HomeMy WebLinkAbout89-290 - Resolutions RESOLUTION NO. 89-290 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, ORDERING THE WORK IN CONNECTION WITH FORMATION OF LANDSCAPE MAINTENANCE DISTRICT NO. 7 AND ACCEPTING THE FINAL ENGINEER'S REPORT WHEREAS, the City Council of the City of Rancho Cucamonga, California did on the 17th day of May, 1989, adopt its Resolution of Intention No. 89-233 to order the therein described work in connection with the Formation of Landscape Maintenance District No. 7, which Resolution of Intention No. 89-233 was duly and legally published in the time, form and manner as required by law, shown by the Affidavit of Publication of said Resolution of Intention on file in the office of the City Clerk; and WHEREAS, after the adoption thereof, notice of the passage of said Resolution of Intention, headed "Notice of Hearing", was duly and legally posted in the time, form, manner, location, and number as required by law, as appears from the Affidavit of Posting said notices, on file in the office of the City Clerk; and WHEREAS, after the adoption thereof, notices of the adoption of the Resolution of Intention were duly mailed to all persons owning real property proposed to be assessed for the improvements described in said Resolution of Intention No. 89-233, according to the names and addresses of such owners as the same appears on the last mailing or as known to the City Clerk of the City of Rancho Cucamonga, which said copies were duly mailed in the time, form, and manner as required by law, as appears from the Affidavit of Mailing on file in the office of the City Clerk; and WHEREAS, said City Council having duly received considered evidence, oral and documentary, concerning the jurisdiction facts in this proceeding and concerning the necessity for the contemplated work and the benefits to be derived therefrom and said City Council having now acquired jurisdiction to order the proposed work. NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does hereby resolve as follows: SECTION 1: That the interest and convenience requires the Formation of said District and the ordering of the work, and said City Council hereby orders that the work, as set forth and described in said Resolution of Intention No. 89-233, be done and made; and SECTION 2: Be it further resolved that the report filed by the Engineer is hereby finally approved; and SECTION 3: Be it further resolved that the assessments and method of assessment in the Engineer's Report are hereby approved. SECTION 4: Be it finally resolved that said assessments shall not begin until after 60 percent of said tracts have been occupied. Authelet, Cit~y Cl~k Resolution No. 89-290 Page 3 CITY OF RANCHO CUCAMONGA ENGINEER'S REPORT FOR LANDSCAPE MAINTENANCE DISTRICT NO. 7 TENTATIVE TRACT NOS. 13566-1 & -3 SECTION 1. AUTHORITY FOR REPORT This report is prepared in compliance with the requirement of Article 4, Chapter 1, Division 5 of the Street and Highways Code, State of California (Landscaping and Lighting Act of 1972). SECTION 2. GENERAL DESCRIPTION This report deals with the establishment of a Landscape Maintenance District for the North Etiwanda area. The District will originally comprise of the boundaries of the Tentative Tract Nos. 13566-1 and -3. Areas to be included in the work program are the trees and planting within certain rights-of-way of streets as determined by the City; street trees within street rights-of-way and within dedicated tree maintenance easements as required by specific plans or by the City Council. The public parks, the greenway and passes systems, community gateways, regional and community trail systems including lighting, signing, striping and all other improvements such as play equipment, fences, walls, etc. within those systems; such similar areas as required by the Specific Plan or by the City Council or as dedicated by various subdivisions. At present, the original District will consist of vacant lots. The actual work programs for these tentative tracts will commence at such time as the tracts are recorded and needed improvements are completed and accepted by the City. The work program generally excludes the parkways landscaping (except the street trees) adjoining the fronts and sides of single family residences, adjoining multi-family residential units and adjoining commercial and institutional development which will. b9 maintained by those developments. The District will eventually include the majority of the areas included within the North Etiwanda Specific Plan areas and other areas generally comprised of properties from Day Creek Channel to the East City boundary and from Highland Avenue to North City boundary. SECTION 3. SCOPE OF WORK The areas listed above will become part of the active work program at such time as the specific areas are dedicated to the and accepted by City. The normal process will be the dedication of the areas to the City, the areas improved by the developer with landscaping, irrigation and other required improvements, then after a period of maintenance by the developer as determined by the City Engineer, the acceptance of maintenance by the Maintenance District. There will be a lag time from the original dedication until the District actually begins the maintenance of the areas. Resolution No. 89-290 Page 4 On certain work program areas where abutting properties will never be developed, the District may install the needed improvements as required by the City Council and maintain the same. The plans and specifications for all improvements within the work program areas to be installed by the developer will be completed by the developer at their cost for the individual areas to be maintained within the subdivision and will be approved by the Community Development Department. Annual Engineer's Reports will be prepared and approved by the City Council defining the specific work program for each year and its estimated cost. As development proceeds within the District, the areas to be maintained by the District will increase and so will the cost; however the number of units will also increase. The estimated maintenance _cost and estimated assessment rate per unit for the original District and the completed District are tabulated herein after. The assessment rate is expected to vary year to year as more areas are annexed to the District until such time as all the properties within the ultimate district boundary are annexed, after which the assessment rate should remain constant excluding cost of living increase. Maintenance Activities Detail maintenance activities on the areas to be maintained by the District consist of providing for the life, growth, health, and beauty of the landscaping including: cultivation, irrigation, trimming spraying, r fertilizing or treating for disease or injury; removal of trimmings, rubbish, debris and other solid waste; maintenance, repair, energy costs, and replacement as necessary of all required lighting within the park, greenway, passes and trail system; removal of graffiti from walls immediately adjacent to the cultivated areas; repair, removal or replacement of all or any part of any improvement. SECTION 4. ESTIMATED COSTS No costs will be incurred by the District for original improvement construction except for certain nominal areas as mentioned in Section 3. The cost of any new construction will have negligible effect on the total assessment of the District due to its scope in comparison with the overall District work program areas. Based on data from other cities and from the City of Rancho Cucamonga for Landscape Maintenance Districts and from the review of proposed work program areas, it is estimated that based on current dollars, the maintenance cost for assessment purposes, estimated areas to be maintained and the estimated number of assessment units will be as follows: A. Original District. As no dedication will be made and as no improvement will be done during the tentative stage of the maps, no cost will be incurred for the original District. Resolution No. 89-290 Page 5 B. Phase One Construction (At recordation of Tracts 13566-1 and -3). The estimated costs for the original District comprising of Tract Nos. 13566-1 and -3 plus 24th Street from Wardman Bullock Road to Cherry Avenue/City boundary are shown below: Equestrian Trail (including 50,034 SF @ $0.05 = $ 2,501.70 fences, mow strips and portals Parkways (including slopes & monument walls) 218,448 SF @ $0.30 : $65,534.40 Trees 572 EA @ $5.00 : ~. 2~860.00 ESTIMATED TOTAL MAINTENANCE COST ~.70~896.10 C.Complete District. The estimated costs (as current dollars) for the District upon completion of all areas within North Etiwanda are as shown below: Parkways, trails, greenways, etc. plus neighborhood parks 8,100,028 SF @ $0.35/SF : $2,835,010 Community parks @ 60% of 1,481,040 SF 888,624 SF @ $0.35/SF : $. 311,019 $3,146,029 SECTION 5. ASSESSMENT DIAGRAM A copy of the proposed boundary map and legal description of the Assessment District are attached to this report and labeled "Landscape Maintenance District No. 7 "Exhibit A" and "Exhibit B." These diagrams are hereby incorp.orated into the text of this report. Precise lot dimensions are included in the referenced tract maps and Assessor's records. The District will originally comprise Tentative Tract Nos. 13566-1, and -3. Once the tracts are recorded, it will become a part of Landscape Maintenance District No. 7. The assessment rate after recordation of the tract will be as shown in Section 6, phase one construction. Additional tracts will be annexed into the District after its formation. The final configuration of the District may include much of the North Etiwanda Specific Plan and properties comprising the area from Day Creek east to the City boundary and Highland Avenue north to the National Forest limits. A copy of the proposed final District boundary is attached to this report as "Exhibit C." Resolution No. 89-290 Page 6 SECTION 6. ASSESSMENTS A. ORIGINAL DISTRICT Total Annual Cost : $0 Assessment Units = 0 Assessment rate = 0 B.
