The City Council of the City of Rancho Cucamonsa, California, does
ordain as follows:
SKCTIOIq I: The City Council finds and determines as follows:
A. Govermnent Code Sections 65864 through 6589~.5
authorize the City to enter into binding Development
A&ree~ents with persons having legal or equitable
interest in real property for the development of such
property.
B. Three copies of the proposed "First Supplemental
Agreement to the Terra Vast· Perk Development
Agreement Ho. 1' between the City on the one hand and
Levis Construction Company, Inc., a California
: corporation, Western Properties, · General
Partnership, Lewis Homes of California, · General
Partnership, ·nd Levis Development Company, · General
Partnership, hereinafter collectively #levis# on the
other hand are' on file in the office of the City
Clerk, and the same are public records of the City.
C. ~ne proposed "First Supplemental A&reement to the
Terra Vista Park De~elopment Asr··sent No. 1"
per~iu· to real property situated in the City known
as the Terra Vista Planned Community. The planned
community includes ·n area of land be$innin~ at the
intersection of Haven Avenue and Foothill Boulevard;
thence traversing north along the cent·ri·ne of Haven
Avenue to the south right of way of the Pacific
Electric Railroad; thence east to the easterly
boundary of the Deer Creek Flood Control Channel;
thence southwesterly elou8 said boundary to the
cent·ri·ne of Base Line Road; thence east to the
cent·ri·ne of Rochester Avenue; thence south to the
centerline of Foothill Boulevard; thence vest to the
beginning point being the intersection of Haven
Avenue and Foothill Boulevard.
D. The City Council has held a public hearing on the
proposed "First Supplemental Asreement to the Terra
Vista Park Development Asr··merit No. 1' and notice of
that public hearing has been given for the time and in
the manner prescribed by Cover·merit Code Section
65867.
E. The provisions of the proposed **First Supplemental
Asr··sent to the Terra Vista Park Development
Agreement Ho. In are consistent with the City's
General Plan and the Comnmity Plan of the Terra Vista
Planned Ccumuni ry.
sECTI(~!! 2: The proposed '*First Supplemental Agreeaent to the Terra
Vista Park Development Agreement 1~o. Iu be~veen the City end Levis, referred to
in Section 1 above, is hereby approved. On the effective date of this
Ordinance the Hayor shall sikh is many copies of said Development Agreement a8
are necessary for the parties; and City Clerk shall attest to the same and
shall deliver one fully signed copy to Levis.

SECTIO~ 3: The ltayor shall si~n this Ordinance and the City Clerk
shall cause the same to be published within fifteen (15) days after its passage
at least once in The Daily Revort, a newspaper of general circulation published
in ~he Gi~y of ~srlo, California, and circulated in ~he City of hncho
Cucauonga, California.
