HomeMy WebLinkAbout85 - Ordinances ORDINANCE NO. 85 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, DECLARING CERTAIN ACTS TO BE UNLAWFUL WITHIN THE LIMITS OF CITY-OWNED OR -OPERATED PARKS OR OTHER RECREATION FACILITIES AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF. %he City Council of the City of Rancho Cucamonga, California does ordain as follows: SECTION 1: Except as hereinafter provided, it shall be unlawful for any p~rson within the limits of any park or other recreation facility owned or operated by the City to: (a) Lead or let ]oose any animal except: (1) Dogs or cats on a leash which are under the full control of a person. (2) Horses, ponies or the like which are ridden or led on bridle trails or other areas designated for such purpose. (b) Possess or consume alcoholic beverages. For the purposes of this Ordinance, the phrase "alcoholic beverages" includes alcohol, spirits, liquor, wine, b~' r and every liquid or solid containing alcohol, si~rits, liquor, wine, or beer, and which contains one-half (1/2) of one percent (1%) or more by volume of alcohol and which is fit for beverage purposes either alone or mixed, diluted or combined with other substances. (c) Enter or remain between the hours of iO:O0 p.m. and 6:00 a.m. of the following day except pursuant to a authorization issued by the City. (d) Light or maintain any fire except in a stove, fire circle or other place provided for that purpose. (e) Throw, project or propel any object capable of uausing serious personal injury o~ damage to prop- erty except that baseball, basketball, football and other games where a ball is used may be played in areas designated for such purposes. (f) Park or stand any vehicle in other than a designated parking area except pursuant to a permit ~ssued by the City. (g) Drive any vehicle other than on roads, trails or driveways provided for that purpose except pursuant to a permit issued by the City. (h) Drive any vehicle at a speed in excess of five miles per hour (5 m.p.h.). (i) Ride or use playground equipment posted for use by children under the age of fourteen (14) years unless under the age of fourteen (14) years. (j) Throw, discard, place or dispose of any garbage or refuse upon the ground or in any place other than a garbage can or other receptacle maintained for such purpose. Pa~ge 2 (k) Bring garbage or refuse from outside the limits of the park or recreation facility and deposit the same in garbage cans or receptacles. (1) Hold or engage in a musical concert or other musical event without a permit issued by the City. (m) Fly fuel power driven model airplanes except in areas designated for such purposes. (n)Molest, injure or kill any animal or disturb its habitat. (o) Play any radio, tape recorder or other electronic sound-producing device at such volume as to be audible at a distance of more than fifty feet (50'). SECTION 2: Any person engaging in any activity declared unlawful by sub-sections (b), (j) and (n) of Section 1 of this Ordinance is guilty of a misdemeanor and shall be punished by imprisonment in the county jail for not more than six (6) months or fine not exceeding Five Hundred and no/lO0 Dollars ($500.00), or by both such fine and imprisonment. SECTION 3: Any person violating any of the provisions of sub-sections (a), (c), (d), (e), (f), (g), (h), (i), (k), (1), (m) or (o) of Section 1 of this Ordinance, after having been once advised that such activity is unlawful, is guilty of a misdemeanor and shall be punished by imprisonment in the county jail for not more than six (6) months or fine not exceeding Five Hundred and no/lO0 Dollars ($500.00), or by boti~ such fine and imprisonment. SECTION 4: The provisions of sub-section (c), (f) and (g) of Section [ of this Ordinance shall not apply to City employees who are engaged in the performance of their duties. SECTION 5: The Community Services Director may adopt rules and regulations for the issuance of any permit permitted hereunder. Any seth permit shall be issued by the Community Services Department. SECTION 6: The Community Services Department, pursuant to rules and standards adopted by tile Community Services Director, mav £ssu~· permits authorizing exclusive temporary use of specified recreational areas for groups desiring to engage in specified recreational activities. SECTION 7: The Mayor shall sign this Ordinance and the City Clerk shall attest to the same, and the City Clerk shall cause tile same to be published within fifteen (15) days after its passage, at least once in The Daily Report, a newspaper of general circulation, published in the City of Ontario, California and circulated in the City of Rancho Cucamonga, California.
