ORDINANCE NO. 756
AN ORDINANCE OF THE CITY COUNCIL OF RANCHO
CUCAMONGA, CALIFORNIA, AMENDING REGULATIONS
APPLICABLE TO THE ISSUANCE OF MASSAGE PERMITS
The City Council of the City of Rancho Cucamonga hereby ordains as follows:
SECTION 1: Subsection 7 of Section 9.24.040 E of Chapter 9.24 of Title 9 of
the Rancho Cucamonga Municipal Code is hereby amended to
read as follows:
"7. As to each applicant and owner of at least ten percent
(10%) of the massage establishment and/or out call
massage business, all convictions for any crime that
requires registration under any state, federal or other
governmental law similar to and including California Penal
Code Section 290, and whether or not any such person is
required to register pursuant to Section 290 or any such
similar law, and convictions for any crime that involves
conduct which is a violation of any state, federal or other
governmental law similar to and including California Penal
Code Sections 266h, 266i, 314, 315, 316, 318, 647, or any
other crime involving the elements of the foregoing code
sections, by way of plea bargain, or any other crime
involving dishonesty, fraud, deceit or moral turpitude. For
purposes of this Article 1, 'conviction' shall include a
conviction pursuant to a plea of guilty or nolo contendere;"
SECTION 2: A new subsection "h" is hereby added to Section 9.24.040 E.22 of
Chapter 9.24 of Title 9 of the Rancho Cucamonga Municipal Code
to read as follows:
"h. The applicant, including any ten percent (10%) or more
owner of the massage establishment or outcall massage
service, or any massage technician employed by or
working out of or in connection with the massage
establishment or outcall massage service, is not required
to register under the provisions of California Penal Code
Section 290 or similar criminal statute."
SECTION 3: A new subsection "3" is hereby added to Section 9.24.210 M of
Chapter 9.24 of Title 9 of the Rancho Cucamonga Municipal Code
to read as follows:
"3. The applicant is not required to register under the
provisions of California Penal Code Section 2900r similar
criminal statute."

SECTION 4: Severability. The City Council declares that, should any
provision, section, paragraph, sentence, or word of this Ordinance
be rendered or declared invalid by any final court action in a court
of competent jurisdiction, or by reason of any preemptive
legislation, the remaining provisions, sections, paragraphs,
sentences and words of this Ordinance shall remain in full force
and effect.
SECTION 5: The City Clerk shall certify to the adoption of this Ordinance and
shall cause the same to be published in the manner prescribed by
law.
