A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RANCHO CUCAMONGA SUMMARILY ORDERING THE
VACATION OF EXCESS RIGHT OF WAY DEDICATED FOR
YELLOWWOOD AVENUE BETWEEN ARROW ROUTE AND
THE FOOTHILL MARKETPLACE (CASE NO. DRC2016-00726),
SUBMITTED BY TPT ARROW ROUTE DC, LP.
WHEREAS, by Chapter 4,Article 1 , Section 8334, of the Streets and Highway Code, the
City Council of the City of Rancho Cucamonga is authorized to summarily vacate those portions
of the City Streets hereinafter more particularly described; and
WHEREAS,the City of Rancho Cucamonga staff found and determined that the summary
vacation of the subject rights herein contemplated conformity to the City's General Plan; and
WHEREAS, the City Council found all the evidence submitted that the subject rights
located on Yellowwood Avenue between Arrow Route and The Foothill Marketplace, are
unnecessary for present or prospective public purposes
NOW,THEREFORE BE IT RESOLVED by the City Council of Rancho Cucamonga as follows:
SECTION 1: That the City Council of the City of Rancho Cucamonga hereby makes its
order vacating the excess right-of-way, as shown on map V-237, on file in the office of the City
Clerk of the City of Rancho Cucamonga, which have been further described in the legal
description which is attached hereto, marked Exhibit "A" and shown on Exhibit "B" and by
reference made a part thereof.
SECTION 2: That the subject vacation shall be subject to the reservations and exceptions,
if any, for existing utilities on record.
SECTION 3: That from and after the date the resolution is recorded, said excess right-
of-way no longer constitute a City right.
SECTION 4: That the City Clerk shall cause a certified copy of this resolution to be
recorded in the office of the County Recorder of San Bernardino County, California.
SECTION 5: That the City Clerk shall certify to the passage and adoption of this resolution,
and it shall thereupon take effect and be in force.

LEGAL DESCRIPTION
STREET VACATION
That portion of Parcel 1 of Parcel Map No. 3476, in the City of Rancho Cucamonga,
County of San Bernardino, State of California, recorded in Book 31, Page 81 of Parcel
Maps,in the office of the County Recorder of said County, described as follows:
Commencing at the Southwesterly corner of said Parcel 1; thence along the Westerly line
of said Parcel 1 North 00°09'47" East 301.40 feet to the Northeasterly line of the
Irrevocable Offer of Dedication for streets, highways, and related purposes to the City of
Rancho Cucamonga, recorded March 25, 2011 as Instrument No. 2011-0121526 of
Official Records, in the office of said County Recorder, said point being the beginning of
non-tangent curve concave Southwesterly having a radius of 61.00 feet, a radial line of
said curve to said point bears North 00°09'47"East;thence Southeasterly 21.34 feet along
said curve and said Northeasterly line through a central angle of 20°02'48" to the TRUE
POINT OF BEGINNING; thence continuing along said Northeasterly line and the
Easterly line of said Irrevocable Offer of Dedication, the following three (3) courses:
continuing Southeasterly 90.45 feet along said curve through a central angle of
84°57'12", South 15°09'47" West 87.50 feet to the beginning of a curve concave
Southeasterly having a radius of 96.00 feet, and Southwesterly 25.13 feet along said
curve through a central angle of 15°00'00" to a point of cusp with a line parallel with and
33.00 feet Easterly of said Westerly line of said Parcel 1; thence along said parallel line
North 00°09'47" East 30.75 feet to the beginning of curve concave Westerly having a
radius of 883.00 feet; thence Northerly 109.81 feet along said curve through a central
angle of 07°07'31"; thence North 06°57'44" West 42.51 feet to the TRUE POINT OF
BEGINNING.
Containing an area of 0.076 acres (3,318 square feet),more or less.
Subject to covenants, conditions, reservations, restrictions, rights-of-way and easements,
