Recitals. (i) On April 24 and continued to May 8, June 12, July 10, August 14, August 22, and Septamber 11, 1991, the Planning O',,.-i.~ion of the City of above-referenced Terra Vista Planned Cemmz~ty Amendment. FollcTwing the conclusion of said public hearing on Septamber 11, 1991, the Planning Cc,,,~dssion adopted Resolution No. 91-135, thereby rec~m~eJx~ that the City Council adopt Tetra Vista Planned Cnmmmity Amendment No. 91-02. (ii) On September 11, 1991, the City Council of the City of Rancho Cucamonga conducted a duly noticed public hearing and concluded said hearing prior to its adoption of this Ordinance. (iii) All legal prerequisites prior to the adoption of this Ordinance have occurred. NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does hereby ordain as follows: SECTION 1: This Council hereby specifies and finds that all of th~ facts set forth in the Recitals, Part A, of the Ord/nanoe are true and SECTION 2: Tnis Council hereby finds and certifies that the project ham been reviewed and considered in ocmpliance with the California Environ- mental Quality Act of 1970, and further, this Council hereby issues a Negative Declaration. SECTION 3: The Rancho Cucamonga City Council finds as follc~s: a) That the Planning C~,mdssion of the City of Rancho Cucamonga, following a public hearing held in the time and manner pre- scribed by law, r~ approval of the Cxa,-~unity Plan text amendment hereinafter described to the City Council. This City Council ban held a public hearing in the time and manner pre- scribed by law and duly heard and considered said rec~m,enda- tion. b) Tnat this Community Plan text amendment is consistent with the General Plan of the City of Rancho Cucamonga. c) That this C~wunity Plan text amendment is consistent with the Develolanent Code of the City of Rancho Cucamonga. ~ No. 466 Page 2 d) That this O~mtunity Plan text amendment will have no significant enviroranental impact as provided in the Negative Declaration filed herein. SECTION 4: The City Council of the City of Rancho Cucamonga hereby approves Tetra Vista Planned Community ~t 91-02 as follows: a) The Terra Vista Cz..atum3nity Plan text, Part IV, Design Guidelines, Subsection "Residential Design Guidelines," con~utencing on page IV-35 is hereby amended, in part, to read as attached hereto and i/x~rporated herein by this reference. b) The Tetra Vista C,,:axum3nity Plan text, Part IV, Design Guidelines, Subsection "Residential Design Guidelines," c~..a~,,uencing on page IV-38 is hereby amended in part, to read as attached hereto and incorporated herein by this reference. c) The Tetra Vista Ccmmunity Plan text, Part V, Cc~m:,!~'Lity Develop- ment Standards, subsection "Residential Development Standards," Table V-3, Building Setbacks for Cluster and Innovative Develop- merit (LM and M uses) is hereby amerrled, in part, to read as attached hereto and incorporated herein by this refererK=e. d) The Tetra Vista Cokm~mlity Plan text, Part V, C~a~u~unity Develop- ment Standards, subsection "Residential Development Standards for Medium and Meiium High Density," c:x.a~u,e.r*K::::in*"K/on page V-14 and ending on page V-15 is hereby amended, in part, to read as attached hereto and incorporated herein by this refere3x~e. e) The Tetra Vista C~-a~mn.]nity Plan text, Part V, C.,,-amm]nity Develop- ment Standards, subsection '~Residential Development ~,,, Table V-4, Building Setbacks for multi-family development (MH and H uses) is hereby amended, in part, to read as attached hereto and incorporated herein by this reference. f) The Tetra Vista C~am~mity Plan text, Part V, Conmunity Develop- ment Standards, subsection "Residential Development ~ for High Density," o, at,,,~ing on page V-18 is hereby amended, in part, to read as attached hereto and incorporated herein by reference. SECT/ON 5: The provisions of this Ordinance shall not apply to those residential subdivisions wherein a Tentative Map and/or Design Review b~m been approved prior to the effective date of this Ordinance. The approval shall include the time extmetion as allowed by Section 17.02,100 of the Development Code and as modified from time to time. SECTION 6: The Mayor shall sign this Ordinance and the City Clerk shall cause the ~ to be published within fifteen (15) days after its passage at least once in the Inland Valley Daily Bulletin, a newspaper of general circulation published in the City of Ontario, California, and circulated in the City of Rancho Cucamonga, California.
