Chairman Macias then led in the pledge of allegiance. DEVELOPMENT REVIEW DRC2003-00191 - US HOME-A design review of detailed site plan and elevations for 38 single-family lots (Tract Map SUBTT16370) of previously approved Tentative Tract Map 15974 within the Mixed Use District of the Victoria Arbors Master Plan in the Victoria Community Plan, located on the west side of Arbor Lane north of Church Street- APN: 0227-161-46. Chairman Macias indicated that staff requested that Item E be pulled from the Consent Calendar to be heard in conjunction with Public Hearing Items F and G. Motion: Moved by McNiel, seconded by McPhail, to adopt Items A, B, C, and D of the Consent Calendar. ENVIRONMENTAL ASSESSMENT AND TENTATIVE PARCEL MAP SUBTPM16038-CARNEY - A request to subdivide .817 acre of land into 4 parcels in the Low Residential District (2-4 dwelling units per acre), located on the west side of Klusman Avenue, north of Diamond Avenue -APN: 1062-401-05. Related Files: Development Review DRC2003-00015,Variance DRC2003- 00017, Minor Exception DRC2003-00016, and Tree Removal Permit DRC2003-00419. Planning Commission Minutes -2- August 27, 2003 G. VARIANCE DRC2003-00017- CARNEY-A request to reduce the required lot depth from 100 feet to 80 feet for 4 proposed single family residences in the Low Residential District (2-4 dwelling units per acre), located on the west side of Klusman Avenue, north of Diamond Avenue - APN: 1062-401-05. Related Files: Tentative Parcel Map SUBTPM 16038, Development Review DRC2003-00015, Minor Exception DRC2003-00016, and Tree Removal Permit DRC2003-00419. Rick Fisher, Contract Planner, presented the staff report. Chairman Macias opened the public hearing. Glen Cozad,6201 Klusman Avenue, Rancho Cucamonga, stated that in 1983 he bought his house, which is across the street from the proposed project. He thought the City should not allow houses to be built on substandard lots. He asked the current depth of the lot. He said that once the street and sidewalk are put in, the lots would be too small. He asked if Lots 3 and 4 would have a shared driveway. Dan Coleman, Principal Planner, stated the lots are now 100 feet deep and will be 80 feet deep after Klusman Avenue is finished. Kim Felten, 6155 Diamond, Rancho Cucamonga, objected to having the new houses built 18 feet from her back wall. She noted her house is on a ' acre. She did not want a two-story house overlooking her back yard and said a single-story house would be acceptable. She felt the new lots should be '/ acre in order to be the same size as the surrounding lots. Judy Biewener, 6211 Klusman Avenue, Rancho Cucamonga, felt the proposed new lots are too small. She was concerned about a loss of privacy. She stated they had been told the property was not zoned for houses because of the size of the lots. She said her lot is between a ''/ and % acre. She opposed opening up the street. Marian Kuri, 6221 Klusman Avenue, Rancho Cucamonga, expressed concern about the size of the lots. Scott Biewener, 6211 Klusman Avenue, Rancho Cucamonga, asked if lots had ever been reduced to an 80-foot depth in the past. Floyd Herndon, 9641 Banyan Street, Rancho Cucamonga, stated he owns the property. He said that when the tract of homes that the other speakers live in was constructed, the developer was permitted to put in Klusman Avenue at half of its desired width instead of making full street improvements and it was known at that time that his lots were only 100 feet deep. Cecil Camey, applicant, 12841 Newport Avenue, Tustin, stated he agreed with the staff report and conditions. Brad Buller, City Planner, noted that several residents had expressed concerns prior to Mr.Cameys arrival at the meeting. Greg Wrinen, 4663 Teasdale Avenue, Riverside, stated he hopes to purchase one of the homes to be built. Hearing no further testimony, Chairman Macias closed the public hearing. Chairman Macias noted concerns had been expressed regarding the scale and mass of the development and the depth of the lots had been questioned. Planning Commission Minutes -3- August 27, 2003 Mr. Buller stated the project is a classic case where a variance is necessary. He noted that the owner of the property indicated that three lots were developed on Klusman Avenue, leaving him with a 100-foot depth. He said the City requires dedication of 20 feet for full street improvements,leaving a lot depth of 80 feet. He noted the Commission could deny the setback deviation from the front or rear yard boundaries but staff felt the variance is reasonable in order to build comparable homes for the neighborhood. He said staff supports the variance, as the property owner did not create the situation. Mr. Coleman observed that the houses step back from one-story at the front of the lot to two at the • rear. Mr. Buller noted that the lot would be unbuildable if the Commission did not support the lot depth variance. Commissioner McNiel stated the property is a remnant piece that is undersized in depth. He noted each lot is wider than normal in order to make up for the loss of depth. He said the lots would be approximately % acre, to fit in with the surrounding neighborhood. He stated he understood the concems raised by the residents but he felt they would be less concemed when they see the houses on the wider lots. He observed the back yard setback requirement is 20 feet and the developer is asking for 18 feet and the front yard setback requirement is 37 feet and they are requesting 35 feet. Mr. Buller pointed out that the development meets City Code in all other requirements including lot size. Commissioner McNiel suggested that the setback variance be utilized for the front yard and the rear yard setback be left at 20 feet. He stated that the lots are the same size they would be if 20 acres were divided into 80 lots, as the streets would be carved out of the 20 acres. Commissioner Fletcher asked the spacing between the houses. Mr. Fisher indicated the side yard setbacks are 10 and 15 feet. Mr. Buller stated there is a separation of approximately 30 feet between the houses as they are currently plotted. Commissioner Fletcher felt the major concern raised was privacy. He thought that concem could be addressed in a number of ways. He felt the variance is justified. Chairman Macias noted that any decision by the Planning Commission can be appealed to the City Council. Motion: Moved by McNiel, seconded by Fletcher, to issue a Negative Declaration and adopt the resolutions approving Parcel Map SUBTPM16038, Development Review DRC2003-00015, and Variance DRC2003-00017. ENVIRONMENTAL ASSESSMENT AND DEVELOPMENT REVIEW - DRC2003-00100 - KB HOME GREATER LOS ANGELES The review of design elevations and site plan for 156 multi- family dwelling units on 11.14 acres of land in the Medium Residential District (8-14 dwelling units per acre), located at the southwest corner of Base Line Road and the southbound I-15 Freeway onramp - APN: 1100-011-04, 05 (a portion) 06, and 07 and 1100-051-01 (a portion) and 02. Related Files: Tentative Tract Map SUBTT16455, Variance DRC2003-000523, and Tree Removal Permit DRC2003-00482. J. VARIANCE DRC2003-00523 - KB HOME - A request to increase the height of the perimeter block wall adjacent to the 1-15 Freeway from 6 feet to 18 feet, at the southwest corner of Base Line Road and the southbound I-15 Freeway onramp and the southeast corner of Base Line Road and Etiwanda Avenue-APN: 1100-011-02, 03, 04, 05, 06, and 07; 1100-021-01; 1100- 051-01 and 02; and 0110-061-01. Commissioner Stewart arrived. Rick Fisher, Contract Planner, presented the staff report and stated staff received a letter from the State Department of Fish and Game raising concerns about mitigation measures for burrowing owls. He noted that the biologist who prepared a study found no burrowing owls and little likelihood of their presence because of a lack of suitable habitat as a result of previous development and agricultural activity as well as annual weed abatement on the site. Mr. Fisher suggested changes to the Air Quality mitigations to require the painting or coating of the buildings be applied over a period of 96 days in order to reduce the emissions to a level of insignificance. Chairman Macias asked if burrowing owls have been encountered on previous projects. Brad Buller, City Planner, responded evidence has been found on another site. He noted there have been reports in the press recently about burrowing owls, so there is more recognition of the species. Commissioner McNiel asked the plans for the remnant piece of land along Base Line Road. Dan Coleman, Principal Planner, commented that the developer prepared a master plan showing the property could be incorporated into their project in the future. He said preliminary plans have been submitted by the current owner for single-family homes and there are three driveways that stub out to the corner property and those could be extended in the future. Commissioner Fletcher asked if the palm trees are salvageable. Mr. Fisher replied the arborist report indicated they are salvageable but there is a 50 percent chance they may die within 5 years. He stated the applicant will try to salvage the trees. Commissioner Fletcher asked if there is a market for the trees. Mr. Coleman confirmed there is a market and said that some developers are having trouble finding trees for their projects. Chairman Macias opened the public hearing. Planning Commission Minutes -5- August 27, 2003 Jary Cockroft, KB HOME Greater Los Angeles, 801 Corporate Center, Suite 201, Pomona, agreed with the staff report and conditions of approval. He indicated they are looking at the possibility of using the palm trees along the freeway for this project and for the adjacent single-family home project. He commented that would mean they would have to move and store the trees and then relocate them to their ultimate location. He said they may use the trees on another project if that cannot be done. Commissioner McNiel noted an 18-foot high sound wall is planned along the freeway and he questioned what other sound mitigations are required. Mr. Cockroft replied there are also requirements within the units, such as upgraded windows and sliding doors. Commissioner McNiel asked who owns the out parcel. Mr. Cockroft thought the City owns a portion. He said they considered using it but Engineering staff indicated there is a possibility the parcel may be used as a parking area for commuters following the Base Line Avenue/I-15 intersection construction. He said there are storm drain issues and they could not move forward and use it at this time. Hearing no further testimony, Chairman Macias closed the public hearing. Commissioner McNiel felt the project is straightforward and the sound wall is needed. Commissioner Fletcher also supported the project and the variance for the sound wall. Commissioner Stewart was pleased there will be an effort to preserve the palm trees. Motion: Moved by Fletcher, seconded by Stewart, to issue a Negative Declaration and adopt the resolution approving Tentative Tract Map SUBTT16455, Development Review DRC2003-00100,and Variance DRC2003-00523 with modification to require the painting or coating of the buildings be applied over a period of 96 days. Chairman Macias noted that Item J (Variance DRC2003-00523) had just been approved in conjunction with the previous project. Rick Fisher, Contract Planner, presented the staff report and stated staff received a letter from South Coast Air Quality Management District regarding the adequacy of analysis of air quality impacts. He said staff determined the thresholds will not be exceeded and no additional mitigations are necessary because of phasing of the project. He noted staff also received a letter from the State Department of Fish and Game raising concems about mitigation measures for burrowing owls. He reiterated that the biologist who prepared a study found no burrowing owls and little likelihood of their presence because of a lack of suitable habitat as a result of previous development and agricultural activity as well as annual weed abatement on the site. Chairman Macias opened the public hearing. Jary Cockroft, KB HOME Greater Los Angeles, 801 Corporate Center, Suite 201, Pomona, expressed appreciation for staffs assistance in processing the project. Commissioner Stewart asked if they plan to sell the historic structure. Mr. Cockroft replied they plan to move the structure to Lot 62 so that it faces Etiwanda Avenue. He said that there is another residential structure built about the same time period just to the south and they will frame the entrance to the subdivision off Etiwanda Avenue. He stated they plan to restore the home and landscape it and would like to use it as a temporary sales office for the subdivision. He noted that the public often likes to see historic properties. He said they plan to sell it as a single- family residence at the end of the project. Hearing no further testimony, Chairman Macias closed the public hearing. Commissioner Stewart stated she was on the Design Review Committee when the project was processed and she feels it is a good product. Commissioner Fletcher liked the plans for the historic structure. ENVIRONMENTAL ASSESSMENT AND DEVELOPMENT REVIEW DRC2003-00213—STUDIO 3 ARCHITECTS—A request to develop a 25,000 square foot Holiday Inn Express on 2.7 acres of land in the Industrial Park District(Subarea 12), located on the east side of Milliken Avenue between 4th and 5th Streets — APN: 0229-341-12. Douglas Fenn, Associate Planner, presented the staff report and stated he received a note from Commissioner McPhail asking for less sod along the Milliken Avenue frontage and Planning Condition 4 addresses that concem. Chairman Macias invited public comment. Victor Palos, Studio 3 Architects, 325 North Second Avenue, Upland, stated the project was a challenge. He expressed appreciation for the efforts of staff to get the project before the Commission. He agreed with the conditions. Commissioner Fletcher asked if the sidewalk and landscaping depicted on the drawing is an existing sidewalk. Mr. Palos replied that they are dedicating 10 to 15 more feet of parkway and the improvements shown on the plan are new. Dan Coleman, Principal Planner, stated the rendering does not show all trees that will be planted. Commissioner Fletcher noted that most of Milliken Avenue has a meandering sidewalk. Commissioner McNiel asked if there will be any conference rooms. Mr. Palos responded there will be some small conference rooms but no restaurants. He said they will provide a continental breakfast. Hearing no further testimony, Chairman Macias dosed the public hearing. Commissioner McNiel felt the addition of hotel rooms in the City is good. Motion: Moved by McNiel, seconded by Stewart, to issue a Negative Declaration and adopt the resolution approving Development Review DRC2003-00213. COMMISSION BUSINESS Brad Buller, City Planner, reported the City's website was updated and the Commissioners'picture is now on the Internet site. Mr. Buller commented that Commissioner Fletcher inquired about attendance at a Building Industry Association (BIA) meeting where Randall Lewis is to be a guest speaker. He stated that Mr. Lewis has offered to talk with the Commission regarding development. He indicated he would work with Mr. Lewis to coordinate such a meeting. He also stated the Commissioners could attend functions such as the BIA meeting and staff could make the arrangements. Mr. Buller reported that the Commissioners had agreed to a Planning Commission workshop on Friday, September 26, 2003. It was the consensus of the Commission that the workshop will start at 8:00 a.m. Mr. Buller stated the third project on the Workshop agenda(DRC2003-00733)would be continued to September 10, 2003.
