AN ORDINANCE OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA,
APPROVING A DEVELOPMENT AGREEMENT BETWEEN THE CITY OF
RANCHO CUCAMONGA, CARYN DEVELOPMENT COMPANY, KAUFMAN AND
BROAD LAND COMPANY, AND MARLBOROUGH DEVELOPMENT
CORPORATION, IN RELATION TO THE PROPERTY GENERALLY
LOCATED BETWEEN THE EXTENSION OF BANYAN AVENUE AND THE
PROPOSED FOOTHILL FREEWAY ON THE NORTH AND SOUTH, AND
BETWEEN THE EXTENSION OF ROCHESTER AND MILLIKEN AVENUES
ON THE EAST AND WEST.
WHEREAS, the City Council, following duly held public hearings
approved the Caryn Planned Community on property described in Exhibit "A" and
generally located as described above; and
WHEREAS, it has been determined that the development of the property
in accordance with the Caryn Planned Community/Development Plan text within
the City limits would be beneficial to the public purposes of the City, in
that the property, developed in a manner authorized by the development
approvals would be consistent with the City's General Plan; and
WHEREAS, the implementation of said development in accordance with
the Planned Community/Development Plan text within the City limits would be
beneficial to the public purposes of the City, in that the property, developed
in a manner authorized by the development approvals would be consistent with
the City's General Plan; and
WHEREAS, the Planning Commission of the City of Rancho Cucamonga
passed a resolution recommending approval of this Development Agreement to the
City Couneil
NOW, THEREFORE, the City Council of the City of Rancho Cueamonga,
California, does ordain as follows:
SECTION 1: The City Council finds and determines as follows:
A. Government Code Section 65864 through 65869.5 authorizes the
City to enter into binding Development Agreements with persons having legal or
equitable interests in real property for the development of such property.
B. Three copies of the proposed Development Agreement are on
file in the office of the City Clerk, and the same are public records of the
City.
C. The City Council has held a public hearing on the Caryn
Development Agreement and notice of that public hearing has been given for the
time and in the manner prescribed by Government Code Section 65867.
D. The provisions of the Caryn Development Agreement are
consistent with the General Plan and the Caryn Planned Community text, and
there is no Specific Plan affecting the property subject to the proposed
Development Agreement.
SECTION 2: The Caryn Development Agreement referred to in Section 1
above, is hereby approved. On the effective date of this Ordinance the Mayor
shall sign as many copies of said Development Agreement as are necessary for
the use of the parties, the City Clerk shall attest to the same and shall
deliver one fully signed copy to each party to the Agreement.
SECTION 3: No later than ten (10) days hereafter the effective date
of this Ordinance the City Clerk shall record the Caryn Development Agreement
with the San Bernardino County Clerk.

SECTION 4: The Mayor shall sign this Ordinance and the City Clerk
shall cause the same to be published within fifteen (15) days after its
passage at least once in The Daily Report, a newspaper of general circulation
published in the City of Ontario, California, and circulated in the City of
Rancho Cucamonga, California.
