HomeMy WebLinkAbout470 - OrdinancesORDINANCE NO. 470 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RANCHO CIEAM3NGA, CALIFORNIA, APPROVING VICTORIA PIANN~D OCM4UNTTY ~ 91-03, SUBAREA B, AM~qDING THE RESID~qIIAL (14-24 ~.T.T~G ~ PER ACRE) TO M~D17/~ RESID~/AL (8-14 DWRr,T,TNG UNITS PER ACRE) FOR 19.3 ACRES OF LAND ~ ON THE NORTH SIDE OF BASE LINE ROAD, WEST THEPaOF - APN: 227-091-14 AND 15 A. Recitals. (i) On May 20, 1981, the City of Rancho Cucamonga ap~ the enactment of the Victoria Planned Oatt~unity through the adoption of Ordinance No. 143. (ii) On August 5, 1991, the City of Rancho Cucamonga filed an application for Victoria Planned C~,u~unity ~t No. 91-03, Subarea B, as described in the title of this Ordinance. Hereinafter in this Ordinance, the subject Victoria Planned C~mtunity ~t is referred to as "the application." (iii) On October 9, 1991, the Pianning C~t.,dssion of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and following the conclusion of said public hearing, adopted Resolution 91-168 reoLttute, r]dirlg to the City Council that the application be approved. (iv) On November 20, 1991, the City Council of the City of Rancho Cucamonga conducted a duly noticed public hearing and concluded said hearing prior to the adoption of this Ordinance. (v) All legal prerequisites prior to the adoption of this Ordinance have occurred. NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does hereby ordain as follows: 1. This Council hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Council during the above-referenced public hearing on November 20, 1991, including written and oral staff reports, together with public testimony, this Council hereby specifically finds as follows: (a) The application applies to 19.3 acres of land located on the north side of Base Line R~ad, west of Victoria Park Lane and is presently undeveloped. Said property is currently designated Medium-High Residential (14-24 dwelling units per acre); and Ordinance No. 470 Page 2 (b) The property to the north of the subject site, past the Southern Pacific Railroad right-of-way, is designated Low Residential (2-4 dwelling units per acre) and is developed with single family residences; the property to the south is designated High Residential (24-30 dwelling units per acre) and is developed with an existing, nonconforming irrk~trial building used to produce wine vinegar; the properties to the east are designated Medium-High Residential (14-24 dwelling units per acre) and Village ~ial and are developed with a condcmtinium project and a c~nmercial shopping center; and the property to the west is designated Medium-High Residential (14-24 dwelling units per acre) and is developed with a recreational vehicle storage facility; and (c) Tnis amendment does not conflict with the Iand Use Policies of the Cem_ral Plan and Victoria Planned Co~mnunity and will provide for development, within the district, in a manner consistent with the General Plan and with related development; and (d) Tnis amendment promotes the goals and objectives of the rand Use Element; and (e) The properties located in Subarea B of the application are sui~_ble for the uses permitted in the proposed district and are compatible with existing and adjacent land use designations as evidenced by the location of properties with lower density land use designations bordering the subject sits to the north; and (f) This amendment would not have a significant impact on the environment nor on the surrounding properties as evidenced by the findings and conclusions listed in Parts I and II of the Initial Study; and 3. Tnis Council hereby finds that the project has been reviewed and considered in compliance with the California Environmental Quality AEt of 1970 and, further, this Council hereby issues a Negative Declaration. 4. Based upon the findings and conclusions set forth in paragraphs 1, 2, and 3 above, this Council hereby approves Victoria Planned Community Amendment 91-03, Subarea B, amending the Victoria Planned C. utt,,t:t.]rLity Tand Use Map frc~ Medium-High Residential (14-24 dwelling units per acre) to Medium Residential (8-14 dwelling units per acre) for 19.3 acres of land located on the north side of Base T.~ne Road, west of Victoria Park rane as shown in Exhibit "A." 5. The Mayor shall sign this Ordinance and the City Clerk shall cause the same to be published within 15 days after its passage at least once in the Inland Valley Daily Bulletin, a newspaper of general circulation published in the City of Ontario, California, and circulated in the City of Rancho Cucamonga, California.
