REGULAR MEETINGS COUNCIL CHAMBERS 7:00 P.M.
The City Council meets regularly on the first and third Wednesday of the month at 7:00 p.m. in the
Council Chambers located at 10500 Civic Center Drive. It Is the Intent to conclude the meeting by 10:00 p.m.
unless extended by the concurrence of the City Council. Agendas, minutes, and recordings of meetings can be
found at www.cityofrc.us or by contacting the City Clerk's Office at 9097742023.
In accordance with AB 361, and to ensure the health and safety of our residents by limiting contact that could
spread the COVID–19 virus, members of the public have the option to participate in this City Council/Fire
District meeting via a teleconference. Members of the public may also attend the meeting in person. Those
wishing to speak during public communication may call at the start of the meeting by dialing (909)7742751 to
be added to the queue for public comment. Calls will be answered in the order received. Members of the
public are encouraged to watch from the safety of their homes by Live Streaming on the City's website at
https://www.cityofrc.us/your government/city council agendas or Local Cable: RCTV 3 Programming.

Members of the City Council also sit as the Fire Board, Housing Successor Agency, Successor Agency, and
Public Finance Authority. This is the time and place for the general public to address the Fire Protection
District, Housing Successor Agency, Successor Agency, Public Financing Authority Board, and City Council on
any item listed or not listed on the agenda. State law prohibits the Fire Protection District, Housing Successor
Agency, Successor Agency, Public Financing Authority Board, and City Council from addressing any issue not previously
included on the Agenda. The Fire Protection District, Housing Successor Agency, Successor Agency, Public Financing
Authority Board, and City Council may receive testimony and set the matter for a subsequent meeting.
Comments are to be limited to five minutes per individual or less, as deemed necessary by the Mayor,
depending upon the number of individuals desiring to speak. All communications are to be addressed directly to the
Fire Board, Agencies, Successor Agency, Authority Board, or City Council not to the members of the audience. This is a
professional business meeting and courtesy and decorum are expected. Please refrain from any debate between audience
and speaker, making loud noises, or engaging in any activity which might be disruptive to the decorum of the meeting.
The public communications period will not exceed one hour prior to the commencement of the business
portion of the agenda. During this one hour period, all those who wish to speak on a topic contained in the business
portion of the agenda will be given priority, and no further speaker cards for these business items (with the exception of
public hearing items) will be accepted once the business portion of the agenda commences. Any other public
communications which have not concluded during this one hour period may resume after the regular business portion of
the agenda has been completed.

upon without discussion unless an item is removed by Council Member for discussion.

RECOMMENDATION:
Staff recommends that the City Council/Board of Directors of the Fire Protection District receive
and file the attached current investment schedules for the City of Rancho Cucamonga (City) and
the Rancho Cucamonga Fire Protection District (District) as of November 30, 2022.
BACKGROUND:
The attached investment schedules as of November 30, 2022 reflect cash and investments
managed by the Finance Department/Revenue Management Division and are in conformity with
the requirements of California Government Code Section 53601 and the City of Rancho
Cucamonga’s and the Rancho Cucamonga Fire Protection District’s adopted Investment Policies
as approved on June 16, 2022.
ANALYSIS:
The City’s and District’s Treasurers are each required to submit a quarterly investment report to
the City Council and the Fire Board, respectively, in accordance with California Government Code
Section 53646. The quarterly investment report is required to be submitted within 30 days
following the end of the quarter covered by the report. However, the City and District Treasurers
have each elected to provide this report on a monthly basis.

The monthly investment schedule supports the City Council’s core value of providing and

SUBJECT:Consideration of the Purchase of Fifty Sets of Firefighting Turnout Gear
from AllStar Fire Equipment, Inc. as a Single Source Vendor in the
Amount of $179,730. (FIRE)
RECOMMENDATION:
Staff recommends that the Fire Board authorize the single source purchase of fifty (50) sets of
firefighting turnout gear from AllStar Fire Equipment, Inc. in the amount of $179,730.
BACKGROUND:
The National Fire Protection Association (NFPA) governs turn out gear standards and establishes
requirements for protective clothing to protect against the adverse environmental effects
encountered by Fire Safety Personnel while performing firefighting and lifesaving operations.
NFPA mandates that turnout coats and pants have a service life of no more than 10-years from
the date of manufacturer, to limit potential safety issues.
Firefighters require two (2) sets of gear (coat and pant components) due to daily exposure to
contaminants and the need for NFPA required inspections and maintenance. The Fire District
replaces a portion of our gear every year to maintain our compliance with NFPA guidelines and
provide our personnel with the safest and most fiscally responsible gear possible.
Firefighting coats and pants are each comprised of a 3-layer system. The three-layers involved
are the thermal liner, the moisture barrier, and the outer shell. The thermal liner has greatest
impact on reducing the stress associated with a fire’s heat by providing thermal protection. This
layer traps air in or between layers of nonwoven material quilted to a face cloth fabric. The thermal
and moisture layers combine to provide about 75 percent of the protection for the firefighter.
The moisture barrier protects the firefighter from water, chemicals, and viral agents. It is made of
Polytetrafluoroethylene (PTFE) which is a permeable film barrier laminated to a flame-resistant
material.
The outer shell is the first line of protection from the heat by providing flame resistance and
maintaining the effectiveness of the other two liners. It also protects the firefighter from cuts and
abrasions from debris or building materials. While this provides the least amount of thermal
protection, it is an important piece of the entire ensemble.

ANALYSIS:
The Fire District has determined that fifty (50) sets of turnout gear need to be purchased during
the current fiscal year. This will include the annual replacement of twenty-three (23) sets of
turnouts for existing personnel; twelve (12) sets for personnel who recently completed their
probationary period and need their second set of turnouts; and fifteen (15) new personnel hired
to backfill existing vacancies and staff new Fire Station 178.
The Fire District typically goes out to bid annually for the purchase of turnout gear. The last two
bids have been awarded to AllStar Fire Equipment, Inc., the local authorized distributor of LION
products. LION brand turnouts are well known in the personal protective gear industry and have
a proven track record for quality, performance, and safety. The Fire District currently has 92 sets
of LION brand turnouts, out of a total 156 sets in service (both frontline and backup sets). Since
utilizing these turnouts, Fire personnel have experienced a higher level of fit, function, and mobility
than turnouts previously purchased. The quality and durability of these turnouts, balanced with
the increased comfort, has been unparalleled. As a result, the Fire District now has a higher
standard and expectation for turnout gear moving forward.
In order to provide continuity of operations and ensure the health and safety of Fire District
personnel, staff recommends utilizing a single source purchase with AllStar Fire Equipment, Inc.
for the purchase of LION brand turnout gear. This turnout gear continues to meet the needs and
safety demands of the Fire District and has proven to be a high-quality product that exceeds
brands that have been purchased previously.
FISCAL IMPACT:
The purchase of firefighting turnout gear was approved in the FY 2022-23 budget. A total of
$150,000 was allocated in the Fire Protection Capital Fund under account 3288501-5207 (O&M
– Capital Supplies). The total purchase price will be $179,730. There are sufficient funds within
the Fire Protection Capital Fund to cover the increased cost of the turnout gear.

SUBJECT:Consideration To Approve the Housing Successor Fiscal Year 2021-2022
Annual Report. (HOUSING SUCCESSOR AGENCY)
RECOMMENDATION:
Staff recommends that the Housing Successor Agency approve the Annual Report for Fiscal Year
2021/2022, authorize staff to make administrative changes to the Annual Report upon completion
of the CAFR, and authorize the transmittal of the Annual Report to the appropriate State
agencies.
BACKGROUND:
After February 1, 2012 all assets, properties and contracts of the former Rancho Cucamonga
Redevelopment Agency (former Agency) were transferred, by operation of law to the Successor
Agency to the Rancho Cucamonga Redevelopment Agency (Successor Agency). Pursuant to
the Dissolution Law, the City Council elected to retain and assume all housing assets and
functions. On October 13, 2013, the Governor signed into law Senate Bill 341 (SB341), which
amend provisions of the Dissolution Law, in particular relating to housing successors. SB341
amended the former housing annual report requirement due to both the State Controller and the
Department of Housing and Community Development while Redevelopment Agencies were
active and established affordable housing requirements to be performed by housing successors
effective January 1, 2014. As of dissolution, housing successors now maintain and deposit funds
into a Low-and-Monderate Income Housing Assets Fund (LMIHAF), subject to the requirements
of the Dissolution Law, as amended by SB 341. Under SB 341, housing successors have an
annual auditing and reporting obligation to be completed every fiscal year starting with FY 2013-
2014.
ANALYSIS:
Pursuant to SB 341 a Housing Successor Agency is required to file an Annual Report of its
activities within six months of the Agency’s fiscal year end. This report is required to contain the
following information:
1. The amount deposited to the Low Moderate Income Housing Asset Fund (LMIHAF),
distinguishing and amounts deposited for items listed on the Recognized Obligation
Payment Schedule (ROPS).
2. A statement of the balance in the LMIHAF as the close of the fiscal year, distinguishing
any amounts held for items listed on the ROPS.

3. A description of expenditures from the LMIHAF by category, including, but not limited to,
expenditures for (a) monitoring and preserving the long-term affordability of units subject
to affordability restrictions or covenants and administrative expenses; (b) homeless
prevention and rapid re-housing services; and (c) development of affordable housing.
4. The statutory value of real property owned by the housing successor, the value of loans
and grants receivable, and the sum of these two amounts.
5. A description of any transfers of LMIHAF funds made to another housing successor in the
previous fiscal year.
6. A description of any project for which the Housing Successor receives or holds property
tax revenue pursuant to the ROPS and the status of that project.
7. Status update on compliance with Section 33334.16 for property acquired by the former
redevelopment agency prior to February 1, 2012, and a status update for interests in
property acquired on or after February 1, 2012.
8. A description of any outstanding obligation pursuant to Section 33413. This section
provides a description of any outstanding replacement housing obligation that remained
to be transfer to the Housing Successor Agency on February 1, 2012, and the Housing
Successor Agnecy’s plans to meet the unmet obligations.
9. Housing Successor mush determine the percentage of housing for seniors and person of
all ages within the previous 10-years. Senior housing units may not exceed 50% of the
total units restricted.
The amount of unencumbered funds that exceed the greater of one million dollars
($1,000,000) or the aggregate amount deposited into the account during the Housing
Successor Agency’s preceding four fiscal years, whichever is greater.
The Annual Report for Fiscal Year 2021/22 is being transmitted to the Housing Successor Agency
in accordance with the applicable legislation and contains all the required information as outlined
above. Following the approval by the Housing Successor, the report will be sent to the appropriate
State agencies for review.
FISCAL IMPACT:
There is no fiscal impact to the City’s General Fund associated with the submission of the Annual
Report. However, failure to submit the report could lead to State sanctions and preventing the
Housing Successor Agency’s funds from being encumbered or expended.
COUNCIL MISSION / VISION / VALUE(S) ADDRESSED:
While approval of the Annual Report is not a specific goal of the City Council, this action
is required by the State of California Housing and Community Development Department
to continue operations of the Housing Successor Agency which meets the Council’s core

In July 2014 the Housing Successor Agency acquired a 2.5-acre property for the purpose
of constructing a 60-unit senior affordable rental housing complex. The project
affordability agreement provides for 59 of the 60 1-and 2-bedroom units to be restricted
to income eligible seniors. Construction of the project has been completed and a grand
opening was held in May 2018.

Additionally, in 2019 the Agency acquired a 4.01-acre property for the construction of a
140-unit senior affordable rental housing complex. As of the date of this report the
project was completed in October of 2020. The project offers 1-and 2-bedroom units to
qualified seniors.
8.) A description of any outstanding obligation pursuant to Section 33413 that remained
to transfer to the housing successor on February 1, 2012, the Housing Successor’s
progress in meeting these obligations, and the Housing Successor’s plans to meet
unmet obligations.
There is no outstanding obligation that had been transferred to the Housing Successor
Agency on February 1, 2012.
9.)Housing Successor must determine the % of housing for seniors and persons of all ages

ANALYSIS:
The subject project has been completed in accordance with the approved plans and specifications
to the satisfaction of the Public Works Services Director.
The net increase in the total cost of the project is a result of a Contract Change Order
(CCO). CCO #1 increased the quantity of new asphalt paving and had the contractor install City
supplied exercise equipment.
At the end of the one-year maintenance period, if the improvements remain free from defects in
materials and workmanship, the City Clerk is authorized to release the Maintenance Bond upon
approval by the Public Works Services Director.
FISCAL IMPACT:
Originally, the $150,000 funding was included in the Fiscal Year 2021/2022 adopted budget for
this project in account number 1848303-5607 (PD 85). Due to negotiations to reduce the project
scope to match available funds, the project could not be awarded before the end of Fiscal Year
2021/2022. During the August 17, 2022, City Council meeting, the mayor and members of the
City Council appropriated $150,000 from the PD 85 fund balance to award the contract for the
project.

BACKGROUND:
The City Council/ Fire Board traditionally adopts salary resolutions biannually for classifications
employed by the City of Rancho Cucamonga and the Rancho Cucamonga Fire Protection District.
These resolutions are updated to reflect changes in salaries, additions and deletions of
classifications, changes in job titles, and other terms of employment. The proposed changes in
the attached resolutions reflect the following circumstances:
•Effective January 1, 2023, the State of California minimum wage will increase from $15.00
per hour to $15.50 per hour.
•Equity reviews and adjustments showed significant discrepancies between some salaries
and the prevailing salaries of comparable positions in other organizations within the same
geographic area. Difficulties in recruitment and retention support the need for equity
adjustments.

•For several years, there has been a growing shortage of skilled and qualified workers. The
COVID-19 pandemic has intensified the effect. Contributing factors include Baby Boomers
retiring and leaving the workplace without enough employees to backfill, dwindling
apprenticeship programs, and a lack of interest in trades and STEM careers.
•The City entered into a Memorandum of Understanding (MOU) with the Rancho
Cucamonga City Employees Association (RCCEA), effective July 1, 2022, to December
31, 2024. The Parties met and conferred in good faith in November and December of
2022. The Parties agreed to amend Section 4 of the current MOU, “Equity Adjustment” for
certain RCCEA covered Engineering positions.
ANALYSIS:
In order to comply with the State of California minimum wage law, the attached resolutions include
updates to the City and Fire District part-time salary schedules, increasing those steps below the
minimum wage.
Updates to the Part-Time Fire District salary schedule include increasing steps below the
minimum wage to $15.50 per hour for the Fire Clerk, Fire Prevention Assistant, and Office
Specialist I. In addition, the Office Specialist I salary range will be adjusted to maintain a 5%
difference between each step.
Updates to the Part-Time City Positions Salary Schedule include increasing steps below the
minimum wage to step 6364, $15.55 per hour. This is the next step above the minimum wage on
the City’s salary table. Updates also include the addition of part-time Executive Assistant II with
the salary range set at its full-time equivalent hourly range.
An update to the Rancho Cucamonga City Employees Association (RCCEA) salary schedule
includes adjusting the bottom step of the Customer Care Assistant salary range to maintain the
range equal to the Administrative Assistant position’s salary range. The Animal Center’s
Administrative Assistant position was reclassified to Customer Care Assistant in April 2021. At
that time, it was determined that the salary range for this position was to remain the same as the
Administrative Assistant position. On July 2021, the bottom step of the Administrative Assistant
was eliminated by 10% pursuant to an agreed-upon provision on the RCCEA MOU. Updating the
bottom step of the Customer Care Assistant will allow the salary range to remain at the same
range as the Administrative Assistant.
Additionally, staff identified several classifications that have struggled with recruitment and
retention due to competitive market pressures for certain types of skilled workers. An updated
comparison with labor market cities resulted in the following findings for the Engineering
classifications.
Engineering has struggled to fill positions dues to a number of different reasons, including excess
turnover, unsuccessful recruitments, and candidates accepting other jobs before the City can
complete the hiring process. While the turnover and retention rates are higher than the City’s
average, engineering’s turnover is comparable to other agencies. On average, salaries for the
City’s engineering classifications are between 4.4% and 9.1% below market, which has impacted
the City’s ability to remain competitive with other agencies. Currently, there is an extreme
shortage of engineers and, as a result, increased competition with agencies in both the public and
private sectors.

The City has a number of major capital projects currently underway and more planned in the near
future. Both City and grant-funded, these projects will have a direct impact on the community and
necessitate that the engineering department is adequately staffed with highly skilled employees
to successfully manage the projects.
To ensure external equity with agencies competing for talent in the same labor market, attract
and retain a high-quality workforce, and ensure proper compaction between classifications, staff
recommends the following equity adjustments:

Assistant Engineer RCCEA 8%
Associate Engineer RCCEA 8%
Staff recommends that the City Council approve the attached resolution adopting a side letter
agreement and salary schedules for job classifications employed by the City of Rancho
Cucamonga for the fiscal year 2022-23. This Side Letter of Agreement shall be incorporated into
the RCCEA MOU. The MOU shall remain in full force and effect except to the extent modified by
this Side Letter of Agreement. This Side Letter of Agreement shall not be effective until ratified by
the City Council and approved by RCCEA.
Staff also recommends that the Fire Board approve the resolution updating the salary schedules
for job classifications employed by the Rancho Cucamonga Fire Protection District for the fiscal
year 2022-23.
FISCAL IMPACT:
Adjustments to the part-time salary ranges and their fiscal impacts were accounted for in the
current fiscal year budget. The fiscal impact of the engineering equity adjustments is estimated
as $156,070 as follows:

Staff has identified sufficient salary savings in the General Fund to cover the Engineering position
equity adjustments. Some of the special fund allocations may require further adjustment in FY
2023-24, however, the bulk of the expenses are in the General Fund and any shortfalls in special
funds can be made up accordingly for FY 2022-23.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RANCHO CUCAMONGA, CALIFORNIA, APPROVING A SIDE
LETTER OF AGREEMENT BETWEEN THE CITY OF RANCHO
CUCAMONGA AND THE RANCHO CUCAMONGA CITY
EMPLOYEES ASSOCIATION AND SALARY SCHEDULES FOR
JOB CLASSIFICATIONS EMPLOYED BY THE CITY FOR FISCAL
YEAR 2022-23.
WHEREAS, representatives of the City of Rancho Cucamonga (City) and the Rancho
Cucamonga Employees Association (RCCEA) have met and conferred pursuant to the provisions
of the Meyers-Milias-Brown Act (California Government Code §3500, et seq.) with regard to terms
and conditions of employment; and
WHEREAS, representatives of the City and RCCEA have agreed upon and presented to
this City Council a Side Letter of Agreement (see attached Side Letter of Agreement), effective
upon ratification of the City Council and approved by RCCEA; and
WHEREAS, the City Council of the City of Rancho Cucamonga has determined that it is
necessary for the efficient operation and management of the City that policies be established
prescribing salary ranges, benefits and holidays, and other policies for employees of the City of
Rancho Cucamonga; and
WHEREAS, the City Council of the City of Rancho Cucamonga has previously adopted
salary resolutions establishing salary ranges, benefits, and other terms of employment for
employees of the City of Rancho Cucamonga; and
WHEREAS, the City Council of the City of Rancho Cucamonga recognizes that it is
necessary from time to time to amend the salary resolution to accommodate changes in position
titles, classifications salary ranges, benefits, and other terms of employment; and
NOW, THEREFORE, THE CITY COUNCIL HEREBY RESOLVES that said Side Letter
of Agreement is hereby approved and the City Manager is hereby authorized to sign said Side
Letter of Agreement on behalf of the City, and the City Clerk to attest thereto (Attachment 2); and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rancho
Cucamonga, California to approve the attached salary schedules for the Executive Management
Group, Rancho Cucamonga Management Association, Rancho Cucamonga City Employees
Association, Teamsters Local 1932, and Part-Time City positions (Attachments 3 - 7).

SIDE LETTER OF AGREEMENT
BETWEEN THE CITY OF RANCHO CUCAMONGA
AND THE RANCHO CUCAMONGA CITY EMPLOYEES ASSOCIATION
The City of Rancho Cucamonga ("City") and the Rancho Cucamonga City Employees Association
(“RCCEA) (collectively, the "Parties") entered into a Memorandum of Understanding ("MOU")
that commenced on July 1, 2022, and expires on December 31, 2024.
The Parties met and conferred in good faith in November and December of 2022. The Parties
agreed to amend Section 4 of the current MOU, “Equity Adjustment” for certain RCCEA covered
Engineering positions.
Section 53 would be modified to read (the modifications are highlighted in yellow and the existing
text would remain unchanged):
SECTION 4: EQUITY ADJUSTMENT
Effective December 19, 2022, the following RCCEA positions shall receive an equity
adjustment:
Engineering Technician – 5%
Assistant Engineer – 8%
Associate Engineer – 8%
Effective the second full pay period in June 2023, the following RCCEA positions shall
receive an equity adjustment to bring them closer to 5% of market:
•Animal Services Supervisor – 7%
•Human Resources Technician – 6%
This Side Letter of Agreement shall be incorporated into the MOU. The MOU shall remain in full
force and effect except to the extent modified by this Side Letter of Agreement. This Side Letter
of Agreement shall not be effective until ratified by the City Council and approved by the Rancho

A RESOLUTION OF THE BOARD OF DIRECTORS OF THE
RANCHO CUCAMONGA FIRE PROTECTION DISTRICT,
RANCHO CUCAMONGA, CALIFORNIA, APPROVING THE
RANCHO CUCAMONGA FIRE PROTECTION DISTRICT
SALARY SCHEDULES FOR FISCAL YEAR 2022-2023.
WHEREAS, the Board of Directors of the Rancho Cucamonga Fire Protection District has
determined that it is necessary for the efficient operation and management of the District that
policies be established prescribing salary ranges, benefits and holidays, and other policies for
employees of the Rancho Cucamonga Fire Protection District; and
WHEREAS, the Board of Directors of the Rancho Cucamonga Fire Protection District has
previously adopted salary resolutions that established salary ranges, benefits, and other terms of
employment for employees of the Rancho Cucamonga Fire Protection District; and
WHEREAS, the Board of Directors of the Rancho Cucamonga Fire Protection District
recognizes that it is necessary from time to time to amend the salary resolution to accommodate
changes in position titles, classifications salary ranges, additions and deletions of classifications,
benefits, and other terms of employment; and
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Rancho
Cucamonga Fire Protection District, Rancho Cucamonga, California to approve the attached
Rancho Cucamonga Fire Protection District Salary Schedules (Attachment 9 - 12) effective
January 1, 2023.

RECOMMENDATION:
Staff recommends the City Council approve a resolution adopting a side letter of agreement
between the City of Rancho Cucamonga and the Rancho Cucamonga City Employees
Association (RCCEA) and salary schedules for job classifications employed by the City of Rancho
Cucamonga for fiscal year 2022-23 and approve a resolution adopting salary schedules for job
classifications employed by the Rancho Cucamonga Fire Protection District for fiscal year 2022-
23.
BACKGROUND:
The City Council/ Fire Board traditionally adopts salary resolutions biannually for classifications
employed by the City of Rancho Cucamonga and the Rancho Cucamonga Fire Protection District.
These resolutions are updated to reflect changes in salaries, additions and deletions of
classifications, changes in job titles, and other terms of employment. The proposed changes in
the attached resolutions reflect the following circumstances:
•Effective January 1, 2023, the State of California minimum wage will increase from $15.00
per hour to $15.50 per hour.
•Equity reviews and adjustments showed significant discrepancies between some salaries
and the prevailing salaries of comparable positions in other organizations within the same
geographic area. Difficulties in recruitment and retention support the need for equity
adjustments.
•For several years, there has been a growing shortage of skilled and qualified workers. The

COVID-19 pandemic has intensified the effect. Contributing factors include Baby Boomers
retiring and leaving the workplace without enough employees to backfill, dwindling
apprenticeship programs, and a lack of interest in trades and STEM careers.
• The City entered into a Memorandum of Understanding (MOU) with the Rancho
Cucamonga City Employees Association (RCCEA), effective July 1, 2022, to December
31, 2024. The Parties met and conferred in good faith in November and December of
2022. The Parties agreed to amend Section 4 of the current MOU, “Equity Adjustment” for
certain RCCEA covered Engineering positions.
ANALYSIS:
In order to comply with the State of California minimum wage law, the attached resolutions include
updates to the City and Fire District part-time salary schedules, increasing those steps below the
minimum wage.
Updates to the Part-Time Fire District salary schedule include increasing steps below the
minimum wage to $15.50 per hour for the Fire Clerk, Fire Prevention Assistant, and Office
Specialist I. In addition, the Office Specialist I salary range will be adjusted to maintain a 5%
difference between each step.
Updates to the Part-Time City Positions Salary Schedule include increasing steps below the
minimum wage to step 6364, $15.55 per hour. This is the next step above the minimum wage on
the City’s salary table. Updates also include the addition of part-time Executive Assistant II and
Customer Service Specialist I/II/III – Utilities with the ranges set at the full-time equivalent salary
range.
An update to the Rancho Cucamonga City Employees Association (RCCEA) salary schedule
includes adjusting the bottom step of the Customer Care Assistant salary range to maintain the
range equal to the Administrative Assistant position’s salary range. The Animal Center’s
Administrative Assistant position was reclassified to Customer Care Assistant in April 2021. At
that time, it was determined that the salary range for this position was to remain the same as the
Administrative Assistant position. On July 2021, the bottom step of the Administrative Assistant
was eliminated by 10% pursuant to an agreed-upon provision on the RCCEA MOU. Updating the
bottom step of the Customer Care Assistant will allow the salary range to remain at the same
range as the Administrative Assistant.
Additionally, staff identified several classifications that have struggled with recruitment and
retention due to competitive market pressures for certain types of skilled workers. An updated
comparison with labor market cities resulted in the following findings for the Engineering
classifications.
Engineering has struggled to fill positions dues to a number of different reasons, including excess
turnover, unsuccessful recruitments, and candidates accepting other jobs before the City can
complete the hiring process. While the turnover and retention rates are higher than the City’s
average, engineering’s turnover is comparable to other agencies. On average, salaries for the
City’s engineering classifications are between 4.4% and 9.1% below market, which has impacted
the City’s ability to remain competitive with other agencies. Currently, there is an extreme
shortage of engineers and, as a result, increased competition with agencies in both the public and
private sectors.
The City has a number of major capital projects currently underway and more planned in the near

future. Both City and grant-funded, these projects will have a direct impact on the community and
necessitate that the engineering department is adequately staffed with highly skilled employees
to successfully manage the projects.
To ensure external equity with agencies competing for talent in the same labor market, attract
and retain a high-quality workforce, and ensure proper compaction between classifications, staff
recommends the following equity adjustments:

Associate Engineer RCCEA 8%
Staff recommends that the City Council approve the attached resolution adopting a side letter
agreement and salary schedules for job classifications employed by the City of Rancho
Cucamonga for the fiscal year 2022-23. This Side Letter of Agreement shall be incorporated into
the RCCEA MOU. The MOU shall remain in full force and effect except to the extent modified by
this Side Letter of Agreement. This Side Letter of Agreement shall not be effective until ratified by
the City Council and approved by RCCEA.
Staff also recommends that the Fire Board approve the resolution updating the salary schedules
for job classifications employed by the Rancho Cucamonga Fire Protection District for the fiscal
year 2022-23.
FISCAL IMPACT:
Adjustments to the part-time salary ranges and their fiscal impacts were accounted for in the
current fiscal year budget. The fiscal impact of the engineering equity adjustments is estimated at
$156,440, broken down as follows:

Staff has identified sufficient salary savings in the General Fund to cover the Engineering position
equity adjustments. Some of the special fund allocations may require further adjustment in FY
2023-24, however, the bulk of the expenses are in the General Fund and any shortfalls in special
funds can be made up accordingly for FY 2022-23.

RECOMMENDATION:
It is recommended that the City Council approve and adopt the Resolution Certifying the Results
of an Election and Adding Annexation No. 2022-1 to Community Facilities District No. 2022-01.
BACKGROUND:
The City Council approved Resolutions No. 2022-063 (the “Resolution Authorizing Future
Annexation”) authorizing the future annexation of territory to Community Facilities District No.
2022-01 (Street Lighting Services) (the “CFD 2022-01”) to provide maintenance and services to
streetlights, traffic signals, and appurtenant facilities for new development.
The City conditions the property owner to annex such property into the existing CFD 2022-01 to
fund street light service and maintenance. On September 21, 2022, the property owner signed an
Annexation Proceeding Deposit Agreement to initiate the annexation process.
ANALYSIS:
On November 9, 2022, the Property Owner submitted their Consent and Waiver and Official Ballot
to the City Clerk’s Office Election Official. The Election Official has canvassed the ballot and
completed the statement of votes cast (See Exhibit “A” of the Resolution). The Property Owner
cast their vote unanimously in favor of the special tax levy for CFD 2022-01. Adoption of this
Resolution constitutes the City Council’s formal action certifying the election results and adding
the Annexation Territory to CFD 2022-01 and directs the recordation of an amendment to the
existing Notice of Special Tax Lien. By recordation of this amendment, prospective purchasers of
the property within the Annexation Territory will have notice of the special tax obligation affecting
such property.

FISCAL IMPACT:
CFD 2022-01 was formed to be financially self-sufficient, meaning the revenues generated by the
District offset the costs of providing services and can be adjusted annually based on changes in

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RANCHO CUCAMONGA, CALIFORNIA, CERTIFYING THE
RESULTS OF AN ELECTION AND ADDING ANNEXATION
NO. 2022-1 TO COMMUNITY FACILITIES DISTRICT NO.
2022-01 (STREET LIGHTING SERVICES) OF THE CITY OF
RANCHO CUCAMONGA.
WHEREAS, the City Council of the City of Rancho Cucamonga, California (the
“City Council”) has previously formed Community Facilities District No. 2022-01 (Street
Lighting Services) of the City of Rancho Cucamonga (“CFD No. 2022-01”) pursuant to
the Mello-Roos Community Facilities Act of 1982 (the “Act”), as amended, for the purpose
of financing certain municipal maintenance services; and
WHEREAS, acting pursuant to the Act, the City Council also authorized by the
adoption of Resolution No. 2022-063 (the “Resolution Authorizing Future Annexation”)
the annexation in the future of territory to CFD No. 2022-01, such territory designated as
Future Annexation Area, Community Facilities District No. 2022-01 (the “Future
Annexation Area”); and
WHEREAS, at this time the unanimous consent to the annexation of certain
territory located within the Future Annexation Area to CFD No. 2022-01 has been
received from the property owner of such territory, and such territory has been designated
as ANNEXATION NO. 2022-1 (the "Territory"); and
WHEREAS, less than twelve (12) registered voters have resided within the
Territory for each of the ninety (90) days preceding the election date established for the
Territory, therefore, pursuant to the Act the qualified elector of the Territory shall be the
"landowner," as such term is defined in Government Code Section 53317(f), of such
Territory and such landowner who is the owner of record as of the applicable election
date, or the authorized representative thereof, shall have one vote for each acre or portion
of an acre of the parcel of land that landowner owns within such Territory; and
WHEREAS, the time limit specified by the Act for conducting an election to submit
the levy of the special taxes on the Territory to the qualified elector thereof and the
requirements for impartial analysis and ballot arguments have been waived with the
unanimous consent of the qualified elector of the Territory; and
WHEREAS, the City Clerk of the City of Rancho Cucamonga has caused a ballot
to be distributed to the qualified elector of the Territory, has received and canvassed such
ballot and made a report to the City Council regarding the results of such canvass, a copy
of which is attached as Exhibit “A” hereto and incorporated herein by this reference; and

WHEREAS, at this time the measure voted upon and such measure did receive
the favorable vote of the qualified elector of the Territory, and the City Council desires to
declare the results of the election; and
WHEREAS, a map showing the Territory and designated as Annexation Map No.
2022-1 (the "Annexation Map"), a copy of which is attached as Exhibit “B” hereto and
incorporated herein by this reference, has been submitted to this legislative body.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City
of Rancho Cucamonga, California, acting as the legislative body of Community Facilities
District No. 2022-01, as follows:
Section 1. Recitals. The above recitals are true and correct.
Section 2. Findings. This legislative body does hereby further determine as
follows:
A. The unanimous consent as described in the recitals hereto to the
annexation of the Territory to CFD No. 2022-01 has been given by the owner of the
Territory and such consent shall be kept on file in the Office of the City Clerk of the City
of Rancho Cucamonga.
B. Less than twelve (12) registered voters have resided within the Territory for
each of the ninety (90) days preceding the election date established for the each of the
parcels located within the Territory, therefore, pursuant to the Act the qualified elector for
the Territory shall be the "landowner" of the Territory as such term is defined in
Government Code Section 53317(f).
C. The qualified elector of the Territory has voted in favor of the levy of special
taxes on the Territory upon its annexation to CFD No. 2022-01.
Section 3. Territory. The boundaries and parcels of property within the
Territory and on which special taxes will be levied in order to pay for the costs and
expenses of authorized municipal maintenance services are shown on the Annexation
Map as submitted to and hereby approved by this legislative body.
Section 4. Declaration of Annexation. This legislative body does hereby
determine and declare that the Territory, and each parcel therein, is now added to and
becomes a part of CFD No. 2022-01. The City Council, acting as the legislative body of
CFD No. 2022-01, is hereby empowered to levy the authorized special tax within the
Territory.
Section 5. Notice. Immediately upon adoption of this Resolution, notice shall
be given as follows:

A. A copy of the Annexation Map as approved shall be filed in the Office of the
County Recorder no later than fifteen (15) days after the date of adoption of this

the date of adoption of this Resolution.
Section 6. Effective Date. This Resolution shall become effective upon its
adoption.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RANCHO
CUCAMONGA, CALIFORNIA, ADDING CHAPTER 9.36 OF THE
RANCHO CUCAMONGA MUNICIPAL CODE TO PROHIBIT THE
POSSESSION OF A CATALYTIC CONVERTER WITHOUT LEGAL
AUTHORITY
A. RECITALS
1. WHEREAS, the City Council finds that residents of Rancho Cucamonga have experienced an
increase in catalytic converter thefts from their automobiles over the past several years; and
2. WHEREAS, catalytic converter theft causes significant financial damage to the victims; and
3. WHEREAS, no City, State, or Federal legislation effectively deters unlawful possession of a
catalytic converter, limiting criminal enforcement remedies; and
4. WHEREAS, catalytic converter thefts are on the rise because: (a) detection is difficult, and
such theft can be easily accomplished, often in a matter of seconds, through the use of
common tools such as a reciprocating saw; (b) catalytic converters can be quickly sold for
recycling to scrap metal yards, usually for $200 to $1,200 each; and
5. WHEREAS, persons stealing catalytic converters recycle them for substantial profit, while the
victims suffer significant consequences in the form of costly repairs and inconvenience.
6. WHEREAS, this Ordinance is necessary to provide the City of Rancho Cucamonga with legal
authority to prosecute a person unlawfully possessing a catalytic converter, in order to better
protect the public and deter this criminal activity.
B. ORDINANCE
The City Council of the City of Rancho Cucamonga does ordain as follows:
Section 1. The above recitals are true and correct and incorporated herein.
Section 2. Chapter 9.36 (Unlawful Possession of a Catalytic Converter Prohibited) of Title 9
(Public Peace Morals and Welfare) of the Rancho Cucamonga Municipal Code is hereby added to read as
follows:
Chapter 9.36 Unlawful Possession of a Catalytic Converter Prohibited
9.36.010 – Unlawful Possession of a Catalytic Converter
a. It is unlawful for any person to possess any catalytic converter that is not properly attached to
the exhaust system of a vehicle unless the person has in their possession or under their control
valid documentation or other valid proof of ownership of the catalytic converter.

b. It is unlawful for any person to knowingly falsify or cause to be falsified any information in a
record intended to show valid proof of ownership of a catalytic converter.
9.36.020 – Valid Proof of Ownership
a. For purposes of this section, valid proof of ownership means:
a. A document containing all of the following information:
i. The license plate number and vehicle identification number of the car from which
the catalytic converter was removed;
ii. The name, address, and telephone number of the owner of the vehicle from
which the catalytic converter was removed;
iii. The signature of the vehicle owner authorizing removal of the catalytic converter;
and
iv. The name, address, and telephone number of the current owner of the catalytic
converter.
b. In the event the catalytic converter is in the possession of the current owner of the
vehicle from which it was removed, valid proof of ownership means:
i. Ownership documentation for the vehicle;
ii. A valid receipt for a replacement catalytic converter; and
iii. Proof of installation of the replacement catalytic converter.
9.36.030 – Violations and Enforcement
a. Each violation of this Chapter constitutes a separate violation and is subject to all remedies and
enforcement measures authorized by this Code. Any person who violates any provision of this
Chapter shall be guilty of a misdemeanor punishable by a fine not to exceed $1,000,
imprisonment for a term not exceeding six months, or both a fine and imprisonment.
b. The remedies provided herein are not to be construed as exclusive remedies. The City is
authorized to pursue any proceedings or remedies provided by law.”
Section 3. If any section, subsection, subdivision, paragraph, sentence, clause or phrase in
this Ordinance or any part thereof is for any reason held to be unconstitutional, invalid, or ineffective by
any court of competent jurisdiction, such decision shall not affect the validity or effectiveness of the
remaining portions of this Ordinance or any part thereof. The City Council hereby declares that it would
have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase thereof
irrespective of the fact that any one or more sections, subsections, subdivisions, paragraphs, sentences,
clauses or phrases be declared unconstitutional, invalid, or ineffective.
Section 4. The City Clerk shall certify to the adoption of this Ordinance and shall cause the
same to be published in the manner prescribed by law.

RECOMMENDATION:
Staff recommends that the City Council accept and allocate grant revenue in the amount of
$6,498,130 from the State of California Budget Act of 2021, SB 129, in Building Forward Library
Infrastructure Grant Program Funding to design and construct a replacement facility for the
Archibald Library and adopt Resolution 2022-159 designating the City Manager as the authorized
representative to submit the grant application and enter into agreements on behalf of the City.
BACKGROUND:
The Legislature and Governor of the State of California have provided funds for the Building
Forward Library Infrastructure Grant program through the passing of California Senate Bill 129.
This is an amendment to the Budget Act of 2021 which authorized $439M in funding to support
library maintenance and capital projects through sustainable and equity-focused matching grants
on a one-time basis.
On March 19, 2022, the Library submitted a grant request for first round funding and on October
18, 2022, received an “intent to fund” award letter to fund the Archibald Library Replacement
Project in the amount of $6,498,126. This grant requires a 50% match by the City in the amount
of $3,249,063. The total estimated project cost is $13M, meaning that in addition to the City match,
the City will need to fund the remaining $3,252,811; therefore, the total City funding amount is
$6,501,874. All grant funds must be expended by March 31, 2026.
The California State Library has been delegated the responsibility for the administration of the
grant program, establishing necessary procedures for acceptance, execution, and management
of the grant program, including the authorizing resolution accompanying this staff report. Staff
recommends the City Manager be designated the authorized representative for executing the
funding agreements so he may appoint representatives to submit required documents, funding
information and reports.

The City of Rancho Cucamonga will implement the Archibald Library Replacement Project, will
submit any required documents, requests and reports, certify the project complies with laws and
regulations, legal requirements for building codes, health and safety codes, the California Labor
Code, and disabled access laws.
ANALYSIS:
This project replaces the Archibald Library through the conversion of another City-owned
property. The existing Archibald Library has significant infrastructure challenges, and consultants
have determined that even with site improvements, the property is ill-suited to meet the current
and future needs of the community. Additional investments in the current facility would be fiscally
irresponsible given the site’s limited options.
In accordance with the City of Rancho Cucamonga’s recently adopted “General Plan RC 2040,”
this project will bring Library services to an underserved area of the City that has not benefited
from a new community facility in more than 15 years.
The conversion project will expand library services and feature the following:
• Large-scale indoor and outdoor community event spaces
• Dedicated collection space for the new Library of Things collection
• Expanded public study/meeting spaces
• Expanded story theater and programming spaces supporting early literacy and providing
interactive “play” experiences like those at the Biane Library
• Safety, inclusivity, and accessibility improvements that meet current ADA requirements
• Sustainable and energy efficient systems (lighting, solar, HVAC, etc.)
• Highly walkable location away from major intersections and heavy traffic areas
• Reuse of existing structures minimizing demolition and construction waste
The project’s long-term impact includes maximizing library services and creating a modern and
versatile facility. By using existing buildings and improved materials and technology, this project’s
sustainably accommodates changing use patterns and service expectations including expanded
and enhanced programs and services; increased collection space; higher energy and water
efficiency; use of outdoor spaces; safer and improved accessibility, and more. The project
provides residents with a refreshed and high-functioning space ideally situated to serve the
community well into the future.
A copy of the contract is on file with the City Clerk’s Office.
FISCAL IMPACT:
The $6,498,130 grant funding provides funds from the California State Library and will be added
as new revenue to the Fiscal Year 2022-23 budget. Funds will cover allowable building
replacement and infrastructure improvements and related costs identified in the Archibald Library
Replacement Project budget. The grant funding from the California State Library grant will be
appropriated to:
Library Capital Fund/Grant Income-State - 1329000-4760/0-3789 for $6,498,130
The required matching funds of $3,249,063 will be sourced by the Library Fund and the remaining
funds of $3,252,811 will be sourced from multiple sources: the Library Fund, Community Benefit
Project Fund, and City Capital Reserve Fund. Because the total capital project budget will be

transferred to the Library Capital Fund. As a result of these actions, the following appropriations
will be necessary:

WHEREAS, the Legislature and Governor of the State of California have provided funds
for the program shown above; and
WHEREAS, the California State Library has been delegated the responsibility for the
administration of this grant program, establishing necessary procedures; and
WHEREAS, said procedures established by the California State Library require a
resolution certifying the approval by the potential grantee’s governing board either before
submission of said application(s) to the State or prior to execution of the grant agreement; and
WHEREAS, the Applicant/Grantee, if selected, will enter into an agreement with the State
of California to carry out the project
WHEREAS, the City of Rancho Cucamonga proposes to implement the Archibald Library

Director, or designee was hereby authorized and directed to prepare and file an application for
funding with the California State Library, and take such other actions necessary or appropriate
to obtain grant funding.
SECTION 3: The City of Rancho Cucamonga, Wess Garcia, Acting Library
Director, or designee is hereby authorized and directed to execute the funding agreement with
the California State Library and any amendments thereto.

The California State Library has been delegated the responsibility for the administration of the
grant program, establishing necessary procedures for acceptance, execution, and management
of the grant program, including the authorizing resolution accompanying this staff report. Staff
recommend the City Manager be designated the authorized representative for executing the
funding agreements so he may appoint representatives to submit required documents, funding

The City of Rancho Cucamonga will implement the Biane Library Infrastructure Project, will submit
any required documents, requests and reports, certify the project complies with laws and
regulations, legal requirements for building codes, health and safety codes, the California Labor
Code, and disabled access laws.
ANALYSIS:
The Paul A. Biane Library Infrastructure Project aims to make modifications to a facility nearing
20 years of age. When constructed, much of the building’s design and infrastructure were state
of the art, however through normal wear and tear and sustained levels of high usage, several
critical life systems and significant building features have reached irreparable, end-of-life
conditions requiring refurbishment, upgrade, or replacement.
The project will correct and repair these issues and prepare the building to meet future use in a
safer, more accessible, and sustainable way. Key project elements will address the following:
• Replace HVAC boilers, chillers, and air handlers
• Repair numerous HVAC ceiling leaks
• Replace aging flooring that presents safety and tripping hazards
• Address ADA compliance issues
• Replace aging lighting fixtures for accessibility and sustainability
• Upgrade security camera system
The long-term impact of the Paul A. Biane Library infrastructure project is an updating and
readying of the building for the next 20 years of service. By incorporating improvements in
materials, building techniques, and technology; and implementing higher safety and accessibility
standards; this project will provide the residents of Rancho Cucamonga with a refreshed and
viable space that is flexible and adaptable to changing use patterns, and can accommodate the
next generation of library services and programs.
A copy of the contract is on file with the City Clerk’s Office.
FISCAL IMPACT:
The $594,330 grant funding provides funds from the California State Library and will be added as
new revenue to the Fiscal Year 2022-23 budget. Funds will cover allowable infrastructure
improvements and related costs identified in the Biane Library Infrastructure Project budget. The
grant funding from the California State Library grant will be appropriated to:
Library Capital Fund/Grant Income-State – 1329000-4760/0-3790 for $594,330
The required matching funds of $297,165 and the remaining funds of $308,505 will be sourced
from the City Capital Reserve Fund. Because the total capital project budget will be appropriated
from the Library Capital Fund, these matching funds and remaining funds will be transferred to
the Library Capital Fund. As a result of these actions, the following appropriations will be
necessary:
Library Capital Fund/Capital Projects – 1329601-5650/2115329-0 for $1,200,000
Capital Reserve/Transfer-Out – 1025001-9329 for $605,670
Library Capital Fund/Transfer-In – 1329000-8025 for $605,670

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RANCHO CUCAMONGA, CALIFORNIA, AUTHORIZING THE
GRANT APPLICATION, ACCEPTANCE, AND EXECUTION OF
THE GRANT FUNDS FROM THE STATE OF CALIFORNIA
BUDGET ACT OF 2021 (SB 129)
WHEREAS, the Legislature and Governor of the State of California have provided funds
for the program shown above; and
WHEREAS, the California State Library has been delegated the responsibility for the
administration of this grant program, establishing necessary procedures; and
WHEREAS, said procedures established by the California State Library require a
resolution certifying the approval by the potential grantee’s governing board either before
submission of said application(s) to the State or prior to execution of the grant agreement; and
WHEREAS, the Applicant/Grantee, if selected, will enter into an agreement with the State
of California to carry out the project
WHEREAS, the City of Rancho Cucamonga proposes to implement the Biane Library
Infrastructure Project; and
WHEREAS, the City of Rancho Cucamonga has the legal authority and is authorized to
enter into a funding agreement with the State of California; and
WHEREAS, the City of Rancho Cucamonga has applied and been approved for grant
funding from the California State Library for the Biane Library Infrastructure Project; and
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA,
HEREBY RESOLVES:
SECTION 1: That the above recitals are true and correct.
SECTION 2: That pursuant and subject to all of the terms and provisions of the
California Budget Act of 2021, the City of Rancho Cucamonga, Wess Garcia, Acting Library
Director, or designee was hereby authorized and directed to prepare and file an application for
funding with the California State Library, and take such other actions necessary or appropriate
to obtain grant funding.
SECTION 3: The City of Rancho Cucamonga, Wess Garcia, Acting Library
Director, or designee is hereby authorized and directed to execute the funding agreement with
the California State Library and any amendments thereto.
SECTION 4: The City of Rancho Cucamonga, Wess Garcia, Acting Library
Director, or designee is hereby authorized and directed to submit any required documents,
funding requests, and reports required to obtain grant funding.

SECTION 5: The City of Rancho Cucamonga certifies that the project will comply
with any laws and regulations including, but not limited to, the California Environmental Quality

permits will have been obtained.
