A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO CUCAMONGA, CALIFORNIA, CONDITIONALLY APPROVING
TENTATIVE PARCEL MAP NUMBER 13755, LOCATED BETWEEN TERRA
VISTA PARKWAY AND SPRUCE AVENUE, NORTH OF CHURCH STREET,
AND MAKING FINDINGS IN SUPPORT THEREOF -
APN: 1077-091-27, 31
WHEREAS, Tentative Parcel Map Number 13755, submitted by Lewis
Development Company, applicant, for the purpose of subdividing into 1 parcel,
the real property situated in the City of Rancho Cucamonga, County of San
Bernardino, State of California, identified as APN(s) 1077-091-27, 31, located
between Terra Vista Parkway and Spruce Avenue, north of Church Street; and
WHEREAS, on August 14, 1991, the Planning Commission held a duly
advertised public hearing for the above-described map.
NOW, THEREFORE, THE RANCHO CUCAMONGA PLANNING COMMISSION RESOLVES AS
FOLLOWS:
SECTION 1: That the following findings have been made:
1. That the map is consistent with the General Plan.
2. That the improvement of the proposed subdivision is
consistent with the General Plan.
3. That the site is physically suitable for the
proposed development.
4. That the proposed subdivision and improvements will
not cause substantial environmental damage or public
health problems or have adverse effects on abutting
properties.
SECTION 2: This Commission finds and certifies that the project has
been reviewed and considered in compliance with the California Environmental
Quality Act of 1970; and further, this Commission hereby issues a Negative
Declaration.
SECTION 3: Tentative Parcel Map Number 13755 is hereby approved
subject to the attached Standard Conditions and the following Special
Conditions:
1. Construct the Green Belt Trail Connection as required by the
Terra Vista Community Plan on the north side of the site,
extending south along the west side of Spruce Avenue and
southerly along the east side of Terra Vista Parkway.

2. The grading of the site shall be coordinated with Spruce Park.
A maintenance agreement will need to be worked out with the
Community Services Department.
3. The existing maintenance depression in the median island on
Terra Vista Parkway shall be removed and replaced with curb and
landscaping to the satisfaction of the City Engineer.
4. A left turn pocket shall be constructed in the Terra Vista
Parkway median for south bound traffic at Hampton Place to the
satisfaction of the City Engineer.
5. Public street pavement striping, marking, and signage shall be
installed per the requirements of the City Traffic Engineer.
6. Street Improvement Plans shall be revised by a Registered Civil
Engineer and approved by the City Engineer.
7. Surety shall be posted and an agreement executed to the
satisfaction of the City Engineer and City Attorney,
guaranteeing completion of the public street improvements.
8. Pursuant to provisions of California Public Resources Code
Section 21089(b) , this application shall not be operative,
vested or final, nor will building permits be issued or a map
recorded, until (1) the Notice of Determination (NOD) regarding
the associated environmental action is filed and posted with the
Clerk of the Board of Supervisors of the County of San
Bernardino; and (2) any and all required filing fees assessed
pursuant to California Fish and Game Code Section 711.4,
together with any required handling charges, are paid to the
County Clerk of the County of San Bernardino. The applicant
shall provide the Engineering Department with a stamped and
conformed copy of the NOD together with a receipt showing that
all fees have been paid.
In the event this application is determined exempt from such
filing fees pursuant to the provisions of the California Fish
and Game Code, or the guidelines promulgated thereunder, except
for payment of any required handling charge for filing a
Certificate of Fee Exemption, this condition shall be deemed
null and void.
