HomeMy WebLinkAbout82-102 - Resolutions RESOLUTION NO. 82-102 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, CONDITIONALLY APPROVING TENTATIVE TRACT MAP NO. 12090 WHEREAS, Tentative Tract Map No. 12090, hereinafter "Map" submitted by USA Properties Fund, Ltd. , applicant, for the purpose of subdividing the real property situated in the City of Rancho Cucamonga, County of San Bernardino, State of California, described as a residential development of 128 townhouse dwellings on 9.6 acres of land, located on the northeast corner of Archibald Avenue and Feron Boulevard into 145 lots, regularly came before the Planning Commission for public hearing and action on October 27, 1982; and WHEREAS, the City Planner has recommended approval of the Map subject to all conditions set forth in the Engineering and Planning Division's reports; and WHEREAS, the Planning Commission has read and considered the Engineering and Planning Division's reports and has considered other evidence presented at the public hearing. NOW, THEREFORE, the Planning Commission of the City of Rancho Cucamonga does resolve as follows: SECTION 1: The Planning Commission makes the following findings in regard to Tentative Tract No. 12090 and the Map thereof: (a) The tentative tract is consistent with all applicable interim and proposed general and specific plans; (b) The design or improvements of the tentative tract is consistent with all applicable interim and proposed general and specific plans; (c) The site is physically suitable for the type of development proposed; (d) The design of the subdivision is not likely to cause substantial environmental damage and avoidable injury to humans and wildlife or their habitat; (e) The tentative tract is not likely to cause serious public health problems; (f) The design of the tentative tract will not conflict - with any easement acquired by the public at large, now of record, for access through or use of the property within the proposed subdivision. Resolution No. 82-102 Page 2 • (g) That this project will not create adverse impacts on the environment and a Negative Declaration is issued. SECTION 2: Tentative Tract Map No. 12090, a copy of which is attached hereto, is hereby approved subject to all of the following conditions and the attached Standard Conditions: PLANNING DIVISION 1. This approval shall become null and void if the tentative subdivision map is not approved and recorded within twenty-four (24) months from the approval of this project unless an extension has been granted by the Planning Commission. 2. Upon recordation of the attached tentative subdivision map, Planning Commission Resolution No. 81-145 shall become null and void. 3. The east wall of the project shall be completed with the construction of the first phase of this project and landscaping with the 2nd phase. The final • design shall be submitted with the landscape and irrigation plans prior to issuance of building permits and shall be subject to review and approval of the Planning Division. 4. The perimeter wrought iron fence facing Archibald and Feron shall be redesigned to provide a variety of setbacks; however, in no case shall said fence be located within the public right-of-way. The sidewalk and mounding shall be redesigned to provide gently rolling mounds. 5. The developer shall contact all property owners along the east project boundary to coordinate the construction of the block wall with the removal of existing fences. 6. Shrubs shall be planted underneath trees to form a dense landscape screen along the north and east project boundary. 7. An improved tot lot shall be provided in the center of the project. The tot lot shall be enclosed by a fence, shrubbery, or other physical form and must include an active play area for children. The final design shall be submitted with the landscape and • irrigation plans subject to Planning Division approval . Resolution No. 82-102 Page 3 • 8. A main address directory of residents shall be placed at the main entrance to the development. 9. Sidewalks across the driveways shall be designed to clearly indicate a pedestrian crossing. 10. The roof of the carports shall be roofed with material of earth tone colors and is subject to review and approval by the Planning Division prior to issuance of building permit. 11. The applicant is encouraged to investigate the use of anti-graffiti material for use on proposed walls. 12. The Covenants, Codes and Restrictions shall be reviewed and approved by the City Attorney and shall include provisions for the homeowners to be responsible for maintenance of walls and removal of graffiti . In addition, provisions shall be made to ensure that the maintenance of dense landscaping be kept dense and not trimmed up. 13. The parking lot at the northeast corner of the • project shall be lighted for security. Shielding shall be provided to prevent glare on adjacent residences. 14. Security gates shall be provided at the project entrances to be approved by the Sheriff's Department and Foothill Fire District. 15. The easterly and northerly project boundaries shall be planted with continuous densely landscaped buffer. 16. Parking lot trees shall be planted in all planters within parking areas and adjacent to carports. ENGINEERING DIVISION 1. The developer shall redesign the access on Archibald Avenue to provide for a "right turn only" exit from the project, unless developer aligns the driveway access with 9th Street. 2. Drainage flows from the major portion of the drainage area "E", as shown on the Hydrology Map, shall be conveyed to Archibald Avenue along Feron Boulevard. The balance of the drainage shall be • directed towards Reid Avenue. Resolution No. 82-102 Page 4 • 3. Necessary approval and permits from Southern California Gas Company for the construction on their easement area shall be required prior to recordation of the map. 4. The developer is advised to contact the school district to provide for a joint use driveway access onto Archibald Avenue. 5. The developer shall install street improvements along Archibald Avenue and Feron Boulevard, including the interior loop street as needed for first phase construction. 6. The interior loop street shall be designed per City standards as approved by the City Engineer and shall be subject to the City's plan check and inspection requirements including payments of all necessary plan check and inspection fees.
