AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RANCHO
CUCAMONGA, CALIFORNIA, PROVIDING FOR THE INELIGIBILITY
OF CERTAIN PERSONS FOR E~LOYMENT BY THE CITY AND
AUTHORIZING CERTAIN OFFICERS AND EMPLOYEES ACCESS TO THE
"STATE SUMMARY CRIMINAL HISTORY INFORMATION"
The City Council of the City of Rancho Cucamonga, California,
does ordain as follows:
SECTION 1: No person convicted (including pleas of ~uiltv
and nolo contendre) of a felony or a misdemeanor involving moral
turpitude shall be eligible for employment by and department of the
City; provided, however, the appointing authority may disregard such
conviction if it is found and determined by such appointing authority
that mitigating circumstances exist, such as, but not limited to,
evidence of rehabilitation, the length of time elapsed since such
conviction, the age of such person at the time of the conviction, or
the fact that the classification applied for is unrelated to such
conviction.
SECTION 2: The City Manager, Assistant to the City Manazer,
Finance Director, Police Chief, City Attorney, Assistant City Attornev, and
each appointing authority of the City are herebv authorized to have access
to the "State Summary Criminal Historv Information", as provided for
in Section 11105 of the California Penal Code, when it is required to
assist such individual to fulfill the employment responsibilities set
forth in this Ordinance.
SECTION 3: The Mayor shall sign this Ordinance and the
City Clerk shall attest to the same, and the City Clerk shall ca~se
the same to be published within fifteen (15) davs after its passaze,
at least once in The Daily Report, a newspaper of general circL~lation,
published in the Citv of Ontario, California, and circulated in the City
of Rancho Cucamonga, California.
PASSED, APPROVED and ADOPTED this 2nd day of Way, 1979.
