Recitals. (i) On May 20, 1981, the City of Rancho Cucamonga approved the enactment of the Victoria Planned Ccmmunity through the adoption of Ordinance No. 143. (ii) On August 5, 1991, the City of Rancho Cucamonga filed an application for Victoria Planned Ccmmunity Amendment No. 91-03, Subarea M, as described in the title of this Ordinance. Hereinafter in this Ord/nance, the subject Victoria Planned Ccemunity Amendment is referred to as "the application." (iii) On October 9, 1991, the Planning Cammission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and following the conclusion of said public hearing, adopted Resolution 91-174 rec~mne~ to the City Council that the application be approved. (iv) On November 20, 1991, the City Council of the City of Rancho Cucamonga conducted a duly noticed public hearing and concluded said hearing prior to the adoption of this Ordinance. (v) All legal prerequisites prior to the adoption of this Ordinance have occurred. NOW, THEREFORE, the City Council of the City of Rancho Cuc~Tonga does hereby ordain as follows: 1. Tnis Council hereby specifically finis that all of the facts set forth in the Recitals, Part A, of this Ordinance are true and correct. 2. Based upon substantial evidence presented to this Council during the above-referenced public hearing on November 20, 1991, including written and oral staff reports, together with public testimony, this Council hereby specifically finds as follows: Ordinance No. 479 Page 2 (a) The application applies to 7.895 acres of land located between approximately 600 feet and 1,000 feet south of Highland Avenue on the west side of the future Day Creek Boulevard and is presently undeveloped. Said property is currently designated Medium-High Residential (14-24 dwelling unite per acre); and (b) The property to the north of the subject site is designated Village C~t,,tercial and is vacant; the property to the south is designated Medium-High Residential (14-24 dwelling units per acre) and is vacant; the property to the east is designated Utility Corridor and is vacant; and the property to the west is designated Medium-High Residential (14-24 dwelling units per acre) and Utility Corridor and is vacant; and (c) This~t does notconflictwiththe ;and UsePolicies of the General Plan and Victoria Planned CoKmunity and will provide for development, within thedistrict, in amannerconsistent with theCem_ral Plan and with related development; and (d) This amendment promotes the goals and objectives of the Land Use Element; and (e) Tne properties located in Subarea M of the application are suitable for the uses permitted in the proposed district and are co~tpatible with existing and adjacent land use designations as evidenced by the location of property with the same land use designation bordering the subject site to (f) This amendment will not have a significant impact on the environment nor onthe surrounding properties as evidencedbythe findings and conclusions listed in Parts I and II of the Initial Study; and 3. This Council hereby finds that the project has been reviewedand considered in compliancewiththeCalifornia Environmental QualityAct of 1970 and, further, this Council hereby issues a Negative Declaration. 4. Based upon the findings and conclusions set forth in paragraphs 1, 2, and 3 above, this Council hereby approves Victoria Planned Ccrm/nity ~t 91-03, Subarea M, amending the Victoria Planned C'J'.ttttu3]lity ]'-'1rid Use Map from _Me~__ium-High Residential (14-24 dwelling units per acre) to Village CuLutercial for 7.895 acres of land located between approximately 600 feet and 1,000 feet south of Highland Avenue on the west side of the future Day Creek Boulevard as shown in Exhibit "A." 5. The Mayor shall sign this Ordinanoe and the City Clerk shall cause the same to be publishedwit_hart 15 days after its passage at least once in the Inland Valley Daily Bulletin, a newspaper of general circulation published in the City of Ontario, California, and circulated in the City of Rancho Cucamonga, California. Ordirk/nce No. 479 Page 3 SECTION : Tne Mayor shall sign this Ord/nance and the City Clerk shall cause the same to be published within fifteen (15) days after its passage at least once in the Inland Valley Daily Bulletin, a newspaper of general circulation published in the City of Ontario, California, and circulated in the City of Rancho Cucamonga, California.
