HomeMy WebLinkAbout295 - Ordinances NO ACTION TAKEN ORDINANCE NO. 295 AN ORDINANCE OF THE- CITY COUNCIL OF TRE CITY OF RANCRO CUCAMONGA, CALIFORNIA, APPROVING A DEVELOPMENT AGREEMRNT BETdE~lq THE CITY OF RANCHO CUCAMONGA A~D C/A, LTD., AND THE TO~ER PARTNERSHIP, IN RELATIO~ TO THE PROPERTY G~ERALLY LOCATED AT THE NORTK~EST CORNER OF FOOTHILL BOULEVARD AND ~AV~ AV ~lq U E The City Council of the City of Rancho Cucamonga, California, does ordain as follows: SECTI08 1: The City Couocil finds and determines as follows: A. Government Code Section 65864 through 65869.5 authorizes the City to enter into binding Developmeot Agreements with persons having legal or equitable interests in real property for the development of such proper~y. B. Three copies of the proposed Development Agreement between the City, C/A, Ltd., and The Tower Partnership are ou file in the office of the City Clerk, and the same are public records of the City. C. The proposed Development Agreement pertain to real property situated in the City and described as follows: Lot "A" and Parcels 1 through 4, inclusive, and Parcels 6 tbroush 9, inclusive, of Parcel Map 8303 as shown on Nap recorded in Hook 95 of Parcel Maps, Pages 76 through 79, inclusive, Records of San Bernardino County, California. D. The City Council bas held a public hearing on the proposed Development Agreement and notice of that public hearing has been given for the time and in the manner prescribed by Government Code Section 65867. E. The provisions of the proposed Development Agreement are consistent with the General Plan, and there is no specific plan effecting the property subject to the proposed Development Agreement. SECTI~q 2: The proposed Development Agreement between the City, C/A Ltd., nod The Tower Partnership, referred to in Section I above, is hereby approved. On the effective date of this Ordinance the Mayor shall sign as many copies of said Development Agreement as are necessary for the use of the parties, the City Clerk shall attest to the same and shall deliver one fully signed copy each to C/A, Ltd., and The Tower Partnership. SECTI08 ~: A Negative Declaration is hereby adopted for this Development Agreement, based upon the completion and findings of the Initial Study. SECTIOiq 4: The Mayor shall sign this Ordinance and the City Clerk shall cause the same to be published within fifteen (15) days after its passage at least once in ~_~2~~, a newspaper of general circulation published in the City of Ontario, California, and circulated in the City of Rancho Cucamonga, California.
