HomeMy WebLinkAbout328-A - Ordinances AN ORDINANCE OF THE CITY OOUNCIL OF THE CITY OF RAN(~O ~, CALIFORNIA, AM~qDING ~ 3.08 OF THE RANC~O ~ ~ OOOE BY ADD//qG S~CTIC~ 3.08.240 P~AT//qGTOP~0Ct~TOFR~CY~~ WHEREAS, the volume of material disposed of at the oounty landfill ba~ been increasing annually; and WHEREAS, sanitary landfill space is at a uremium and it is bec~ increasingly difficult to site new landfills; and ~, much of the material that enters the waste stream can be recycled, reused or incorporated in the manufacture of new products; and WHEREAS, city participation in and ~ion of recycling programs can significantly reduce the volume of material entering the waste stream thereby extending county landfill life e~ and reducing expenses; and WHerEAS, for recycling programs to be effective, markets must be developed for products that incorporate postconsumer materials in their manufacture, are reusable, or are designed to be recycled; and WHEREAS, California State Law requires that local agencies buy recycled products if fitness, quality and price are equal to nonrecycled products and allows local agencies to adopt purchasing preferences for recycled products. NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does hereby ordain as follows: That Ordinance No. 328 is hereby amended by adding Section 3.08.240 Recycled Product Procurement Policy to read as foll~s: S~CTION 1: Within twelve months ~sequent to th~ effective date of this section, all city de~axtments, offices, and commissions must conduct a review of existing product and service specifications to determine wb~ther existing specifications either require the use of products manufactured frc~ virgin materials or exclude the use of recycled products, reusable products, or products designed to be recycled. S~ATION 2: In the event that such specifications do exclude the use of recycled products or rec~re the use of virgin mterials, then such exclusions or r~quirements ~ be eliminated unless the pertinent department or entity can demonstrate to the satisfaction of the city manager that these recycled products would not achieve a necessary performance standard. SECTION 3: Within the same 12 month period, all city departments and agencies ~ reccm~_nd changes to the city manager to ensure that performanoe standards for particular products can be met and that specifications are not overly stringent, and to rec~L..end changes to ensure that specifications will incorporate a requirement for the use of recycled mterials, reusable Ordinance No. 328A Page 2 products, and products designed to be recycled to the maximum extent practic- able, subject to an alternative showing that either the performance of the product will be jeopardized or that the product will negatively impact health, safety or operational efficiency. S~'~ION 4: Outside contractors bidding to provide products or services to the city including printing services, ~ust demonstrate that they will comply with the specifications described in paragraph 3 to the greatest extent feasible. S~CITON 5: City staff will work to enocurage the copier industry to develop high-speed copiers that will accept recycled paper. In addition, recycled paper shall be purdmased and used in all copy machines that will accept it. S~CTION 6: When recycled p~ducts are used, reasonable efforts shall be undertaken to label the products to indicate that they contain recycled materials. City de~ and agencies shall use for their mast-head stationery and envelopes recycled paper that includes postconsumer recycled material. Other recycled products used by the City shall also indicate that they contain recycled material to the extent practicable. S~TON 7: A five percent (5%) price preference may be given to recycled products, reusable products offered as alternatives to disposable products, and products designed to be recycled where they are offered as alternatives to non-recyclable products. S~E/ON 8: The city will cooperate to the greatest extent feasible with neighboring city and county gove~a~ents in an effort to develop a c~,~re- hensive, consistent and effective procurement effort intended to stimulate the market for recycled products, reusable products, and products designed to be recycled. S~iTION 9: All related city de~L~uments and agencies shall work cooperatively to further the purposes of the ordinance. ~ne city economic development process shall incorporate the goal of stimulatin~ the market for recycled material. S~CITC~ 10: The City Clerk shall certify to the passage of this SECIT~ 11: The Mayor shall sign this ~ and the City Clerk shall cause the same to be published within fifteen (15) days after its passage at least c~oe in the Inland Valley Daily Bulletin, a newspaper of general circulation published in the City of Ontario, California, and circulated in the City of Rancho cucamonga, California.
