AN ORDINANCE OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA,
AMENDING CHAPTER 1.04 OF THE RANCHO CUCAMONGA MUNICIPAL
CODE BY AMENDING SECTION 1.04.010 (G) TO REDEFINE THE
WORDS "MUST" AND "SHALL" AND BY ADDING SECTION 1.04.100
TO PROVIDE THAT NO CODE, ORDINANCE, RESOLUTION OR
ADMINISTRATIVE REGULATION SHALL CREATE OR IMPOSE A
MANDATORY DUTY FOR OR UPON THE CITY OF RANCHO CUCAMONGA
OR ANY OFFICER OR EMPLOYEE THEREOF ACTING WITHIN THE
SCOPE OF SUCH OFFICE OR EMPLOYMENT
The City Council of the City of Rancho Cucamonga does ordain as
follows:
SECTION 1: Chapter 1.04 of the Rancho Cucamonga Municipal Code is
hereby amended by amending Section 1.04.010 (G) to read as follows:
"G. 'Must' and 'shall' are each mandatory except in
reference to acts or omissions of the City of Rancho
Cucamonga or any officer or employee of the City of
Rancho Cucamonga in which cases 'must' and 'shall' are
each directory only."
SECTION 2: Chapter 1.04 of the Rancho Cucamonga Municipal Code is
hereby amended by adding Section 1.04.100 to read as follows:
"1.04.100 No Mandatory Duty. Notwithstanding any
other provision of law, no provision of this Code, of any
Ordinance of the City, of any Code adopted by reference
by this Code or any Ordinance of the City, of any
resolution of the Council, or of any administrative
regulations having the force of law, whether the same was
heretofore or is hereafter enacted, shall be deemed to
creat or impose a mandatory duty for or upon the City,
any department, board or commission of the City, or any
officer or employee of the City who is acting within the
scope of such office or employment."
SECTION 3: The Mayor shall sign this Ordinance and the City Clerk
shall cause the same to be published within fifteen (15) days after its
passage at least once in The Daily Report, a newspaper of general circulation
published in the City of Ontario, California, and circulated in the City of
Rancho Cucamonga, California.
