A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO
CUCAHONGA, CALIFORNIA, ORDERING THE PREPARATION OF A
REAPPORTIONHENT REPORT AND ANENDED ASSESSMENT AND DIAGRJiN
IN ABSESSNENT DISTRICT AND ESTABLISHING REAPPORTIONMENT
FEES FOR PARCEL MAP 9530 WITHIN THE SIXTH STREET ININSTRIAL
PARK ASSESSMENT DISTHICT
WHEREAS, the City Counci 1 of the City of Rancho Cucamonga,
California, has previously confirmed assessments in a special assessment
district, pursuant Co the terms and provisions of the '~unicipal Improvement
Act of 1918", being Division 12 of the Streets and Highways Code of the State
of California, and bonds were issued to represent the costs for unpaid
assessments purstmnC to the terms and provisions of the '~lmprovement Bond Act
of 1915", being Division 10 of said Code, said special assessment district
knoeu and designated as Assessment District 82-1R. (hereinafter referred co as
the "Assessment District") and
VHEREAB, subsequent thereto, certain lots and/or parcels of land upon
which there are unpaid assessments have been apportioned or divided; and
~HEREAS, aC this time this leEislative body is desirous Co order the
reapportionment of said unpaid assessments pursuant to the provisions of Part
I0 of the '~ImprovsmenC Bond Act of 1915.
NO~, THEREFOkE, IT IS HEREBY RESOLVED AS FOLLOWS:
SECTION 1: That the above recitals are all true and correct.
SECTION 2: That the Superintendent of Streets is hereby o~dered Co
file with the City Clerk a report entitled 'Reapportionment Report" and an
amended assessment and diagram of the original parcel or parcels of land
affected by such division or transfer of ownership, segregating and
apportioning the unpaid installments of the original assessment in accordance
with the benefits to the several parts of the oriSinal lot or parcel, plus
costs and fees of making the apportionment.
SECTION 3: That this legislative body hereby determines and
establishes a fee in the amount of $50.00 for each separate part of parcel of
land into which the original lo~ or parcel has been divided, fee to cover the
costs of the reapportionment.
SECTION 4: ThaC the Superintendent of Streets shall, prior to making
a division and making the amended assessment, notify the ocher of the original
parcel or parcels assessed, as the me of the saner or owners appear on the
last equalized assessment roll for taxes, or as said o~ner or o~ners are known
to the Superintendent of Streets, of the order of this legislative body fixinS
the costs and fees of the apportionment, and directing Chat the payment of such
costs and fees be made co the Superintendent of Streets within fifteen (15)
days of such notification. In the event chat the reapportionment fee is no~
paid within fifteen (15) days of such notification, the Superintendent of
Streets shall proceed to prepare the amended assessment and shall show
separately thereon, but as a part of the total, the reapportionment fee
charSsable to each divided parcel.
