A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO CUCAMONGA, CALIFORNIA, . CONDITIONALLY APPROVING
TENTATIVE TRACT MAP NO. 13441
WHEREAS, Tentative Tract Map No. 13441, hereinafter "Map" submitted
by The William Lyon Company, applicant, for the purpose of subdividing the
real property situated in the City of Rancho Cucamonga, County of San
Bernardino, State of California, described as a residential tract subdivision
of 18.32 acres of land into 115 single family lots located at the northeast
corner of Victoria Park Lane and Kenyon Way (APN: 227-011-07), regularly came
before the Planning Commission for public hearing and action on June 24, 1987;
and
WHEREAS, the City Planner has recommended approval of the Map subject
to all conditions set forth in the Engineering and Planning Division's
reports; and
WHEREAS, the Planning Commission has read and considered the
Engineering and Planning Division's reports and has considered other evidence
presented at the public hearing.
NOW, THEREFORE, the Planning Commission of the City of Rancho
Cucamonga does resolve as follows:
SECTION 1: The Planning Commission makes the following findings in
regard to Tentative Tract No. 13441 and the Map thereof:
(a) The tentative tract is consistent with the General
Plan, Development Code, and specific plans;
(b) The design or improvements of the tentative tract is
consistent with the General Plan, Development Code,
and specific plans;
(c) The site is physically suitable for the type of
development proposed;
(d) The design of the subdivision is not likely to cause
substantial environmental damage and avoidable
injury to humans and wildlife or their habitat;
(e) The tentative tract is not likely to cause serious
public health problems;
(f) The design of the tentative tract will not conflict
with any easement acquired by the public at large,
now of record, for access through or use of the
property within the proposed subdivision.

(g) That this project will not create adverse impacts on
the environment and a Negative Declaration is
issued.
SECTION 2: Tentative Tract Map No. 13441, a copy of which is
attached hereto, is hereby approved subject to all of the following conditions
and the attached Standard Conditions:
Planning Division:
1. Prior to recordation of Tract 13441, the final map
for Tract 13279 shall be recorded.
2. All pertinent conditions for Tract 13279, as
contained in Resolution 87-40, shall apply.
3. This map is being approved as a Tract Subdivision
only. Any future proposals for the development of
five or more residential units shall require Design
Review approval prior to the issuance of building
permits for any units.
4. The William Lyon Company shall submit a disclosure
statement for this tract to be reviewed and approved
by the City Planner prior to distribution to
perspective developers of this tract. The
disclosure statement shall include the City of
Rancho Cucamonga's conditions, requirements, and
expectations for development standards and product
types for this tract.
5. Landscape treatments at the end of the side-on cul-
de-sacs shall be designed to provide an open view
into the interior of the cul-de-sac.
6. The fencing/walls required for the tract shall be
consistent with the fencing/walls indicated on the
conceptual landscaping plan. Wood fencing exposed
to public view shall be treated with stain, paint or
water sealant. Fencing on corner side yards and
fencing along Kenyon Way, Lark Drive, and Victoria
Park Lane shall be decorative block (except trail
fence along Victoria Park Lane which shall be per
City standard).

7. Prior to occupancy of more than 50 percent of the
units within the tract, the pedestrian trails shall
be improved with sidewalks, landscaping, irrigation,
and low level lighting. The plans are to be
reviewed and approved by the City Planner and the
City "Engineer prior to the issuance of building
permits.
8. Any retaining walls used are to be a maximum of four
feet high.
9. All retaining walls visible to the general public,
i .e. on the street side of corner side yards and
within the front yard, are to be constructed of a
decorative material to the satisfaction of the City
Planner.
10. All back of lot grade differentials are to be a
maximum of 12 feet.
11. The six foot high precision block wall along the
east property line shall introduce elements
(vertical or horizontal ) on the east side of the
wall to provide visual relief as viewed from the
future high school site. The design of the wall
shall be shown on the final landscape plan and is
subject to review and approval of the City Planner
prior to the issuance of building permits.
12. The fencing proposed at the southwest and northwest
corners of the tract shall be rounded or angled to
soften the impact at the street intersections. The
realignment of the walls shall be shown on the final
landscape plan and is subject to review and approval
of the City planner prior to the issuance of
building permits.
13. The following items shall be included in the
disclosure statement and shall be considered during
the design review for this tract:
A. A majority, if not all of the lots 45
feet or greater in width should
incorporate units with side-entry
garages.
B. Special attention should be paid to the
detailing on the front elevation of the
units with side-entry garages.

C. If two-story units are proposed, the
second story portion should have a
greater front yard setback than the ten
feet indicated for the first story of
side-entry garage units.
D. The front entry of the units should be
located to provide a relatively open area
between the front door and the adjacent
dwelling unit.
E. Variation should be provided in the
location of side yard walls/fencing to
create courtyard areas to tie in with the
architectural style of the units, and to
mitigate the amount of "blank" wall (zero
lot line side) exposed to public view.
F. The floor plans and plotting of the units
should be designed to create variation in
setbacks and open spaces for both the
front and rear yard areas.
Engineering Division
1. All pertinent conditions of Tract 13279 shall apply.
2. Notice of intention to form and/or join the Lighting
and Landscaping District shall be filed with the
City Council prior to recordation of the map or
issuance of building permits, whichever occurs
first.
3. The developer shall pay the pro rata fee for future
undergrounding of overhead utilities along Highland
Avenue, as conditioned with Tentative Tract 13279,
prior to recordation.
4. The trails to be maintained by the City shall be
constructed and dedicated full width incorporating a
separation device such as a wall or curb to define
the limits to be maintained by the City.
5. The alignment of Lark Drive from Kenyon Way to the
east tract boundary shall be resolved prior to
recordation of the final map as approved by the City
Engineer as follows:

a. It shall be realigned so that its south
right-of-way line intersects the west
property line of the easterly adjacent
property at a point 40 feet south of the
north line of the south 20 acres of said
adjacent property, (APN: 227-011-08); or
b. It may be aligned as proposed subject to
the City and the developer arranging for
the dedication for the portion from the
easterly tract boundary to Rochester
Avenue (a minimum of 40 feet in width ) on
an alignment approved by the City
Engineer and the execution of a three
party agreement between the High School
District, the developer and the City.
