HomeMy WebLinkAbout505-B - Ordinances NO ACTION ORDINANCE NO. 505-B AN ORDINANCE OF THE COUNCIL OF THE CITY OF RANCMO CUCAMDNGA AMMqDING SUBS~IIONS 12.04,010A.2.a AND 12.04,010B AND REPEALING SECTION 12.04,050 OF THE RANCHO THE COUNCIL OF ~ CITY OF RANCMO CI/CAMONGA HEREBY DOES ORDAIN AS FOLLOWS: Section 1: Subsection 12.04.010A. 2. a of the Rancho Cucamonga Municipal Code hereby is amended to read as follows: "2 .a Possess or consume alcoholic beverages except that beer or wine may be possessed or consumed within the interior of the stadium beilding located in the sports complex on the west side of RDchester Avenue, south of Foothill Boulevard, and beer, wine and/or other alcoholic beverages may be possessed or consumed within eleven enclosed rooms which are located on the third level of the stadium and are included in the lease between the City and the stadium tenant, provided that any such alcoholic beverage must be purchased from a vendor located within said stadium building. All other spaces on the third floor are specifically precluded from possessing or consuming any alcoholic beverage." Section 2: Subsection 12.04,010B of the Rancho Cucamonga City Municipal Code hereby is amended to read as follows: "B. Any person violating any of the provisions of Subsection A of this Section 12.04.010, after having been once advised that such activity is unlawful, is guilty of a misdemeanor and shall be punished by imprisonment in the county jail for not more than six months or fine not exceeding one thousand dollars, or both fine and imprisonment." Section 3: Section 12.04.050 of the Rancho Cucamonga Municipal Code hereby is repealed. Section 4: Section 12.04.060 Civil Remedies Available. Ihe violation of any of the provisions of this Chapter contitutes a nuisance and may be abated by the City through civil process by means of restraining order, preliminary or permanent injunction, or in any other manner provided by law for the abatement of such nuisance. Section 5: Section 12.04.070 Severability. If any section, subsection, sentence, clause, [~hrase, or portion of this Ordinance is for any reason deemed or held to be invalid or unconstitutional by the decison of any court of ccmpetent jurisdiction, Or by reason of any preemptive legislation, such decision shall not affect the validity of the remaining portion of this OrdiDance. The City Council of the City of Rancho Cucamonga hereby declares that it would have adopted this Ordinance and each section, subsection, sentence, clause, phrase or portion thereof, irrespective of the fact that any one or more sections, subsections sentences, clauses, phrases, or other portions might subsequently be declared invalid or unconstitutional. Ordinance No. 505-B Page 2 Section 6: Tne City Clerk shall certify to the passage of this Ordinance. Section 7: The Mayor shall sign this Ordinance and the City Clerk shall cause the same to be published within fifteen (15) days after its passage at least once in the Inland Valley Daily Bulletin, a newspaper of general circulation published in the City of Ontario, California, and circulated in the City of Rancho Cucamonga, California.
