Chairman McNiel then led in the pledge of allegiance. (Continued from December 8, 1999) Dan Coleman, Principal Planner, indicated that the applicant had still not submitted any documentation regarding the concerns raised by the Department of Fist and Game. He suggested that the matter be continued to February 9, 2000, to allow time for the environmental issues to be resolved prior to the public hearing. Chairman McNiel noted the public hearing was open. There was no public testimony. ENVIRONMENTAL ASSESSMENT AND CONDITIONAL USE PERMIT 99-25—LEWIS RETAIL CENTERS/LEWIS OPERATING CORPORATION — The development of a master plan and design guidelines for Terra Vista Commons; the approval of Pad E (a 10,088 square foot retail building) including site plan, architecture and landscaping; and the conceptual approval of Pad D as a 3,100 square foot drive-thru restaurant on 20.40 acres of land in the Mixed Use District of the Terra Vista Community Plan (MFC), located on the north side of Foothill Boulevard between Elm and Milliken Avenues -APN: 1077-421-98 and 227-771-53 (portion). J. Related file: Conditional Use Permit 99-25. Debra Meier, Contract Planner, presented the staff report. Chairman McNiel opened the public hearing. Glen Pierce, MCG Architects, 200 South Los Robles Avenue, Suite 300, Pasadena, stated they addressed the conditions as directed by the Design Review Committee. He indicated they tied into the design elements for the Texaco service station. He discussed Flexi-Rock and said it is a hard, durable material applied like stucco. Hearing no further testimony, Chairman McNiel closed the public hearing. Motion: Moved by Mannerino, seconded by Stewart, to issue a Negative Declaration and adopt the resolutions approving Conditional Use Permit 99-25 and Parcel Map 15424. Motion carded by the following vote: AYES: MANNERINO, MCNIEL, STEWART, TOLSTOY NOES: NONE ABSENT: MACIAS - carded Chairman McNiel stated the applicant had been cooperative with the Design Review Committee. He felt the project will be a nice addition to the community. K. ENVIRONMENTAL ASSESSMENT AND CONDITIONAL USE PERMIT 98-30- NORTHTOWN HOUSING DEVELOPMENT CORPORATION -The development of a 5,672 square foot community center facility on a 0.5-acre parcel of land in the Low Residential District (2-4 dwelling units per acre), located on the south side of Feron Boulevard, west of Hermosa Avenue -APN: 209-085-04. Related File: Variance 98-04. Chairman McNiel noted that staff was requesting that the item be continued until January 26, 2000. He opened the public hearing. There was no testimony. Motion: Moved by Stewart, seconded by Mannerino, to continue Conditional Use Permit 98-30 to January 26, 2000. ENVIRONMENTAL ASSESSMENT AND CONDITIONAL USE PERMIT 99-35 - POST PLAZA - The development of an office and warehouse building totaling 11,100 square feet on .7 acre of land in the General Industrial District (Subarea 13) of the Industrial Area Specific Plan, located on the east side of Charles Smith Avenue, north of San Marino Way - APN: 229-283-63. Lisa Kuschel, Planning Aide, presented the staff report. Chairman McNiel opened the public hearing. Ed Dugger, Project Manager, Post Plaza, 27935 Cactus Flower, Sun City, requested approval. Chairman McNiel thought the project is a good one. Harlan Delzer, Inland Empire Utilities Agency (IEUA), 9400 Cherry Avenue, Building A, Fontana, referenced a January 11, 2000, letter which indicated that the IEUA will soon have recycled water available. He stated that three of the projects on the current agenda are near a large trunk line and three other projects may be near lines in the near future when Cucamonga County Water District finalizes its plans. He asked that the Commission encourage the use of recycled water. He said the IEUA has an ordinance in process to adopt rates. Chairman McNiel asked for staff input. Kevin Ennis, Assistant City Attorney, explained that state law has been amended to encourage the use of recycled water. He noted that local water agencies must apply to a state agency which determines if recycled water of acceptable quality is available and what the proper rate would be. He did not believe the law mandates that municipalities require such use on individual projects or requires the City to use recycled water. Mr. Delzer indicated that the IEUA does not intend to require the use of recycled water. He said Section 13575 of the California State Water Code spells out a preferred operating agreement and they do not wish to mandate recycled water use. He stated that potable water will cost as much as $400 per acre foot and recycled water may be around $60. Chairman McNiel asked if IEUA has received approval from the state to sell water. Mr. Delzer responded they are operating under a National Pollutant Discharge Elimination System (NPDES) permit. Chairman McNiel asked if IEUA is a private enterprise. Mr. Delzer replied that it is a quasi-governmental agency and works with water districts. Chairman McNiel stated he would not be inclined to impose a requirement to use recycled water on a project which had already gone so far in the process but he felt the use of recycled water is a good idea. Commissioner Tolstoy asked who would be responsible for the distribution of recycled water. Planning Commission Minutes -4- January 12, 2000 Mr. Delzer said they deliver recycled water to the region and are offering to have Cucamonga County Water District (CCWD) be the agency in charge of connecting plumbing and piping as of April. He said CCWD may wish to have IEUA be in charge and they would work with construction people. He said they are interested in providing funding and a capital recovery system to encourage use. Commissioner Tolstoy asked about the service area and if it would go north of Sixth Street and would require pumping. Mr. Delzer said they are working on the master plan for serving recycled water with CCWD. He indicated recycled water would be available throughout Rancho Cucamonga. Chairman McNiel suggested that a workshop be scheduled to educate the Commission. Brad Buller, City Planner, suggested that staff could provide information about the use of recycled water at pre-development meetings. He felt it is an educational process and a map would be good. John Vega, Director of Operations, Cucamonga County Water District, 10440 Ashford, Rancho Cucamonga, stated they are working closely with IEUA to make the project work. He said that every drop of recycled water saves potable water and they are doing the best they can to encourage the use of recycled water. He thought it is a great project. Hearing no further testimony, Chairman McNiel closed the public hearing. Motion: Moved by Stewart, seconded by Tolstoy, to issue a Negative Declaration and to adopt the resolution approving Conditional Use Permit 99-35. ENVIRONMENTAL ASSESSMENT AND TIME EXTENSION FOR TENTATIVE TRACT 14405 - LEE - A request for an extension of a previously approved tentative tract map including design review for the development of 20 single family lots on 4.39 acres of land in the Low- Medium Residential District (4-8 dwelling units per acre), located on the north side of San Bemardino Road, east of Vineyard Avenue—APN: 208-091-08. Related File: Variance 91-11. N. TIME EXTENSION FOR VARIANCE 91-11 - LEE -A request for an extension of a previously approved variance to reduce the required rear lot depth from 90 to 65 feet for one lot within a proposed 20 lot subdivision in the Low-Medium Residential District (4-8 dwelling units per acre), located on the north side of San Bernardino Road, east of Vineyard Avenue - APN: 208-091-08. Related File: Tentative Tract 14405. Warren Morelion, Assistant Planner, presented the staff report. Chairman McNiel opened the public hearing. Jeff Lee, 2135 Huntington Drive, Suite 202, San Marino, stated they are in the process of submitting a new map to realign the street and hoped to present it to the Commission within a few months. He said they are seeking to extend the map because they must have a map in place to fulfill financial obligations. Hearing no further testimony, Chairman McNiel closed the public hearing. Planning Commission Minutes -5- January 12, 2000 Motion: Moved by Mannerino, seconded by Macias, to issue a Negative Declaration and adopt the resolutions approving Time Extension for Tentative Tract 14405, Time Extension for the Design Review of Tentative Tract 14405, and Time Extension for Variance 91-11. Motion carried by the following vote: AYES: MACIAS, MANNERINO, MCNIEL, STEWART, TOLSTOY NOES: NONE ABSENT: NONE - carried O. VARIANCE 99-07-AMERICAN STORES PROPERTIES-A request to exceed the maximum height requirement for one wall sign for a proposed supermarket within the Community Commercial District (Subarea 2) of the Foothill Boulevard Specific Plan, located at the northwest comer of Foothill Boulevard and Vineyard Avenue -APN: 207-102-03, 05, 08, 09, 15, 20, 21, and 49. Tom Grahn, Associate Planner, presented the staff report. Chairman McNiel asked for clarification that the variance request was only for the height of the sign, not the overall size. Mr. Grahn confirmed that was correct and the size would meet the City's maximum 150 square feet. Chairman McNiel opened the public hearing. There were no comments and he closed the hearing. Mr. Grahn reported he had spoken with the applicant on Tuesday and the applicant agreed with the conditions in the resolution. ' Commissioner Tolstoy felt the request was appropriate. Commissioner Mannerino concurred. Motion: Moved by Stewart, seconded by Mannerino, to adopt the resolution approving Variance 99-07. VARIANCE 99-10 — WILLIAMS ARCHITECTS — A request to reduce the interior side yard setback from 10 feet to 0 feet for a church in the Low Residential District (2-4 dwelling units per acre). Planning Commission Minutes -6- January 12, 2000 Commissioner Stewart asked if the applicant had held a neighborhood meeting and if there has been any opposition. Mr. Le Count replied that no neighborhood meeting was held and there has been no opposition. Commissioner Stewart asked if there is room for future growth. Mr. Le Count responded that the parking could probably not be expanded Commissioner Stewart asked if that meant that if they grow beyond 108, they would have to relocate. Mr. Le Count confirmed that was correct. Chairman McNiel opened the public hearing. There was no testimony and he closed the hearing. Commissioner Mannerino asked if the previous application had been approved. Chairman McNiel confirmed that it had. He said the previous owners built a room without permits and got caught and they then vacated the premises without making the improvements. He noted the variance request is to allow a fire lane. Commissioner Tolstoy supported the project because it would provide for the improvements to finally be made. Motion: Moved by Tolstoy, seconded by Mannerino, to issue a Negative Declaration and adopt the resolutions approving Conditional Use Permit 99-52 and Variance 99-10. ENVIRONMENTAL ASSESSMENT AND DEVELOPMENT REVIEW 99-54 — CABOT — The development of three industrial buildings totaling 217,210 square feet on 13.73 acres of land in the General Industrial District (Subarea 11) of the Industrial Area Specific Plan, located on the south side of Sixth Street between Richmond Place and Buffalo Avenue - APN: 229-263-56 through 61. Brent Le Count, Associate Planner, presented the staff report and indicated that staff had received a letter earlier in the day from the United States Fish and Wildlife Service requesting that focused surveys be conducted during the next two years to determine if the Delhi Sands flower-loving fly is present. He said the Service was requesting the surveys based upon driving to the site and standing at the edge of the site, rather than walking the site. Mr. Le Count stated that, based upon discussions with the City Attorney, staff was recommending a continuance for two weeks to allow the applicant time to respond to the letter. Chairman McNiel asked if staff had discussed the matter with the applicant. Mr. Le Count indicated staff had not been able to reach the applicant who could not be present this evening. Planning Commission Minutes -7- January 12, 2000 Commissioner Tolstoy asked if all projects with a suspicion of the presence of the Delhi Sands flower-loving fly would be faced with a two-year delay. Dan Coleman, Principal Planner, observed that the fly only comes above ground for about two weeks in August and the Fish and Wildlife Service feels it is necessary to conduct a survey in two consecutive years to determine if the fly is present. Commissioner Macias asked how frequently the Fish and Wildlife Service goes out and physically looks for the fly. Mr. Le Count responded that Fish and Wildlife Service personnel were at City Hall to attend a meeting with staff and drove by the site when they left. Commissioner Mannerino asked if the Service has the authority to mandate the surveys. Kevin Ennis, Assistant City Attorney, stated that the second paragraph in the letter from Fish and Wildlife outlines the legal authority under which they would be able to block development. Commissioner Macias asked if the City would be liable. Mr. Ennis responded that the City would have immunities and the developer would be the party doing the taking. He said that under the CEQA process, the submission of the letter from the Fish and Wildlife Service could trigger the Commission's request for a detailed review and the Commission should evaluate that review. Commissioner Mannerino asked if a two week continuance would be sufficient. Mr. Ennis felt that would at least give the applicant and the City time to know what was necessary. He indicated it would be appropriate to give the applicant time to address the letter. Chairman McNiel opened the public hearing. There were no testimony. Motion: Moved by Mannerino, seconded by Tolstoy to continue Development Review 99-54 to January 26, 2000, to allow the applicant time to respond to the letter from the United States Fish and Wildlife Service. Motion carried by the following vote: AYES: MACIAS, MANNERINO, MCNIEL, STEWART, TOLSTOY NOES: NONE ABSENT: NONE - carried PUBLIC COMMENTS There were no public comments at this time. COMMISSION BUSINESS S. DESIGN REVIEW COMMITTEE APPOINTMENTS Commissioner Mannerino noted that he and Commissioner Macias are on the General Plan Update Task Force and he asked if Chairman McNiel and Commissioner Stewart could continue on the Design Review Committee. Planning Commission Minutes -8- January 12, 2000 Chairman McNiel and Commissioner Stewart indicated they could continue to serve. It was the consensus of the Commission that Chairman McNiel and Commissioner Stewart would remain on the Design Review Committee. T. GENERAL PLAN UPDATE PROGRESS Brad Buller, City Planner, indicated that staff recently finished updating the mapping capability on the GIS to allow generation of maps which are parcel specific. He indicated another Task Force meeting will be scheduled shortly. ADJOURNMENT Motion: Moved by Stewart, seconded by Mannerino, carried 5-0, to adjourn.
