AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RANCHO
CUCAMONGA, CALIFOP~IA, AFFORDING TO TRE DEER CRE~ COMPANY A
CREDIT APPLICABLE TO SYSTEMS DEVELOPMENT FEES
A. Recitalq.
(i) Chapter 3.28 of the Rancho Cucamonga Municipal Code requires
the payment of Systems Developlent fees in conjunction with approval of
subdivisions and in accordance with a fee schedule adopted by this Council by
resolution.
(ii) Aa a condition of approval of Tentative Tract 12801, the Deer
Creek Colpany has been required to provide a City standard cul-de-sac on Opal
Street rather than constructing Opal Street as a through street.
(iii) In addition to the condition specified in Recital (ii) above,
Deer Creek Co,,pany has been required by the City's Plann£ng Coe~aission to
provide pedestrian access to Alta Loma Junior glgh School.
(iv) This City's Flannin$ Co~ission has recommended to this Council
that the Deer Creek Company be afforded a Systems Development fee credit in the
amount of $16,777.00 due to the Commission's f£nd£n~ that the requirements
referred to in Recitals (i) and (ii) above were not generated by the
developlent of the subject tentative tract but, rather, met certain public
concerns and therefore constituted an unusual condition and exaction
conjunction with approval of that tentative tract.
(v) It is the purpose of this Ordinance to afford to the Deer Creek
Company the credit referred to above in this Ordinance.
B. Ordinance.
NO~, THERE~0RE, the City Council of the City of Rancho Cucamenga does
hereby find, determine and ordain aa follows:
SECTIO~ 1: This Council specifically finds that all of the facts set
forth in the Recitals, Part A, of this Ordinance are true and correct.
SECTI~ 2: It hereby is ordained that the Deer Creek Co~pany shall be
afforded a credit against its others/se required Systems Develops, ant fee
applicable to Tract No. 12801 in the amount of $16,777.00
SECTI~ 9: The Mayor shall sign this Ordinance and the City Clerk
shall cause the sale to be published within fifteen (15) days after its passage
at least once in ~_~~, a newspaper of general circulation published
in the City of Ontario, California, and circulated in the City of Rancho
Cucamon~a, California.
PASSED, APFROVED, and ADOPTED this 20th day of November, 1985.
