HomeMy WebLinkAbout477 - OrdinancesORDINANCE NO. 477 AN ORDINANCE OF THE CITY OOUNCIL OF THE CITY OF RANCMO CI/CAMDNGA, CALIFORNIA, APPROVING VICTORIA PIANN[D ~ AMMqEMBNT 91-03, SUBAREA J, AMMqDING THE VICIDR/A PLANNM3 ~ LAND USE MAP FRCM M~DIUM RESIDMqTIAL (8-14 EWRI.T.ING UNITS PER ACRE) TO I/TW-MBDIII~ RESIDMqTIAL (4-8 DW~.T,ING UNITS PER ACRE) FOR 20.895 ACRES OF LAND IDCAT[D APPROXIMATELY 892 FEET NORIM OF THE FUllRE VICIDRIA PARK LANE EXTENSION ON THE WEST SIDE OF SUPPORT THEREOF - APN: PORT/ON OF 227-021-03 AND 13 A. Recitals. (i) On May 20, 1981, the City of Rancho Cuca/mDnga approved the enactment of the Victoria Planned C~eu~,unity through the adoption of Ordinance No. 143. (ii) On August 5, 1991, the City of Rancho Cucamonga filed an application for Victoria Planned Ccmmunity Amerrhnent No. 91-03, Subarea J, as described in the title of this Ord/nance. Hereinafter in this ~, the subject Victoria Planned Ccmmunity Amendment is referred to as "the application." (iii) On October 9, 1991, the Planning Oammission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and following the conclusion of said public hearing, adopted Resolution 91-170 rec~uier~ to the City Council that the application be approved. (iv) On November 20, 1991, the City Council of the City of Rancho Cucamonga conducted a duly noticed public hearing and concluded said hearing prior to the adoption of this Ordinance. (v) All legal prerequisites prior to the adoption of this Ordinance have occurred. NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does hereby ordain as follows: 1. This Council hereby specifically fi/xi~ that all of the facts set forth in the Recitals, Part A, of this Ordinance are true and correct. 2. Based upon substantial evidence presented to this Council during the above-referenced public hearing on November 20, 1991, including written and oral staff reports, together with public testimony, this Council hereby specifically finds as follows: Ord/nance No. 477 Page 2 (a) The application applies to 20.895 acres of land located approximately 892 feet north of the future Victoria Park tane extension on the west side of the future Day Creek Boulevard and is presently undeveloped. Said property is currently designated Medium Residential (8-14 dwelling units per acre); and (b) The property to the north of the subject site is designated Medium Residential (8-14 dwelling units per acre) and is vacant; the property to the south is designated Low _-Mea_~_ium Residential (4-8 dwelling units per acre) and is vacant; the property to the east is designated Utility Corridor and is vacant; the pro~ to the west is designated Utility Corridor and is vacant; and (c) Tnis ~t does not conflict with the Tand Use Policies of the General Plan and Victoria Planned Cunununity and will provide for development, within the district, in a manner consistent with the General Plan and with related development; and (d) Tnis amendment promotes the goals and objectives of the and Use Element; and (e) The properties located in Subarea J of the application are suitable for the uses permitted in the proposed district and are compatible with existing and adjacent land use designations as evidenced by the location of properties with the same land use designations bordering the subject site to the south; and (f) This ~t would not have a significant impact on the environment nor on the surrcunding properties as evidenced by the fixflings and conclusions listed in Parts I and II of the Initial Study; and 3. This Council hereby finds that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970 and, further, this CnurEil hereby issues a Negative Declaration. 4. Based upon the findings and conclusions set forth in paragraphs 1, 2, and 3 above, this Council hereby approves Victoria Planned Oat,,~tunity ~t 91-03, Subarea J, azerrLir~ the Victoria Planned Cc~munity ;and Use Map from Medium Residential (8-14 dwelling units per acre) to Low-Medium Residential (4-8 dwelling units per acre) for 20.895 acres of land located approximately 892 feet north of the future Victoria Park vane extension on the west side of the future Day Creek Boulevard as shown in Exhibit "A." 5. Tne Mayor shall sign this Ordinance and the City Clerk shall cause the same to be published within 15 days after its passage at least once in the Inland Valley Daily Bulletin, a newspaper of general circulation published in the City of Ontario, California, and circulated in the City of Rancho Cucamonga, California.
