HomeMy WebLinkAbout90-17 - Resolutions RESOLUTION NO. 90-17 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, CONDITIONALLY APPROVING TENTATIVE PARCEL MAP NUMBER 13125, LOCATED AT THE SOUTHWEST CORNER OF TRADEMARK STREET AND CENTER AVENUE, AND MAKING FINDINGS IN SUPPORT THEREOF - APN 210-072-33 WHEREAS, Tentative Parcel Map Number 13125 , submitted by Burke Commercial Development, applicant, for the purpose of creating one parcel for condominium purposes, the real property situated in the City of Rancho Cucamonga, County of San Bernardino, State of California, identified as APN(s) 210-072-33, located at the southwest corner of Trademark Street and Center Avenue; and WHEREAS , on February 14 , 1990, the Planning Commission held a duly advertised public hearing for the above-described map. NOW, THEREFORE, THE RANCHO CUCAMONGA PLANNING COMMISSION RESOLVED AS FOLLOWS: SECTION 1 : That the following findings have been made: 1. That the map is consistent with the General Plan. 2. That the improvement of the proposed subdivision is consistent with the General Plan. 3. That the site is physically suitable for the proposed development. 4. That the proposed subdivision and improvements will not cause substantial environmental damage or public health problems or have adverse affects on abutting property. SECTION 2: This Commission finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970 and, further, this Commission hereby issues a Negative Declaration. SECTION 3: That Tentative Parcel Map No. 13125 is hereby approved subject to the attached Standard Conditions and the following Special Conditions: 1 . Obtain sufficient right-of-way from the property (APN 210-381-08) on the east side of Center Avenue to construct the northerly curb return to City standards. If the Developer is PLANNING COMMISSION RESOLUTION NO. 90-17 TENT PARCEL MAP 13125 - BURKE COMMERCIAL DEVELOPMENT FEBRUARY 14 , 1990 PAGE 2 unable to obtain that right-of-way, Center Avenue shall be relocated westerly, the minimum distance necessary to construct the curb return within the project. However, such a relocation will most probably necessitate a revision to Development Review 89-25 . 2. The strip of land located on the east side of Center Avenue shall be deeded to the property owner to the east (APN 210-381-08) and a lot line adjustment recorded to merge the strip of land with the property to the east prior to recordation of the Parcel Map. 3. Provide an offer of dedication for a possible future public storm drain extending from Deer Creek Channel to Center Avenue centered within the 28 foot drive aisle for Development Review 89-25. 4. The Developer shall submit a request to vacate the existing east/west and north/south storm drain easements within the project. The vacations shall be completed prior to the issuance of building permits or recordation of the Parcel Map, whichever occurs first. 5. Provide an offer of dedication for a storm drain easement and construct a storm drain pipe within the westerly most drive aisle from the north property line southerly and westerly to connect to the existing storm drain connection to Deer Creek Channel . 6. Center Avenue and Trademark Street shall be constructed full width, with the exception of parkway improvements on the east side of Center Avenue. 7. An easement over the internal drive aisles shall be provided to the City for maintenance vehicle access to the City storm drain. 8. There shall be a minimum five-foot (5) separation (measured horizontally) between the outer edge of a mature tree base and the outside of a storm drain pipe. 9. A deposit shall be posted with the City covering the estimated cost of apportioning the assessments under Assessment District 82-1 prior to recordation of the Parcel Map for both the lot line adjustment and lot consolidation. 10. The Developer shall complete the purchase of the surplus County Flood Control Property located at the southwest corner of the site prior to recordation of the Parcel Map.
