AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RANCHO
CUCAMONGA, CALIFORNIA, IMPOSING A MORATORIUM UPON THE
FILING, PROCESSING AND APPROVAL OF TENTATIVE AND FINAL
MAPS FOR SUBDIVISIONS CREATING BY CONVERSION, FIVE (5)
OR MORE CONDOMINIUMS, COMMUNITY APARTMENT CONVERSION
PROJECTS CONTAINING FIVE (5) OR MORE PARCELS, AND
CONVERSION OF DWELLINGS TO STOCK COOPERATIVES CONTAINING
FIVE (5) OR MORE DWELLING UNITS A~ND DECLARING THE URGENCY
THEREOF.
The City Council of the City of Rancho Cucamonga, California,
does ordain as follows:
SECTION 1: The City Council finds and determines that:
(a) It is in the best interests of the public
health, safety and welfare that an adequate number of multiple-family
dwellings with dwelling units available for rental exist within the
City.
(b) The number of multiple-family dwellings
with dwelling units available for rental presently existing within the
City is limited and should be preserved pending further study and action
by the Planning Commission and the City Council.
(c) The unrestricted conversion of available
multiple-family dwelling rental units to condominiums, community apartment
projects, or stock cooperatives would seriously deplete the number of
such rental units available within the City and would therefore be
detrimental to the public health, safety and welfare.
(d) Additional time is needed to study the
matter and determine if permanent controls on such conversions should be
imposed by the City.
SECTION 2: The City shall not accept for filing a tenta-
tive map or a final map for the purpose of creating a subdivision containing
five (5) or more condominiums as defined in Section 783 of the Civil
Code, a community apartment project containing five (5) or more parcels,
or for the conversion of a dwelling to a stock cooperative containing
five (5) or more dwelling units.
SECTION 3: The City shall not further process or approve a
tentative map or a final map for the purpose of creating a subdivision
containing five (5) or more condominiums as defined in Section 783 of
the Civil Code, a community apartment project containing five (5) or
more parcels, or for the conversion of a dwelling to a stock cooperative
containing five (5) or more dwelling units.
SECTION 4: This Ordinance shall not apply to a map describing
land which is not occupied by a multiple family dwelling at the time the
map is filed.
SECTION 5: This Ordinance shall be of no further force and
effect four (4) months after its adoption.
SECTION 6: The City Council hereby declares that it would
have adopted this Ordinance and each section, sub-section, sentence,
clause, phrase or portion thereof irrespective of the fact that any one
or more sections, sub-sections, sentences, clauses, phrases or portions
thereof be declared invalid or unconstitutional. If for any reason any
portion of this Ordinance shall be declared invalid or unconstitutional,
then all other provisions thereof shall remain in full force and effect.
SECTION 7: This Ordinance is hereby declared an urgency
measure necessary for the immediate protection and preservation of the
public health, safety and welfare for the reasons stated in Section 1
hereof, and it shall take effect immediately upon its adoption.
SECTION 8: The Mayor shall sign this Ordinance and the
City Clerk shall cause the same to be published within fifteen (15) days
after its passage at least once in The Daily Report, a newspaper of
general circulation published in the City of Ontario, California, and
circulated in the City of Rancho Cucamonga, California.
PASSED, APPROVED, and ADOPTED this 21st day of May, 1980.
