SU44APY: The project site falls within a portion of the area known as Hermosa Groves. It is located on the east side of Hermosa and encompasses approximately 55 acres. As required by California State Environmental review law, each City must determine whether or not a proposed project may create significant adverse environmental impacts. The primary mechanism for determining significant impacts is the prep- aration of an Initial Study. The City conducts the Initial Study through an Environmental Assessment and Checklist process. For the most part, this is adequate to determine whether or not significant adverse impacts may result in the majority of the projects th3t we review. However, in this instance, and because of the nature of the site, a simple Initial Study with a Checklist_ does not adequately answer the question of significant adverse impacts. The Applicant has conducted several environmental studies concerning soils, hydrolgy, and seismicity and is willing to provide additional information to &ssistus in making an environmental determination. Therefore, staff has prepared a preliminary environmental assessment and has isolated five areas which we are recommending an expansion on details for inclusion in the final Initial Study. This report outlines these five areas cf potential environmental impacts and a general description of what additional information is needed. These areas are geology, hydrolgy, biota (plant and animal life), cultural and aesthetic aspects. Staff is recommending in this report that the Planning Commission authorize the staff to coordinate tAe preparation of an expanded Initial Study for final review and determination of significant adverse impacts for this project. Woodland Pacific /TT 12237 August 25, 1932 Page 2 ANALYSIS: The State Environmental law provides the Planning Commission with the authority to request additional information for the preparation of Initial Studies. This enables the Planning ro,.,;i_�<_ the sign;f;cance of potential impacts and tiuhether or�notr�tho determine could ep appropriately revised to mitigate those potential impacts to an acceptable level. Attached is Part I and Part II of the preliminary Initial Study which indicates the potential for some impacts. ithout further details on these areas, we would have to conclud k'e that an Environmental Impact would need to be required. However, the Applicant has prepared, in conjunction with a previous project submitted two years ago, some reports on soils, seismicity, and hydrology. Although these studies were directed and conducted based upon the old project, there is some information that can be extracted and used for an expanded Initial Study for this project. These reports alone would not be adequate as they were not written exclusively for this project. Some information in these reports will need tc be revised and updated and refined in order to adequately answer the questions which the Commission will need to consider. For instance, the soils report does not contain a plot plan showing locations of the borings. In addition, the grading recommendations do not recognize the grading Proposal which is proposed for this project and its relationship a' custom lot development and the preservation of trees. The seismic r'. is lacking a map showing the fault location to determine the bui .ility of certain lots in the north section of the project. The hydrology report needs some revision relative to the potential need of a debris basin; ground water tables and the effect with the usage of septic tanks; cross lot drainage; and, the overall impact on the Alta Loma Channel. It is our opinion that an expanded Initial Study should be prepared using the available existing data (with some updates and revisions) and conducting some new research relative to biota and cultural and aesthetic aspects. Because of the significance of the Eucalyptus trees, it is unknown what the impacts may be regarding plant and animal life or the potential for effecting any rare and endangered plant and animal species. This analysis should also discuss any fea- sible mitigation measures. There are no known3tudies on the cultural aspects of this site. Therefore an archeological and historical survey should be conducted. The overall gradient of the site is 10 %, with the slope running from north to south. The site is traversed from the northeast to the southwest in the vicinity of Lot 45 by a natural drainage course. This drainage and other smaller natural drains flow westerly under Hermosa Avp_ ;nt-n 4hn +., designated un design P- -r -- _,, yK_ tiie attached sheets as "Proposed Park Site." Manmade drainage channels exist across the south portion and the easterly portion of the site. The development concept for this project results in minimal grading with grading only for streets, access, and 'housing structure. Vegetations Approximately 7006 of the site is densely planted with red gum eucalyptus (Eucal- yptus camaldulensis) approximately 65 years old. The densely planted conditions of the site have not permitted the average tree diameter formation. however, overall the trees are in good condition. The limits of the densely planted conditions are shown on the following exhibit. As can be seen from this exhibit, the groves do not exist on the most northern and eastern portions on the site. This plan will preserve the maximum number of trees possibly restricting tree removal to that necessary for streets, access, future custom houses. Soils The site lies in the northwestern portion of the San Berna --lino Valley in an area of granular alluvial soils. These soils, derived from the San Gabriel Oountains, have been deposited to great depths. Soils in this area are part of the Tujunga - Soboba Association. A soil association is a landscape that has 'a distinctive proportional pattern of soils. Specifically, these soils are of the Soboba gravelly, loamy sand series (SOC), are nearly level to moderately sloping, and are excessively drained. Runoff on these soils is very slow, erosion hazard is slight, and the degree of limitation for septic tank absorption fields is also slight. Test holes encountered surface lavers of light brown to dark yellow -brown silty sands with gravel, cobbles, and boulders underlain by dark grey -brown sands with gravel, cobbles, and boulders, or red -brown very silty sands with gravel, cobbles, and boulders, which are further underlain by light brown sandy gravels with cobbles and boulders to the maximum depth penetrated. A full soils engineering report prepared by Richard Mills Associates, Inc., 9223 -C Archibald Avenue; Rancho Cucamonga, CA 91730, (714) 989 -1751, is available upon request. The study did not indicate that soils would be a problem during this development of the site provided guidelines are followed. Scitimicity 'rhe site is located largely on the northwest extremity of the Deer Canyon alluvial fan in the upper San Bernardino Valley. The northmost portion of the property extends locally into the foothills of the San Gabriel Mountains and is transacted by the Cucamonga fault. An Alquist- Priolo Special Sudies Z,ne has been established for this fault. Bedrock exposures are limited to the foothills area north of the fault. The potentially active Cucamonga fault cuts across the northern part of the property. It is typically a thrust fault striking N60 -81E and dipping from zero to 19 degrees north. Significant local variations in strike and dip suggest an uneven thrust plane. The southerly dip has been noted in adjacent areas along the Cucamonga fault. it may represent a "tectonic - slide" feature: the movement of the edge of the thrust plate dcwnslope across the land surface during repeated fault movement. The maximum credible earthquake magnitude for the Cucamonga fault, and for other active or potentially active faults that should be considered in design are listed below: Distance to Magnitude Maximum Site (mi.) Said investigation indicates that the site is considered feasible for aevelopment within the limitation and requirements contained within the seismicity investiga- tion. Groundwater Small seeps representing local groundwater occurrences concentrated by the clay faultgouge were noted in the northwest portion, but were not in evidence on the existing around surface. A small spring discharging less than an estimated 1 gal /min. was noted about 130 feet north - northeast of the northeast property corner. Water from this spring was not in evidence on the site. Surface water flowing at an estimated rate of 1 gal. /min. disappeared into the alluvium (Qal) at the existing subdrain located approximately 325 feet northeas- terly of the Hermosa Avenue curie -sac. The Seismic Refraction Survey suggests a possible isolated groundwater table at depths of 45 -75 feet along Seismic Lines 3. Drainage Analysis The site is bounded on the north by the Los Angeles Department of Water and Power Transmission line right -of -way and the south by a county roadway_ A drainage review of the site was made by the County Flood Control District in the late 1960's and the information is contained in their file 106.0302_ A drainage study made for this report yields results consistent with District's. C:mprehensive Storm Drain Project No. 2 (CSDP2), System No. 3, is intended to serve the area. Construction of the Corps of Engineers' Hillside Basin and Channel are required before the CSDP2 system can function adequately as proposed. Approximately 650 acres, offsite, drain to and across the site. Of these, about 484 acres will be intercepted by the Hillside Basin and Channel System, construc- tion of which is currently scheduled to commence in the spring of 1982. Develop- ment of the site prior to 1982 must allow for the possibility of flows from the approximately 390 acres of drainage from Hillside Creek as well as the approximately 94 acres east of the Hillside Creek drainage boundary and north of the proposed Hillside Channel. Existing drainage improvments on the site, constructed in connection the the improvement of Hermosa Avenue, include from north to south respectively, a 48" Corrugated Metal Pipe (C}IP), 30" CMp, two 24" CHIP and a double 6' x 3' Reinforced Concrete Box Culvert (RCB). (Plate 4) Their respective capacities, assuming one foot of head at the entrance before overflow, onto the street, are 100 cfs, 40 cfs, 25 cfs and 290 cfs. With the exception of the 48" CMP, these capacities are adequate for the 10 -year discharges. Required capacity for the 48" CHIP is 133 cfs. Capacity of the double 6' x 3' RCB is sufficient to handle the 100 year discharge once the Corps' Hillside Basin and Channel improvements are completed. In addition to the improvements listed above, a County Flood Control channel bounds the property on the south and a large channel, part of the earlier water spreading system, runs north to souti, near the east property line. This latter channel serves about 8.5 acres of the most easterly part of the property. Its tributary area will be practically eliminated by construction of the Corps' pro jest. Existing Development from Associated Engineers, 316 East '•E" details the improvement that will Existing development on -Fite is limited to Hermosa Avenue, a concrete reservoir in the southwest portion, a forest ser-vice road along the north property line, several unpaved internal roads and paths and small borzon pits on the northwest. The site utilization map filed as part of this application g.- phically describes surrounding land uses. Biota Wildlife resident on the site consists of= ground rodents, lizards, snakes, oppossums, skunks, coyotes and birds common to foothill areas. The eucalyptus grove on the site serves as cover for deer which traverse the property. The trees also serve as roc5ting site for game birds such as quail and doves. The custom lot design for the subdivision together with restrictions on grading and tree removal will minimize the impact or the biota. Date Signature Title Paoe 7 ADDENDUM TO ENVIRONMENTAL CHECK LIST FOR TENTATIVE TRACT 12237 Explanation of "Yes" and "Maybe" answers: Soils and Geology - This project has th5 potential for allowing and increasing water erosion, of the soils that could affect both on and off site conditions. The situation needs analysis relative to the potential for debris collection from water tributaries from the north and of protection of the site. In addition, a portion of the site does fall within an earthquake special study zone known as the Alquist- Prioio special study zone. As a result, a detailed analysis of the seismicity on the pr ^perty is required by a regis- tered geological engineer. Analysis is required in both the seis- micity and the potential for erosion, the deposition of material to determine the need for any debris basins and proposed setbacks for buildings relative to fault lines. 2. Hydrology - This project has the potential to change the absorption rates, the drainage patterns and the amount and rate of surface water runoff for the area. There are several small water tributaries that transverse the site that will require close examination to insure appropriate dewatering of the area. There is also the potential for exposing property and /or people to water- related hazards such as flooding. Further, ground water tables have been noted to be shallow at depths of 45 feet as well as some surface springs noted north of the project site. The ground water level should be an?lyzed and determined if the usage of s.ptic tanks would ad:-crsely affect the quality of the acquife�s. This -infor,-ion would best be studied in the form of a hydrological report. 4. Biota - Since 1.- project site does contain a significant number of trees, then the c= .elopment of this site will most likely alter the characteristics of plant and animal species. It is not known whether the development of this site would cause the reduction of any unique, rare or endangered species of plant or animals. A detailed study will have to be conducted to determine whether or not development of the site will create significant impacts relative to the less of animal or plant life. 8. Transportation - As is the case in m-st proposed developments, the demand for new streets will exist. These streets are intended to be developed at appropriate standards that will be able to handle the projected flow of traffic caused by the development of this site. It is not anticipated that any additional off -site impacts will be created on the existing transportation system. 9. Cultural Resources - There is no current record known relative to the potential disturbance to the integrity of the archeological, paleon- tological, or historic significance of this site. A research into this aspect and a report on its finding would be necessary in order to .make a clear and precise finding. Addendum - Environmental Check List TT 12237 -2- ' 11. Aesthetics - Because of the existence of the large amount of mature trees, removal of the trees may cause the degradation of scenic views and vistas. This is more of a design - related issue which can be dealt with through appropriate design of the subdivision and measures for maintaining a significant portion of that view through preservation of trees. The Planning Commission approval is due to ex ire on September 15 1982. The bank was approved as a temporary facility until such time as a permanent facility could be built in conjunction with a shopping center. The request is based upon the continued recessionary economy which has made it difficult to obtain tenants for a shopping center. The bank is not in a position at this time to build a permanent facility. The approved Site Plan is shown as Exhibit "B ". ANALYSIS: Per Planning Commission policy, the temporary modular bank facility was approved to allow the Applicant time to find or construct permanent facilities. Therefore, the original Conditions of Approval required submittal of plans for a permanent building by June 15, 1982, if a permanent facility was desired on this site. To date, no such plans have been submitted to the City. Traditionally, the Planning Commission has granted twelve month extensions for Conditional Use Permits of this nature. In grant- ing an extension, the Planning Commission may attach new condi- tions or revise existing conditions. Should the Commission grant an extension, then a new time schedule for submittal of perma- nent building plans should be established. Previously, some residents of the tracts east of Alta Loma Channel (Tracts 9290, 9381 & 9427) requested a study by the Staff to consider the effect of extending Banyan Street across the channel. The study resulted in a Staff opinion that there would be an adverse traffic impact on the residential neighborhood east of the channel in which most of the lots front onto the street. Traffic counts taken in 1980 show a count of 900 average daily traffic on Banyan east of Amethyst. A copy of the traffic count survey is attached for your review. The traffic on Banyan, in our opinion, is not expected to be much higher at ultimate build -out of the City, and its affect or. the surround - :r_; streets will be negligible. We will be presenting, ir: the near future, to the Planning Cornission for their consideration an amended General Plan proposing to discontinue Banyan Street at the channel and to extend Wilson Avenue from its present terminus at Carnelian to Amethyst. In order to receive an approaal on the subject tract nap prior to amending the General Plan, the applicant's engineer has submitted a revised tentative map for Planning Commission's consideration in which provision has been kept to extend Banyan Street, if required. He has also expressed his desire that he may be allowed to proceed with the original design of the map provided the General Plan amendment as mentioned hereinabove is approved prior to recorda- tion of the final map. ENGINEERING DIVISION Installation of an improved corcre„e channel for Alta Loma watercourse from the existing spillway structure to South tract boundary including outlet structures shall be required. The cost of the channel shall be credited to the storm drain fees for the project and a reimbursement agreement will be executed in conformance with the City Ordinance tic. 75 to cover contributions which exceed the amount of these fees. This requirement may be waived if and when Alta Loma Channel Assessment District is formed. A letter from Flood Control District accepting the design of the channel and adequacy of the right -of -way width shall be obtained prior to recordation, of the map. The applicant shall meet all the requirements of the Flood Control District for this channel construction. 4. The portion o reconstructed London Avenue Engineer. f the existing Banyan Street shall be to provide a smooth connection to to the satisfaction of the City 6• The final design of Mandarin Street shall provide a four -foot parkway at the end of the temporary cul -de -sac. 6- If a General Plan Amendment is approved to discontinue Banyan Street, the applicant shall redesion Mandarin Street to provide a standard, regular cul -de -sac. Related File: Zone Change 81 -04 PROJECT AND SITE DESCRIPTION: This project consists of 19 single family lots on approximately 6.9 acres of land located south of Banyan Street, east of Archibald Avenue (Exhibit "A "). A change of zone from R -1- 20,000 to R -1- 10,000 is pending and is also being considered or this agenda. The site is currently a citrus grove with a slope of approximately 5°S from north to south. A Metropolitan Dater District right -of -way borders the property along the north side and a pcirtion of Banyan Street extends into the site on the northwest corner. At the south- west corner of the site, two future streets border the property. In addition, a 20 -foot wide drainage ditch extends along the south boundary of the property and Alta Loma Channel, a 50-foot wide par - tialiy improved flood control channel, exists to the east. Surrourdir,o land uses include vacant property to the north and south with single family homes on various lot sizes to the east and west. The surround- ing zoning is shown on Exhibit "B ". Lot_ sizes within the project_ range from a minimum of 10,000 square feet to 15,000 square feet at the end of the cul -de -sacs (Exhibit "C "). The natural topography of the site is to be preserved as much as pu�sible with only grading for the streets as shown on Exhibit "D ". ITEM D Tentative Tract 1.0076 /Wilson Planning Commission Agenda August 11, 1982 Page 2 ANALYSIS _ _ _ The proposed street pattern resulted from a number of site constraints. The location of the north -south street was de- termined by the future roads entering the property at the southwest corner and by the existing Banyan Avenue connection to the north across the NUD right -of -way. The location of the southerly east - west street was chosen to provide proper flood control protection. In place of the natural drainage ditcn, a 42 inch reinforced con- crete pine will be provided down the center of the street. Placing this storm drain in the street provides good access for maintenance and increases overflow capacity by sheet flowing in the street. Banyan Street is shown on the General Plan as an east -west collector street. The initial design of the tract map had Banyan extending all the way through the property. Howevor. based on recommendations by the Cit, Engineer, in conjunction with other design issues, the street pattern was altered. Two issues concern the Banyan Street connection. Between Haven Avenue and the project site along Banyan, numerous homes on 60 -70 foot frontages exist. The increased traffic associated with the collector street could create traffic safety hazards. The cost of building a bridge across Alta !.oma Charnel was also considered. The Engineering staff does not believe the amount of traffic generated would justify the expense of the bridge construction. A conceptual master plan for adjacent properties Prepared by the Applicant is shown on Exhibit "E ". The intent of this sketch is to demonstrate that surrounding properties can to reasonably de- veloped. The exact street pattern will be devFrmined when the adjacent land is subdivided. As an example, the southerly street Of this Project may be a 900 knuckle curve which would Provide a north -south street through the adjacent property. DESIGN EW_ When reviewing this project, the Design Review Com- mittee consi ered the Banyan Street connection, grading, and solar orientation. The Committee felt that the proposes design was accept- able considering Banyan would not be a through street. The Comr;ittee recomm-nerded approval of the Tract Mao. Tentative Tract 10076 /Wilson Planning Camnission Agenda August 11, 1922 Page 3 FACTS FOR FINDING: This project has been designed in accordance with the Genera Pan, Land Use Map, the Zoning Ordinance, Growth Manage- ment Ordinance, and Subdivision Ordinance of the City. In addition, the design has taken into consideration the existing site constraints and the effect on surrounding properties. CORRESPONDENCE: This project has been advertised in The Daily Report newspaper as a public hearing and 33 notices were mailed to adjacent property owners within 300 feet of the subject site. A letter in opposition to the design of this tract was submitted by Dr. Kanokvechayant. the owner of 9.1 acres of land to the south between the project site and Lemon Avenue (Exhibit "F "I. Avenue - APN 1062- 511 -09. PROJECT AND SITE DESCRIPTION: The applicants Ceasar and Linda Garcia, are requesting approva of a variance to allow them to construct a room addition within the required rear yard setback of their lot located on the south side of Lemon Avenue west of Carnelian Street (Exhibit "A "). As shown on the plot plan (Exhibit "B "), the proposed addition measures 18 X 22 feet (396 sq. ft.) and will encroach 10 feet into the required rear yard or 25 feet. The building setbacks established by the Zoning Code for the R- 1- 10,000 district are illustrated on Exhibit "C ". The subject parcel measures 115 feet deep and 94 feet wide, and totals approximately 10,800 sq. ft. The house on the property is 1,776 ss- ft. in size, plus a 3 -car garage. A pool and spa exist in the rear yard di- rectly behind tha house, about 10 feet from the proposed addition. ANALYSIS: State Law, as well as the City Zoning Ordinance, gives the Planning Commission the authority to approve a variance for certain de- velop,ment standards only when special circumstances applicable to the property such as size, shape, or topography would create undue hardships or wfier strict interpretation of the Zoning Ordinance :•.,ould deprive such property owners of privileges enjoyed by other properties in the vicinity in the residential zone. Variances may only be granted when the strict enforcement of the Zoning Ordinance would result in practical difficulty or unnecessary hardship inconsistent with the objectives of the Zoning Ordinance. The Commission must determine whether or not there is legal justification for granting this variance and if approval of the variancL would constitute a grant of special privilege. A building permit for this room addition was issued in September 1980, but cancelled by the applicant four months later. When the permit was issued, the rear yard setback was 15 feet. BACKGROUND: The applicant is requesting approval of a 1,500 square foot video game arcade at 6652 Carnelian. The applicant, Joseph lMannella, is the owner;cnerator of the existir5 JJ's Arcade located on Foothill Boulevard. Attached as Exhibit "D" is a description of the proposed arcade operation.. The applicant intends to start with twenty (20) machines and expand per demand. The arcade is proposed to be located in the middle of the shopping center, as shown on the Site Plan, Exhibit "B ". The site is zoned C -1 (Neighborhood Commer- cial) and contains a Bob's Big Boy Restaurant, the Boars Head, a bank, and retail /office uses. ANALYSIS: The recent denial of the Family Game Arcade in the Alta Loma Country Center was based upon the proposed location being contiguous to Alta Loma High School and adjacent alleyways. Primarily the Commission in this case expressed concern with loitering and enforcement problems this close to the high school. This proposed arcade at 6652 Carnelian is approximately 1,000 feet from the Jasper Elementary School. The applicant's proposal would not allow anyone under 18 years of age in until 2:00 p.m. during school session. However, staff recommends that the arcade be restricted to non - school hours to prohibit truancy. The arcade will occupy a unit in the middle of a retail shop building and will not be adjacent to alleyways. Attached is a memorandum from the Sheriff's Department listing their concerns and a memorandum with the staff's response. The most significant question in this case is the compatability of the proposed arcad- with the surrounding businesses. There is a possibility of conflict cween the Boars Head customers and arcade clientele in the parking lot areas, especially on Friday and Saturday nights. The applicant intends to provide interior seating areas, bathrooms, and vending machines to discourage outside loitering. ITEM E Page 2_ CONDITIONAL USE PERMIT 82-15 - MANNELLA Staff Report August 25, 1982 FACTS FOR FINDING: The najor finding the Commission is required tc make prior to granting any Conditional Use Permit for an arcade is that the proposed use, together with the conditions of approval, would not be detrimental to the public health, safety, or welfare, or materially injurious to the property or improvements in the vicinity. In addition to this finding. the Commission is required to consider the criteria established by Ordinance 174, regulating arcade uses. Based upon the input and material that has been received thus far, it would appear that this use would not cause a public health nuisance or be materially injurious to property ii the vicinity. The use could be compatible with the existing develupment with the adoption of the recommended conditions of approval. CORRESPONDENCE: This project has been advertised as a public hearing and all tenants within the shopping center, as well as proper�y owners within 300 feet, have been notified of such hearing. In addition, the Sheriff's Department, Fire District, and the principal of Jasper Elementary School were notified of the appiication for an arcade. Staff received a phone call from a nearby homeowner expressing concern that the arcade would compound the existing problems associated with the Boars Head. RECOMME'iDATION: It is recommended that the Planning Commission consider all im,ut and material in regard to this item. A Resolution with Conditions of Approval is attached for your review and consideration. The Planning Division shares the concerns outlined in your memo of August 9, 1982, and would offer the following comments. uest,on l: The arcade premises would be required to be posted. The adu t supervisor would enforce the 'under 18" limit in the same fashion as merchants selling alcoholic beverages or cigarettes - by "carding" suspected minors. In addition, staff is recommending that the arcade not be permitted to be open during school hours. Question 2: A violation of the Conditions of Approval, Section 61-0219(o) of the Zoning Ordinance causes the suspension of the CUP approval by the City. The Planning Commission may revoke the CUP approval (and require the arcade to close) or take such action deemed necessary to correct the violation. Question 3: There is a possibility of conflict between Boars Head customers and arcade patrons. The arcade will have interior seating areas to discourage ioite ring. Question 4: Most likely, the bike racks would be placed at the edge of the sidewalk in such a manner as to not obstruct pedestrian access. An alternate arrangement to be considered is to re- stripe a parking stall in front of the arcade and place a bike rack in the stall. E A RESOLUTiON OF THE RANCHO CUCX -1ONGA PLANNING COMMISSION APPROVING CONDITIONAL USE PERMIT NO. 82 -15 FOR AN ARCADE LOCATED AT 6052 CARNELIAN IN THE C -1 ZONE WHEREAS, on the 28th day of July, 1982, a complete application was filed by Joseph Mannella for review of the above - described project; and WHEREAS, or the 25th day of August, 1982, the Rancho Cucamonga Planning Commission held a public hearing to consider the above- described project. NOW, THEREFORE, the Rancho Cucamonga Planning Commission resolved as follows: SECTION 1: That the following findings can be met: 1. That the proposed use is in accord with the General Plan, and the purposes of the zone in which the use is proposed; and 2. All signs on the exterior of the building or visible from the outside, such as window signs, shall require Planning Division approval in accordance with the Sign Ordinance. 12. No amusement device shall be used for purposes of or in connection with gambling. The winning of anything of value shall constitute gambling, except the winning of a prize in a scheduled tournament. 13. No persons shall be permitted to enter, be or remain in any part of the arcade while in the possession of, con- suming, using or under the influence of any alcoholic beverage or drugs. This shall be prominently posted inside the arcade in letters not less than 1" in height and shall be enforced by the adult supervisor. 14. The walls, ceiling or floor, or any combination thereof, of the building or structure, or portion thereof, shall be insulated or otherwise constructed so that no noise or vibration that is detectable without the aid of any mechanical deg: ::e or instrument will be allowed to be on the outer perimeter of the arcade. 15. This approval shall become null and void if a Certificate of Occupancy is not issued within 18 months from the date of approval, unless an extension has been granted by the Planning Commission. The Planning Division shall review and monitor the arcade operation on an annual basis to ensure compliance with all Conditions of Approval and applicable City Ordinances. Failure to comply with Conditions of Approval or applicable City Ordinances shall cause the suspension of the Conditional Use Permit and possible revocation of the Conditional Use Permit by the Planning Commission. 16. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other appli- cable City Ordinances in effect at the time a Certificate of Occupancy is granted. C CM OF RAI\Ui0 CUCAMOiiiiGA STAFF REPORT DATE: August 25, 1982 T0: Members of the Planning Commission FROM: Rick Gomez, City Planner 8Y: Michael Vairin, Senicr Planner Can Coleman, Associate Planner SUBJECT: ENVIRONMENTAL ASSESSMENT FOR TENTATIVE TRACT 12237 - WOODLAN PACIFIC - A custom lot residential development of 56 lots on 55.95 acres, located on the east side of Hermosa, north of Hillside in the R -1- 20,000 zone - APN 201 - 091 -03, 16,17, 23, 30, 36 and 38. SUMMLARY: The project site is located on the east side of Hermosa, north of Hillside and within the Hermosa Eucalyptus Grove. The applicant also has a project pending on the same site as well as the west side of Hermosa, known as Tract 11933. The Planning Commission has required the prepara- tion of an environmental impact report. The EIR was required as a result of the proposed density and intensity of development. This EIR is still pending preparation following a final authorization from the applicant. The revised project, Tentative Tract 12237, on the east side of Hermosa, has been revised substantially. The density has been reduced to a level which is consistent with the General Plan. Geology, hydrology, seismi- city, groundwater and biota (plant and animal life) are still concerns which need to be thoroughly addressed prior to consideration of the pro- ject. Detailed studies have been conducted on soils, hydrology and seismicity. Staff is reviewing these reports and exploring the possibility of using these detailed studies as well as furt',er studies on biota and groundwater to de- termine if significant adverse impacts may be created by this project. We did not have enough time to provide you with a final recommendation at the time this report was printed. We anticipate bringing a detailed ana- lysis and recommendation to you for presentation at the meeting Wednes- day night. The intention of this analysis is to assist the Commission in making a final environmental. determination. This determination involves a decision as to whether information available is adequate to determine if significant adverse environmental impacts will be created. If the special studies or expanded Initial Study is not adequate, then the Commission will have to require the preparation of an EIR, as mandated by State Environmental law. If staff is unable to provide this informatics by Wednesday night, then we will seek a two week continuance. We are now able to set a reason- able work program. The Division's budget for 1582 -83 is basically a roll -over from last year. The major difference is the frozen positions: one, the Assistant Planner; and two, the Clerk Typist. The impact of these frozen positions is being felt throughout the department. The Assistant Planner for the Current Planning Divi- sior, was responsible for project processing. The clerk typist supplemented our clerical staff in peak work load periods. Because of these positions being frozen, the balance of the staff will have to assume the workload and responsibilities of the frozen positions. There is some relief in sight, we have currently hired a part time planning intern. The intern positior will augment the professional planning staff with support on areas of graphics, small planning and administrative assignments. Also, the City Council has approved the purchase of a word processor for the Community Development Department. Because of the increased production and conservation of time, this will improve our written communications and soften the impact of the frozen clerk typist position. With this deple- ti -)n in our manpower, it becomes imperative that we delineate a clear lis: of priorities in order to effectively allocate our resources between the special projects and our day -to -day Division activities. I have listed for the Commission a series of projects broken into three categories of high, medium, and low priority. Under high priority are such projects as the Etiwanda Specific Plan, Terra Vista Plannea Community, the Development Code (which would include the Zoning Ordinance, map, handouts, and Foothil, Corridor Study). Also, I have listed three projects; the Sign Ordinance amendments, General Plan land use amendments, and review of our development processing procedures. Staff is waiting for further direction from the City Council concerning the first two items. I have shown them as high priority and will schedule them accordingly when we have further direction from the Council. These later items are small in nature and can be produced in a. short period of time. Under melium priority, I have listed the neighborhood plans for the North Town and Alta Loma downtown areas. Under low priority, I have listed meandering sidewalks, standards/ guidelines, street tree standards, development monitoring, fiscal model update, and the transportation plan. As the Commission is quite well awarf: of, the development of any work program ;q an essential managerant tool in order to set prior- ities and coordinate the financial and human resources of any period of time. The staff is seeking the Planning Commis °ion's input regarding the establishment of these priorities and scheduling of the listed projec:s, as well as any Commission items that they may wish to add or delete from the work program. I have attached for the Commissicn's review, my memo of May 12, 1982, discussing the preliminary work program and previous work programs for the years 1980 and 1981, as well as a description of the Cu-.rent Planning and Advanced Planning section's responsibilities and some of the special projects in each one of those in.ividual sections.
