HomeMy WebLinkAbout291-A - Ordinances ~' i, Ot~D~N~ICE NO. 291 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RANCHO (~CAMONGA, CALIFORNIA AMENDING CHAPTER 8.19 OF THE RANCHO ~3CAMONGA MUNICIPAL CODE CONCERNING COMMERCIAL AND INDUSTRIAL REFUSE COLLECTION The Council of the City of Rancho Cucamonga does hereby ordain as follows: SECTION 1: Section 8.19.040 of the Rancho Cucamonga Municipal Code hereby is amended to read as follows: "8.19.040. Permits for refuse collection and establishment of collection fees. The Council hereby does determine that the disposal and/or collection of refuse, trash, rubbish or other solid waste is a service to be performed in the City in accordance with the provisions of this chapter. The City may from time to time issue permits to those parties meeting the criteria of this Chapter 8.19 and such other standards as may be established by resolution of the City Council regarding the collection of refuse, rubbish and other forms of solid waste from commercial and industrial establishments, provided that no more than three such permits may be exercised or outstanding slmultaneously. So long as any such permit remains in force. collection of material provided for herein may be made only in accordance with the terms and conditions hereof. Such fees and charges for such collection, removal and disposal services shall be those which the Council may from time to time hereafter approved by resolution. No person shall engage in the business of collecting, removing or disposin8 of any refuse, trash, rubbish or other solid waste within the City from any commercial or industrial establishment nor transport the same over any public streets or rights-of-way, unless a permit to do so has been obtained from the Council and such person complies with the provisions of this chapter and any other regulations which have been adopted pursuant to this chapter." SECTION 2: Subsection 8.19.270B hereby is added to the Rancho CucamonEa Municipal Code to read as follows: "B. Notwithstanding any contrary provision set forth in this Chapter 8.19, any person who was providing commercial or industrial refuse collection services to customers within City as of the effective date of City's Ordinance No. 291 may continue to service any or all of those customers for a period of two years commencing with that effective date." SECTION 3: The Mayor shall sign this Ordinance and the City Clerk shall cause the same to be published within fifteen (15) days after its passage at least once in The Daily Report, a newspaper of general circulation published in the City of Ontario, California, and circulated in the City of Rancho Cucamonga, California.
