HomeMy WebLinkAbout88-366 - Resolutions RESOLUTION NO. 88-366 A RESOLUTION OF THE CITY ~OUNCIL OF THE CITY OF RAN(~O CUCAM~NGA, CALIFORNIA, APPROVING DEVELOPMENT REVIEW NO. 87-34, THE DEVELOPMENT OF A 22,400 SQUARE FOOT MEDICAL OFFICE BUILDING ON 1.7 ACRES OF LAND IN ~HE LOW-MEDIUM RESIDENTIAL DISTRI6T (GENERAL PLAN AMENDMENT PENDING), LOCATED ON THE WEST SIDE OF ARCRIBALD AVENUE, SOU~H OF BASE LINE ROAD - APN: 208-031-17, 54, 55, 56 and 57. A. Recitals. (i) West End Investments has f/led an application for the approval of Development Review No. 87-34 as described in the title of-this Resolution. Hereinafter in this Resolution, the subject Development Review request is referred to as "the application". (ii) On the 23rd of March, 1988, the Planning Oouission of the City of Rancho Cucamonga conducted a meeting on the application and the related General Plan and Development District Amendments to change the land uae designation from Low-Medium Residential to Office-Professional. (iii) Based on evidence presented during the meeting of March 23, 1988 the Planning Commission recommended denial of the General Plan and Development District Amendments to the City Council and, in so doing, denied the application due to inconsistencies with the General Plan and Development Code. (iv) On the 18th of May, 1988, the City Council of the City of Rancho Cucamonga, on appeal by the applicant, conducted a meeting on the application and concluded said meeting on that date. (v) All legal prerequisites to the adoption of this Resolution have occurred. B. Resolution. NOW, ~HEREFORE, it is hereby found, determined and resolved by the City Council of the City of Rancho Cucamonga as follows: 1. This Council hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Council during the above-referenced meeting on May 18, 1988, including written and oral staff reports, this Council hereby specifically finds as follows: Resolution No. 88-366 Page 2 (a) The application applies to property located on the west side of Archibald Avenue, south of Base Line Road with a street frontage of 260 feet and lot depth of 283 feet and is presently 9aproved with single family residences; and (b) The properties to the north and east of the site are designated for commercial uses and are developed with shopping centers. The properties to the south and east are designated for residential uses and are developed with single family homes$ and (c) The City Council recommended approval of the General Plan and Development District Amendments to change the land use designation from Low-Nedium Residential to Offlce-Professional. With approval of the General Plan and Development District Amendments. the project will be consistent with the General Plan and meet the intent and requiraments of the Development Code. 3. Based upon the substantial evidence presented to this Council during the above-referenced meeting and upon the specific findings of facts set forth in paragraph I and 2 above, this Council hereby finds and concludes as follows: (a) That the proposed project is consistent with the objectives of the General Plan; and (b) That the proposed uae is {n accord with the obi ective of the Deve/opment Code and the purposes of the district, in which the site is locatedl and (c) That the proposed use is in compliance .with each of the applicable provisions of the Development CO de ~ and (d) That the proposed use, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity. 4. This Council hereby finds mud certifies that the project has been reviewed and considered in compliance with the California Enviror~ental Quality Act of 1970 and, further, this Council hereby issues a Negative Declaration. 5. Based upon the findings and conclusions set forth in paragraph 1, 2 and 3 above, this Council hereby approves the application subject to each and every condition set forth below and in the attached Standard Conditions attached hereto and incorporated herein by this reference. Resolution No. 88-366 Page 3 Planning Division 1. Approval of Development Revie~ 87-34 is contingent upon approval of General Plan Amendment 87-O4H and Development District Amendment 87-06. 2. ~ne rust accent color shall ~e changed to integrate with the existing commercial center to the north. ~ne color shall be reviewed and approved by the Design Review Committee prior to the issuance of building permits. 3. ~ne removal of the 64 mature trees shall require replacement with the largest nursery grown trees available, as determined by the City Planner. The applicant shall su~mit a plan and a list of the tree species, height, and trunk circumference as measured twenty-four inches from ground level, for the 64 existing trees. The applicant shall submit documentation of replacement, including a plan, to the City Planner prior to the removal of the trees. 4. A decorative block wall shall be required along the south boundary. The wall shall terminate far enough back from Archibald Avenue to avoid any disruption to the roof system of the Carob Tree at the southeast corner. The design of the wall shall be shown on the final building plans and shall be reviewed and approved by the Gity Planner prior to the issuance of grading permits. 5. The driveway at the southwest corner of the site shall be turf block to provide emergency access between this site and the site to the west. The turf block shall be incorporated into the final landscape plan which shall be reviewed and approved by the City Planner prior to the issuance of building permits. Engineering Division 1. A private drainage easement in favor of the property to the west shall be provided alonE the southern property line. 2. For the Archibald Avenue driveway, sight lines shall be plotted on the landscape plans to assure adequate safe. unobstructed stopping sight distance as approved by the City Engineer. 3. "No Stopping Any T~me" zone w~ll be required on Archibald Avenue. 4. Drainage from the site shall be outletted onto Archibald Avenue in such a manner to not cause damage to the property to the south as approved by the City Engineer. The outlet facility could consist of a parkway drain or pipe and catch basin system outletting south of the existing driveway adjacent to the south property line and the rolling of said driveway if permission can be obtained from the property owners. Resolution No. 88-366 Page 4 5. An emergency access easement in favor of the property to the vest shall be provided to ensure emergency ingress and egress to Archibald Avenue.
