HomeMy WebLinkAbout484 - OrdinancesORDINANCE NO. 484 AN ORDINANCE OF THE CITY COUNCIL OF ~HE CITY OF RANCHO Ctr_AMDNGA, CAT.TFORNIA, APPROVING EITWANDA SPECIFIC PLAN AMtlqEMtlqT 91-01, TO AMtND THE ETIWANDA SPECIFIC PLAN STREET SYSTEM TO CHANGE THE PORTION OF MIT.T.ER AVENUE BETWEE~ ETIWANDA AVtlqI/E AND EAST AVENUE FROM A COTLFCIDR TO A SECONDARY ARTERIAL AND MAKING FINDINGS IN SUPPORT THERBOF A. Recitals. (i) On July 6, 1983, the City Council of the City of Rancho Cucamonga approved the enactment of the Regulatory Provisions of the Etiwanda Specific Plan through adoption of Ordinance No. 203. (ii) The City of Rancho Cucamonga has filed an application for Etiwanda Specific Plan Ansldment No. 91-01 as described in the title of this Ordinance. Hereinafter in this Ordinance, the subject Etiwanda Specific Plan Amendment is referred to as "the application." (iii) On December 17, 1991, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and rec~m~_nded approval by the adoption of Resolution No. 91-191. (iv) On February 5, 1992, the City Council of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application. (v) All legal prerequisites prior to the adoption of this Ordinance have occurred. NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does hereby ordain as follows: 1. This Council hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Ordinance are true and correct. 2. Based upon substantial evidence presentedto this Council during the above-referenced public hearing on February 5, 1992, including written and oral staff reports, together with public testimony, this Council hereby specifically finds as follows: (a) The application applies to the portion of Miller Avenue between Etiwanda Avenue and Fast Avenue; and (b) This amendment does not conflict with the circulation policies of the General Plan and Etiwanda Specific Plan and will provide the traffic flow in a manner consistent with the General Plan and with related development; and Ordinance No. 484 Page 2 (c) This amendment does promote the goals and objectives of the circulation element; and (d) This amendment would not be materially injurious or detrimental to the adjacent properties and would not have a significant impact onthe environment nor onthe surrounding properties. 3. Based upon the substantial evidence presented to this Council during the above-referenced public hearing and upon the specific findings of facts set forth in paragraph 1 and 2 above, this Council hereby finds and concludes as follows: (a) That the portion of Miller Avenue in the application is suitable for the designation as evidenced by the designation in the General Plan; and (b) That the proposed amendment would not have significant impacts on the environment nor on the surrounding properties as evidenced by the findings and conclusions listed in Parts I and II of the Initial Environ- (c) That the proposed amendment is in conformance with the General Plan and the Etfwanda Specific Plan. 4. This Council hereby finds that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970 and, further, this Council hereby authorizes the issuance of a Negative Declaration. 5. Based upon the findings and conclusions set forth in paragraphs 1, 2, 3, and 4 above, this Council hereby ordains that on the 5th day of February 1992, the City Council of the City of Rancho Cucamonga approves Etiw-~nda Specific Plan Amendment No. 91-01, amending the Etiwanda Specific Plan Street System Map to change the portion of Miller Avenue between Etiw~nda Avenue and East Avenue from a collector to a secondary arterial. 6. The Mayor shall sign this Ordinance and the City Clerk shall cause the same to be published within 15 days after its passage at least once in the Inland Valley Daily Bulletin, a newspaper of general circulation published in the City of Ontario, California, and circulated in the City of ~m'"~b,o Cucamonga.
