HomeMy WebLinkAbout88-401 - Resolutions RESOLUTION NO. 88-401 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAI~I~A, CALII~)RNIA, ORDERII~ ~I~E WORK IN ~~ION WI~ A~TION NO. 45 ~ S~EET LIGHT~ ~~N~ DIS~I~ NO. 1 A~ AC~~ ~E FI~ ~I~ER*S RE~RT ~R ~ NO. 13644, PM 9504, ~P 87-04 A~ DR 86-32 (~T ~ 12176) ~IEREAS, the City Council of the City of Rancho Cucamonga did on the 18th day of May, 1988, adopt its Resolution of Intention No. 88-316 to order the th~re~n described work ~n connection w~th Annexation No. 45 to Street L~ht~n8 ~ntenance D~st=~ct No. 1, which R~solut~on o~ Intention No. 88-316 was d~ and 1ega11~ published ~n t~ time. fo~ and manner as r~qu~red by law, shown ~ the A~dav~t of ~bl~cat~on o~ sa~d Resolution o~ Intention on f~le in the office of the City Clerk; and ~/EREAS, after the adoption thereof, notice of the passage of said Resolution of Intention, headed "Notice of Improvement", was duly and legally posted in the time, form, manner, location, and number as required by law, as appears from the Affidavit of Posting said notices, on file in the office of the City Clerk; and 91/EREAS, after the adoption thereof, notices of the adoption of the Resolution of Intention were duly mailed to all persons owning real property proposed to be assessed for the improvements described in said Resolution of Intention No. 88-316, according to the names and addresses of such owners as the same appears on the last mailin$ or as know~ to the City Clerk of the City of Rancho Cucamonga, which said copies were duly mailed in the time, form. and manner as required by law, as appears from the Affidavit of Mailing on file in the office of the City Clerk; and ~RERFAS, said City Council having duly received considered evidence. or~l and documentary, concerning the jurisdiction facts in this proceeding and concerning the necessity for the contemplated work and the benefits to be derived therefrom and said City Councll having now acquired ~urlsdiction to order the proposed work. SECTION 1: It is hereby resolved by the City Council of the City of Rancho Cucamonsa that the public interest and convenience requires the annexation to the District and the ordering of the work. and said City Council hereby orders that the work, aa set forth and described in said Resolution of Intention No. 88-316, be done and made; and SECTION 2: The Report filed by the Engineer is hereby finally approved; and Resolution No. 88-401 Page 2 SECTION 3 = The assessments and method of assessment in the Engineer's Report are hereby approved. SECTION 4: The assessments shall not begin until after 60 percent of said tracts have been occupied. PASSED, APPROVED, and ADOPTED this 15th day of June, 1988. Work to be provided for with the asses~ents established by the district ~e furnishing of se~ces and materials for ~he ord~na~ and us~l maintenance, o~ra~n8 mn4 se~c~ns of street 1~8~t ~ov~ents on major streets (ar~er~ an4 certain collector s~reets) as s~own on the Li~h~in8 District A~las ~p which is on f~e with the City Engineer. ~ov~ent maintenance is considered of sener~ benefit to all areas in the District and cos= shall be assessed on a ~r unit basis. Reference is here~ made to the subject tract map or develo~ent plan and the asses~ent dla~m for the ~act 'loca~ion of the street lilhtin~ areas. ~e plans and s~ciftcatton~ for street li~htin~ ~ov~en~ on ~he individ~l develo~ent is here~ made a ~rt of this ~e~rt to the s~e ~tent as if said plans and s~cifics vere attached hereto. Detailed maintenance activities on ~he street limb:in8 district include: ~he re,ir, r~o~al or replac~ent of all or any ~rt of any ~provment, providin~ for the illmination of the subject area. SE~ION 4. Est~a~ed ~sts No costs will be incurred for stree~ liihttni ~~en~ construction. All ~pr~ents will be constructed ~ develo~rs. Based on available data, it ia es~ated that maintenance costs for asses~ent p~poses will be as indicated bel~. ~ese costs are est~ated only, actual asses~ents will be based on act~l cost data. Resolution No. 88-401 Page 4 Street Lighting Maintenance District No. I has been demarcated into two zones. Zone I is comprised of street light improvements on major streets for residential improvements (single finally, multi-family, condominiums and apartments) throughout the City. Each dwelling unit in this zone will be assessed as one assessment unit for the operation of the District. Zone 2 is comprised of all industrial, commercial and institutional projects throughout the City. It has been dete~ined that one acre of land in industrial, commercial and institutional areas derives the same benefit as two assessment units in Zone 1. The estimated total cost for Lighting Haintenance District No. 1 is shown below: 1. S.C.E. Assessment Diagra~ Copies of the proposed Assessment Diagrams are attached to this report and labeled wStreet Lighting Haintenanca District No. Iw, Annexation No. 45. These diagrams are hereby incorporated within the text of this report. SECTION 6. Assessment Improvements for the District are found to be of general benefit to units within the District and that assessment shall be equal for each unit. When units are based on acreage, assessment will be 2 units per net acre, SECTION 7. Order of Events 1. City Council adopts Resolution of Preliminary Approval of City Engineer's Report. 2. City Council adopts Resolution of Intention to annex a District and sets public hearing date. 3. City Council conducts public hearing, considers all testimony and determines to fora a District or abandon the proceedings. 4. Every year in Hay, the City Engineer files a report with the City Council. 5. Every year in June, the City Council conducts a public hearing and approves, or modifies and approves the individual assessments.
