AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RANCHO
CUCAMONGA, CALIFORNIA, PROVIDING FOR CONTRIBUTION FROM
LAWFUL FUNDS TO PAY FOR CERTAIN COSTS AND EXPENSES IN A
COMMUNITY FACILITIES DISTRICT
WHEREAS, the City Council of the City of Rancho Cucamonga, California
(hereinafter referred to as the "legislative body of the local Agency"), has
previously declared its intention and order the preparation of a "Report"
relating to the initiation of proceedings to create a Community Facilities
District pursuant to the terms and provisions of the "Mello-Roos Community
Facilities District Act of 1982", being Chapter 2.5, Part 1, Division 2, Title
5 of the Government Code of the State of California. This Community
Facilities District shall hereinafter be referred to as
CO~4UNITY FACILITIES DISTRICT NO. 84-1
(DAY CREEK DRAINAGE SYSTEM)
(hereinafter referred to as the "District"; and
WHEREAS, Section 53314.8 of the Government Code of the State of
California expressly authorizes a local agency, at any time, by Ordinance,
either before or after the formation of the District, to authorize a
contribution from any lawful source of revenue to pay for certain of the costs
and expenses to said District; and
WHEREAS, at this time this City Council is desirous to provide for a
contribution in the manner and form as authorized by law.
NOW, THEREFORE, ITS IS HEREBY ORDAINED AS FOLLOWS:
SECTION 1. That the above recitals are all true and correct.
SECTION 2. That this City Council does at this time provide and
authorize for a contribution from lawful sources to pay for a certain portion
of the costs and expenses of the District, all as specfically set forth in an
Agreement between the City of Rancho Cucamonga and the Rancho Cucamonga
Redevelopment Agency, said Agreement approved by this City CounciI on the 4th
day of April, 1984, a copy of which is on file in the office of the City Clerk
and open for public inspection. For all particulars as to the period of the
contribution and the method and apportionment of said funds, reference is
hereby made to said approved Agreement.
SECTION 3. The contribution as above referenced, shall not
constitute an indebtedness or liability of the City of Rancho Cucamonga.
SECTION 4. The Mayor shall sign this Ordinance and the City Clerk
shall cause the same to be published within fifteen (15) days after its
passage at least once in The Daily Report, a newspaper of general circulation
published in the City of Ontario, California, and circulated in the City of
Rancho Cueamonga, California.
