HomeMy WebLinkAbout40 - Ordinances ORDINA~NCE NO. 40 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ~a~NCHO CUCAMONGA, CALIFORNIA, ASSUMING RESPONSIBILITY FOR THE ENFORCEMENT OF THE MOBILEHOME PARKS ACT AND RELATED REGULATIONS OF THE CALIFORNIA ADMINISTRATIVE CODE AND DESIGNATING THE ENFORCEMENT AGENCY. WHEREAS, it is the interest of the City of Rancho Cucamonga to assume responsibility for the enforcement of the Mobilehome Parks Act and related regulations of the California Administrative Code: The City Council of the City of Rancho Cucamonga does ordain as follows: 1. The City of Rancho Cucamonga hereby assumes responsibility for the enforcement of the California Health and Safety Code, Division 13, Part 2.1 (Mobilehome Parks Act) and related regulations of Title 25, California Administrative Code, within the City of Rancho Cucamonga. 2. The San Bernardino County Department of Environmental Health Services is hereby designated as the enforcement agency for the City of Rancho Cucamonga and is authorized to provide the qualified personnel necessary to enforce the provisions of the Mobilehome Parks Act consistent with the state's enforcement program. 3. As needed to meet the program goal and objectives, the County Department of Environmental Health Services is directed to assign up to two qualified employees to enforce the provisions of the Mobilehome Parks Act. 4. The schedule of fees contained within the Mobilehome Parks Act shall be applicable within the City of Rancho Cucamonga to provide for the cost of administration and enforcement of the Wobilehome Parks Act. The County Department of Environmental Health Serivces shall administer and collect these fees for deposit within the County Treasury to offset the costs of the enforcement responsibility. 5. There exists within the boundaries of the City of Rancho Cucamonga eight (8) mobilehome parks with a combined total of approxi- mately 1280 mobilehome dwelling units. Approximately one-third of these parks have more than 80 spaces; one-third of these parks have more than 140 spaces, and the remaining one-third more than 200 spaces. Average age of park is seven years. The majority of the existing mobilehome parks are in a generally excellent to good condition. The remainder are in fair condition in regards to compliance with this Chapter. There are no major violations. 6. With the adoption of this ordinance, the City of Pancho Cucamonga hereby intends to meet the public protection intent and provisions of the California Health & Safety Code, Division 13, Part 2.1 (Mobilehome Parks Act) and related regulations of the California Administrative Code, Title 25 pertaining to mobilehome parks to assure that all mobilehome parks within the City of Rancho Cucamonga are safe, sanitary and acceptable residential areas. Reasonable compliance with maintenance, sanitation, safety, use and occupancy provisions of the Mobilehome Parks Act is anticipated within three (3) months from the effective date of this ordinance. 7. The effective date of enforcement by the City of Rancho Cucamonga shall be October 1, 1978. Ordinance No. 40 Page 2 PASSED, APPROVED, and ADOPTED this 20th day of September, 1978. ATTEST: City Clerk
