HomeMy WebLinkAbout78-C - Ordinances ORDINANCE NO. 78-C AN ORDINANCE AMENDING CHAPTER 8.12 OF THE RANCHO CUCAMONGA MUNICIPAL CODE TO PROHIBIT THE SALE, USE OR DISCHARGE OF SAFE AND SANE FIREWORKS IN THE CITY OF RANCHO CUCMAONGA. THE PEOPLE OF THE CITY OF RANCHO CUCAMONGA DO ORDAIN AS FOLLOWS: SECTION 1: Chapter 8.12 of Rancho Cucamonga Municipal Code is hereby repealed. SECTION 2: A new Chapter 8.12 is hereby added to the Rancho Cucamonga Municipal Code to be read, in words and figures as follows: "8.12.010 Fireworks prohibited; exception. Subject to the exception set forth below in this section, it shall be unlawful for any person, firm, partnership or corporation to sell, use or discharge any fireworks within the City of Rancho Cucamonga including, but not limited to, "safe and sane" fireworks as that term is defined in Part 2 of Division 11 of the California Health and Safety Code, as the same may be amended from time to time hereafter. "EXCEPTION: Nothing in this chapter shall preclude the presentation of a licensed public display of fireworks including, but not limited to, "safe and sane" fireworks. "8.12.020 Penalty for violation of chapter. It shall be unlawful for any person, firm, partnership or corporation to violate any provision of this chapter. Any person, firm, partnership or corporation violating any provision of this chapter shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine not exceeding one thousand dollars, or by imprisonment not exceeding six months, or by both such fine and imprisonment. Each such person, firm, partnership or corporation shall be deemed guilty of a separate offense for each and every day or any portion thereof during which any violation of this chapter is committed, continued or permitted by such person, firm, partnership or corporation, and shall be deemed punishable therefore as provided in this chapter. "8.12.030 Civil remedies available, The violation of any of the provisions of this chapter shall constitute a nuisance and may be abated by the city through civil process by means of restraining order, preliminary or permanent injunction or in any other manner provided by law for the abatement of nuisances." Ordinance No. 78-C Page 2 of 2 SECTION 3: The provisions of this Ordinance may be amended by adoption of an ordinance of the City Council of the City of Rancho Cucamonga. NOTES: This Ordinance was approved by the registered voters of the City of Rancho Cucamonga on November 7, 1989. The certified results of the November 7, 1989 election were approved by the City Council on December 6, 1989 by Resolution No. 89-570.
