blank. The intent of tiro ordinance in act to control rmit,
but to limit the conversion of units from apartments to condominiums. Mr. Ilogan
further indicated that thin ordinance wan different from those or other communities
in that conversion wan riot tied to the city'n vacancy rata.
Mr. Hogan related to tiro Commiuuion, the number of apartments currently in th- city
and stated that C G L Developers, with 1311 units, had filed for conversion. Sun -
scope Apartments with h25 lrnitn had alno filed. Mr. Hogan further related that
some duplex units near the Magic Lamp restaurant have alou submitted their requent
for conversion.
Information from the State Map Act wan provided. Mr. Ilogan stated that if tine City
does not have it condominium conversion ordinance, the City then does riot have the
right to act standards on these units. Mr. Hogan indicated that the ordinance be-
fore the Planning Commission wan a compendium worked out between the Chamber of
Commerce, Developers and City staff and that not all points of the ordinance were
in total agreement by all parties.

The developers, in general, felt that the law of supply and demand ghoul d govern
whether condominium conversion should be allowed in the City. They felt that
restrictions act by the City would hamper any additional. rental unit construction.
'there was considerable discussion by tire Commission. Jack Lam nuked the Planning
Commission for direction in that one -third of the units in the.City were being pro-
posed for condominium conversion.
Further discussion ensued. It was moved by Tolatoy, seconded by Dahl, carried
unanimously, that Commissioners Dahl and Tolstoy be appointed to a committee to
further study the Condominium Conversion ordinance, with input from Staff, the
Chamber of Commerce and Developers.
Moved by Dahl, seconded by Hempel, carried unanimously, to adjourn at 11:25 p.m.,
with the provision that the Comprehensive Grading Ordinance be the first item of
new bunineso on the next Planning Commission Agenda.

within the A -1 (limited agricultural) zone locatodon the west
side of Etiwanda Avenue north of Summit, 5992 Eitwanda Avenue
BACKGROUND: This review is for environmental assessment to determine any
s gnif cant adverse impactson the environment as a result of the parcel map
herein described. To determine significant adverse impacts, an Initial
Study of environmental concerns is prepared. Upon completion of that study,
envdence would indicate either no significant impacts or the potential for
significant adverse impacts. If a determination of no significant impact is
made, based upon the Initial Study, then a Negative Declaration may be issued
for the project. If significant impacts are found, then an Environmental
Impact Report should be required to fully analyze the potential impacts of
the project.
The applicant is requesting to divide approximately five (5) acres into four
(A) parcels of approximntley one (1) acre e.ich. This subdivision will create
a legal lot for ownership purposes for an existing residence fronting on
Eitwanda Avenue, with the remaining parcels to be available for future develop-
ment. The zoning is A -1 which requires a one acre minimum lot. The General
Plan designates this area as windrow - residential, .1 to 3 units per gross acre.
ENVIRONMENTAL SETTING: There is an existing single family residence fronting
upon Et wan a Avenue, with the remainder portion of the site being undeveloped.
There are Eucalyptus windrows on the north, south, and east property lines.
A 30 foot offer of dedication, in favor of the County, exists as an easement
for road purposes along the south property line, and the City of Rancho Cuca-
monga is requiring an additional 10 foot offer of dedication for road purposes.
At such time as future development occurs on the parcels created by this
subdivision, the applicant will be required to install full street improve-
ments for the proposed street, Amber Lane, along the south property line.
Construction of said street improvements necessitates removal of a portion of
the existing Eucllyptus windrow, and replacement planting would be required
by Code. The following is the adjacent Land Use and Zoning of the site:

BACKGROUND: Recently, the Planning Commission was approached by the Sigma
Share Foundation requesting a determination as to the similarity of their
proposed use in relationship to other uses permitted in the M -R zone. The
Planning Coannission voted 4 -1 to consider approval of the alcohol rehihblll-
tation center subject to the site approval process in tlhe M -R zone. Tile ap-
plicant has submitted the appropriate applications and fees and is requesting
review and consideration for the establishment of an alcohol rethabilitation
center.
ANALYSIS: The Sigma Share Foundation is a non - profit organization which has
develop d a program for tile correction of substance abuse. The applicant
has described the program strictly as an outpatient program with instructions
and seminars provided for industry and the public. The most important issue
relative to this use is the adequacy of parking. Presently, there are nu-
merous group'hore
in-
structions and seminars will be held in the evening from approximately 6:00
p.m. to 10:00 p.m., when the highest use of the parking lot would be required.

nesses nesses in the center are closed by that time with all of their parking spaces
available. During normal business hours, the applicant anticipates there
will be a need for 5 -6 parking spaces. This is well within the limits of
the code. To insure that no future problems arise relative to parking and

quire periodic parking surveys, inspections and analysis to determine if
proglems are being created as a result of the project within the center. If
problems have arisen which cannot be solved between the applicant, property
owner and staff, then the project will be brought before the commission for
their review and consideration.
This item has been advertised in the Daily Report as a public hearing and
property owners have been notified. To date, no correspondence has been re-
ceived on the project. q
RECOMMENDATION: It is recommended that the Planning Commisr.on review the
above request and analysis and find whether or not this project request meets
the standards and desires of the Planning commission.

A RESOLUTION OF THE RANCHO CUCAMONGA PLAN-
NING COM14ISSION APPROVING SITE APPROVAL N0.
00 -08 LOCATED ON THE NORTHWEST CORNER OF
ARCHIBALD AND SEVENTH STREET IN TIIE M -R ZONE.
WHEREAS, on May 23, 1980, a formil application was submitted
requesting review of the above- described pr -jrct; and
WHEREAS, on June 11, 1900, the Planning Commission held a duly
advertised public hearing for the above- doscribed project.
NOW, THEREFORE, THE RANCHO CUCAMONGA PLANNING COM14ISSION RE-
SOLVED AS FOLLOWS:
SECTION 1: That the following findings have been made:
1. That the site is adequate in size and shape.
2. That the site has adequate access.
3. That the proposed use will have no adverse
effect on abutting property.
4. That the proposed use is consistent with the
proposed General Plan.
® 5. That the conditions listed in this report are
necessary to protect the public health, safety,
comfort, convenience, and general welfare.
SECTION 2: That this project will not create significant adverse
mpacts on the environment and a Negative Declaration is issued
on June 11, 1980.
SECTION 3: That Site Approval No. 80 -08 is approved subject to
t e- fo owing conditions:
1. That all provisions of the zoning ordinance
and all other applicable ordinances of the City
be complied with.
2. That no group instruction or seminars be held
prior to 6:00 p.m.
3. Periodic checks shall be conducted by the Staff
to determine if such use is causing problems,
at least every two months.
4. Approval of this request shall become null and
void if building occupancy is not granted within

RELATED ITEM: Zone Change No. 00 -05
BACKGROUND: The Planning Commission and the City Council recently appIroved
a zone change from R -1 -1 to R -1- 20,000 square feet for this site. At tha time
of tike review of the zone change by the ConuiAssion, concern was expressed over
the subdivision of this site, relative to the size, shape and configuration
of the lots being proposed. As a result the Commission requested this parcel
mal, come before them for their review and consideration.
ANALYSIS: The Commission's concerns were centered around the shape of for
1 and the minimum amount of frontage on lots 2 and 3. Exhibit "A" displays
the division as proposed by the applicant. As you can see from the exhibits,
lots 2 and 3 have approximately 31 and 32 foot frontages. Lot 1 has depths
ranging from 186 feet at its deepest point to 90 feet at approximately midway.
The applicant's reason for tike configuration of this subdivision is the fact
that the area has a steep grade and that the design of the street was proposed
in order to try to provide the most reasonable sloped street. The applicant
feels that it is the best solution for the present grade of the project site.
Lot 1 does have appropriate depth and usable area to construct a house within
the given setbacks and still maintain sizeable and usable open space. The
concern on the widths of lots 2 and 3 is valid as the lots are not the minimum
required widths at the building setback line by Code. Code requires a minimum
of 60 feet in width at the point where the front yard setback line intersects
the side lotlines. In this case, the width of the lot at the frontyard set-
back line of 25 feet is approximately 5C feet. The boundaries of lots 2 and
3 could be adjusted northerly to meet Code requirements.
An alternate street design could be done as shown on Exhibit "B ". However,
this would require the applicant to completely rethink the grading of tike
site and it is not known whether or not such design would be feasible given
the present grade of the site.
The Planning Commission, has two options; 1) require the applicant to adjust
the lines of lots 2 and 3 to meet the minimum Zoning Ordinance requirement in
terms of minimum widths, and accept the modified map, or 2) require the ap-
plicant to provide additional street design and lot configuration studies for
your review and consideration.

condominiums. The project site is located on the north side of Nine -
teonth Stroot, between Cornolion and Beryl in the R -3 (Multiple -
Family Residential) Zone, and generally known as Sunscape II.

ABSTRACT: On May 21, 1900, the City Council adopted an urgency ordinance lmpos-
nng a moratorium on the filing, processing and approval of final maps for sub-
divisions created by conversion of five or more parcels or conversion of dwel-
lings to stock cooperatives containing five or more dwelling units. The ques-
tion was asked of the City Attorney, at that time, whether or not Sunscape II,
presently under construction, would come under the provisions of this ordinance.
It was the City Attorney's opinion that Section 1, Subsection c, stating "the
unrestricted conversion of available multiple family dwelling units to condo-
miniums", clearly exempts Sunscape TI because the units are not available for
occupancy at the time of enactment of this ordinance. Consequently, Lewis Homes
is proceeding with the conversion of this previously approved apartment complex
to condominiums.
DISCUSSION: Attached, please find a copy of the staff report describing the
project as proposed as apartments. As you will note from the report, the pro -
ject meets the City's landscape standards, setbacks and parking standards.
State low, specifically, Section 66427 of the Subdivision Map Act as amended
January 1, 1900, states "the governing body shall not have the right to refuse
approval of a parcel, tentative or final map of such a project on account of
design or location of buildings on the property shown on the map not violative
of local ordinances or on account of the manner in which the air space is to
be divided in conveying the condominiums . nothing herein shall be deemed
to limit the power of the legislative body to regulate the design'of location
of buildings in such a project by or pursuant to local ordinances ". In other
words, unless the City has an ordinance regulating the conversion of apart-
ments into condominiums, we have no authority to condition the tentative map
relative to design, landscaping, parking or laundry facilities, etc.
Section 66427.1 requires that the developer provide written notice of the pro-
posed condominium 120 days prior to the termination of tenancy due to the con-
version or proposed conversion. Additionally, each of the tenants of the
proposed condominium must be given notice of an exclusive right to contract
for the purchase of their respective units upon the same terms and conditions
that the units will be offered to the general public or terms more favorable
to the tenant. This right shall run for a period of not less than 60 days
from the date of issuance of the subdivision report unless the tenant gives
prior written notice of his intention not to exercise that right.

DACKGROUNDt Tho Lewis Company is requasting the Planning Commission to conuidar
revisions to the provioualy approved Phase II Sunscapo Apartment project located on
19th Street. The Planning Commission reviewed and approved the project in rebruary
of 1979. A copy of the staff report and pertinent material in attached for your
review. The rovisions requosted by Lewin Company con -ter around the exterior design
of -tile buildings. Following the original staff report arc oxhibito of tine proposed
designs. Minor adjustments were also mado on tho site plan to permit the fire lane
an required by the roothill Tiro District.
EVALUATION- The most obvious chango between the approved building elevations and
tho proposed revisions in tine configuration of the roof. The original approved
elevations allow a variation of roof tochniquan indicating different levels which
are accentuated by indentations and punch outs in the building. The proposed
elevations have eliminated the variable roof levels. other variations nrat
elimination of the wood capped banintor on the balconies and railings, elimination
of the roof Overhang, and elimination of wood trim on the and elevations.
The rovisions proposed do not portray the name character that was originally approved.
The roofs without the variation of roof levels do not create the character and quality
that was originally anticipated. The elimination of the overhang in a significant
chnngo in that the roof now appears to be only a simple cover rather than an
architectural feature. The elimination of the wood capped banister and the wood trim
does not conform with the wood siding as it did previously- While the revisions
may make the construction costa loan expensive, they also cheapen the total design
of the project and in not consistent with the high design quality and character
doaLrod.
RECOMMENDATION: Based on the revisions submitted, it is recommended that the
Planning Commission deny t:ho applicant's request. if the applicant wishes to pursue
changoo, we suggest that the Chairman appoint a Planning Commission subcommittee to
moot with the Lewis Company to discuss any changes in the original approved dusign.

BACKGROUND: Thin application in among the first apartment projects submitted
to the City since the adoption of Ordinance 50 which exempts such projects
from tl,e residential moratorium. Staff is bringing thin and other apartment
applications before the planning Commission to reeievo guidance regarding
development review and design eritarir,. Tito Lewin Development Co. is pro-
posing n 248 unit apartment complex at the above described location which in
the Phase II expansion of on existing apartment complex to the went. 'Ilia
property is zoned R -3 and tl,e General Plnn designation in High Density
Residential (15 -30 units /acre). The complex will be built on 14.93 acres of
land and the overall density will be 16.6 units per acrn.
ANALYSISS Tito 248 unit complex will consist of 72 efficiency (bachelor), 56
one bedroom and 120 two bedroom units. The applicant proposes 558 parking
stalls, 2A8 covered and 310 open, which exceeds the zoning ordinance requirement
of two (2) spaces per unit. Staff in requiring tl,e elimination of tl:e eight (8)
proposed carportaiwith the spocen remaining, on the northern property lion
which lieu within the 25 ft. setback from the Foothill Freeway right -of -way;
these carports should be redistributed throughout the project.
The complex proposes three (3) drive approachcs from 19th Street. The Engin-
eering Division lino reviewed these approaches in terms of the City's access
policy and in recommending a shared access drive between thin site and tl:e
proposed Community Baptist Church to the east. The design of tills approach
will be subject to the City Engincer's approval. Further, it is recommended
that a block wall be built along tl,e eastern property line, the expense of
which could be shoreil by the Lewis Development Co. and the Dcptiot Community
Church.
The applicant proposes a total of 420 trees on the conceptual landscape plan
which indicates a density of 28 trees per gross acre. Staff feels this density
will not present the high quality environment desired for high density residen-
tial projects. We recommend a standard of 50 trees per gross acre; 20% of the
trees a minimum 24" box size, 70% be a minimum of 15 gallon size and the
remaining 10% be a minimum of 5 gallons in size. All parking lot trees should
be a minimum of 15 gallons in size.

The City Council of the CiLy of Itancho Cucamonga, California,
doer ordain an followu:
SEC'T'ION 1: The City Council finds and detarminea that:
(a) It in in the heat interests of Lbe pub -
lie health, safety and welfare that an adequate number of multiple-
family dwellings with dwelling units available for rental. exint• within
the City.
(b) The number of multiple - family dwellings
with dwelling units available for rental presently existing within
the City in litnitnd and should be preserved pending further study and
action by the Planuing Commission Lind the City Council.
(c) The unrestricted conversion of avail-
able multiple- family dwelling rental units to condominiums, community .
npartmunt projects, or stock cooperatives would seriously deplete
the number of such rental unith available within the City and would
therefore be detrimental to the public health, safety and welfare.
(d) Additional time is needed to study the
matter and determine if permanent controls on such conversions should
be imposed by the City.
SECTION 2: The City shall not accept for filing a tenta-
tive map or a final map for the purpose of creating a subdivision
containing five (5) or more condominiums as defined in Section 783
of the Civil Code, a community apartment project containing five (5)
or more parcels, or for the conversion of n dwelling to a stock
cooperative containing five (5) or more dwelling units..
SECTION 3: The City shall not further process or approve
a tentative map or a final map for the purpose of creating a sub -
divi.;ion containing five (5) or more condominiums as defined in

TIME EXTENSION IIEQUEST FOR DIRECTOR REVIEW NO. 79 -20 - VANIR RE-
SEARCI COMPANY - A request for aun cxtens on of t me fora previously
approvecT office complex which is to be located on the nortliwest car -
ne of Archibald and Nineteenth Street within the A -P (Administra-
tive- Professional) Zone.
BACKGROUND: Attached is a letter from Vanir Research Company requesting a one -
year extension on the approval of an office complex which Included three build-
ings totaling approximately 26,000 square feet to be located on the northwest
corner of Nineteenth Street and Archibald Avenue (see exhibit A). The appli-
cant claims that the adverse financial situation has caused a short delay in
the completion of the project. As the Commission is aware, it has been the
policy of the City to approve projects for a one -year period with possible
extensions sho -tld the Commission feel that the project meets present day po-
licies and standards. This project is due to expire on June 16, 1980.
ANALYSIS: In addition to site plans, please find attached a copy of the ex-
ter or uilding elevations for the proposed office building, a copy of the
Planning Commission minutes at which time the project was approved, and a copy
of the conditions of approval. As can be seen from review of the minutes, this
project was approved by a split decision. The main objection was the fact that
the office building appears to be designed as a retail style shop building ra-
ther than an office complex. More recent reviews of office complexes by the
Planning Commission have reflected a higher degree of architectural quality
with emphasis on the creation of a professional office identity.
If the Commission finds that the design of this facility does not meet the
present policies or desires of the Commission, then the Commission has several
options available to them. Since the project approval is due to expire, the
Planning Commission in granting an extension could require changes or additional
conditions on the project to make it comply with standards and policies which
are now applicable.
The second option to the Planning Commission would be to deny the time exten-
sion request requiring the applicant to submit a new development package, should
they desire to continue with the project. The last option available to the
Commission would be to grant an extension if the Commission felt that the de-
sign of the presently approved office building is adequate.

Barry slogan, Senior Planner, reviewed the staff report in detail, this being
on file in the Planning Division. Staff recommends approval of Resolution No.
79 -28 approving Director Review No. 79 -28.

Mr. Began stated two additional conditions should be added to the Resolution as
follows: 1) Extend the roof line along the north and west elevation, 2) the
approval of this project aliull expire within one year unless exercised by the
issuance of building permits.
Commissioner Tolstoy stated little, if any, attention has been given to the
screening from the proposed project un the north. Since this project is going
to be built in two phases, now is the time to net that screening designed and
planned.

Commissioner Garcia atuted, in his opinion, tl:e architect could enrich the
architectunl detailing style and design of the building elevations,
Commissioner Dahl stated if the roof line in extended along the north and went
elevations; and with additional landscaping to the north, lie does not ace any
further problems with the development.
Representative of Vanir Development indicated they are willing to meet all
conditions with regard to landscaping.
Mr. Ted Stelzer, Designer with Vanir Development Company, stated they went out of
their way with this development to project a profesnionnl office design. It is
hill opinion this will be a first close building with first close materials and
will be a nice addition to the community.

wholesale building materials and supply center located on the south side of
Foothill Boulevard, 1,000'± west of the Devore Freeway in the C -2 zone and M -1
zone.
Barry Hagan, Senior Planner, reviewed tine staff report in detail, this being on
file in the Planning Division. Staff has found the site plan to be a substantial
improvement over previous submittals. It allows the Commission to see how the
Alftk proposed phase one will fit in with the ultimato development of the site.
However, staff would recommend that the Commission continue this item for four
weeks to allow the applicant time to revise the architectural plans for the
propcsud office retail structure and give the applicant the direction necessary
for those architectural revisions.

reviewed. Thin is not really what we want to see along Foothill Boulevard,

the bent materials on the market.
Comminnioner Tolstoy stated he in not taking miy exception to the type of materials
being proposed. llin continents were directed at the design as what tins been pre-
sented den not fit in with the character of Foothill Boulevard, The design
needs more refinement.
Comminnioner Garcia stated lie would agree. lie felt that iit terms of consistency
in design proposals and the aesthetics and character of the development, an
proposed, is not compatible nor desirable within our community.
Commissioner Data stated he in in favor of thin development as presented.
Chairman Hempel stated lie in not in favor of a uniform type of architecture
throughout the City. Each concept needs to be left open to each developer or
individual builder to design Ilia own type of architecture. Perhaps if the
applicant would continue the design across the building for another 200 feet
with the same type of architecture, you would get an entirely different concept
of the building. There are a few things which could be changed a little bit.
Mr. Longley ntated the proposed building is to be net back from Foothill Boulevard
approximately 300 feet. At that point, it is about 15 feet lower than the curb
line. Tile back of the property sets 20 to 25 feet below the freeway.
Mr. Lam stated 1u terms bf review of the project, although the site will be
Leas visible than another site, it does not mean that the Commission should care
less about the appearance of the project.
A Notion was mnde by Commissioner Garcia and seconded by Commissioner Jones to
continue Director Review No. 79 -26 for study of the architectural design of the
building.

NOW, THEREFORE, THE RANCHO CUCAMONGA PLANNING COMMISSION RESOLVED AS
FOLLOWS:
SECTION 1:
That the following findings have been mnde:
1. That the site indicated by the development plan is
adequate in size and ahape to accommodate the pro-
pound tine, and all yards, spaces, walls, fencon,
parking, landscaping, loading and other features
required by this section.
2. That the improvements as indicated on the development
located in a manner as to be properly
plan are such
related to existing and proposed streets and highways.
3. That the improvements as shown on the development
plan are consistent with oll adopted standards and
policies as not forth in thin section.
SECTION 2:
That this project will not create adverso impacts on the
n:,vironment
and that a Negative Declaration in issued on April 11,
1979.
SECTION 3:
That Director Review No. ;9 -28 in approved subject to the
following conditions:
Applicant shall contact the Planning Division for complia:icu
with the following:
1. The parking lot shall be revised to eliminate the two
parking spaces shown on Exhibit A and revised to add
the planter areas shown.
2. All wheel stops,shall be eliminated in favor of 6"
high PCC curbing and overhang parking.
3. The restaurant and financial sites are not approved
and must be resubmitted for Director Review prior
to the issuance of building permits.
4. The landscape plans ahnll he revised to indicate a
substantial amount of trees, earthen barming and
varying sizes ofpinnt material. Precise landncnpa
plans shall be nubmitted to and approved by the
Planning Commisnion prior to the insunuce of a
building permit. All landscaped arena shall be
automatically irrigated and maintained in a healthy
state.
5. No signs are approved. A uniform sign program shall
be submitted prior to building occupancy including
any free standing signs.
6. All roof appurtenmiceu, including air conditioners,
shall be architecturally screened from view of the
street to tho satisfaction of the Planning Commission.
7. All trash arena shall be constructed pursuant to
^.ity Standards.
S. The future restaurant and financial sites shall be
turfed until such time of development.
9. All parking lot lighting shall be a maximum of 12'
from parking lot grade and shielded from adjacent
properties and streets.
C10. Approval of this Director Review is subject to the
approval of the Zone Change No. 79 -03.
11. Extend the roof line along the north and west
elevation.
12. The approval of this project shall expire within one
year unless exercised by the issuance of building
permits.

Applicant shall contact the Engineering Division for
compliance with the following:
14. Street dedication and improvements shall be in
conformance with the currently adopted Master Plan
of Streets and Highways and to the specification
of the City Engineer.
15. The following missing street improvements shall be
constructed which include, but are not limited to,
sidewalks, driveways, wheel chair ramps, curb and
gutter, street paving, street trees, street lights,
and drainage.
16. Street improvement plans prepared•on standard size
sheets by a Registered Civil Engineer shall be sub -
r' mitted for approval by the City Engineer.
r 17. Surety shall be posted and an agreement executed to
the satisfaction of the City Engineer and the City

improvements.

21. Grading plan of the subject property shall be prepared
by a Registered Civil Engineer and in accordance with
Elie Grading Ordinance and to the satisfaction of the
City Engineer.
22. Grading of oubjrct property shall be in accordance
with the grading plan and to the satisfaction of the
Building Official prior to occupancy.
23. A soils report shall bn prepared by a qualified engineer
to the sntisfaction of the Building Official.
24. Prior to the issuance of a building permit, grad4.ng,
drainaga, storm drain, and street plans prepared by
a Registered Civil Engineer shall be submitted for
review and approval of the City Engineer. Hydraulic
Calculations and a topographic map will be required to
support the sizing and location of drainage structures
shown on the plans. Concentrated flows across driveways
and sidewalks are prohibited.
25. Water supply and sanitary sewer facilities shall be
provided to the specifications of the City - approved
agency and the City Engineer with all incidental fees
paid by the developer. Written verification that all
requirements have been met shall be supplied at the
time of building permit application.
26. Prior to the issuance of building permits for combustible
construction, evidence shall be submitted to the Fire
Chief that water supply for fire protection is available.
27. All proposed utilities within the project shall be
installed underground.
28. Utility easements shall be provided to the specification
of the appropriate utility companies and the City
Engineer.
29. Developer shall coordinate, and pay for, the relocation of
any power poles or other existing public utilities, as
required.
