HomeMy WebLinkAbout456 - Ordinances ORDINANCE NO. 456 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RANCMO CIgCAMONGA, CAT,TFORNIA, APPROVING DEVELOPMENT DISTR/CT ~ 91-01, AMMqD]2qG THE DEVELOPMENT DISTRICTS MAP FRCM "OP" (OFFICE PROFESSIONAL) TO "FBSP" (FOOTHIIL BOULEVARD SPECIFIC PIAN) FOR A PARCEL OONSISTINS OF APPROXIMATELY 8.3 ACRES ~ AT THE NORTHEAST CORNER OF FOOTHIIL~AND~A~, AND MAKING FINDINGS IN SUPPORT THEPaDF - APN: 227-152-18 and 30 A. Recitals. (i) On July 10, 1991, the Planning Ccmmlission of the City of Rancho Cucamonga conducted a duly noticed public hearing with respect to the above referenced Development District Amendment. Following the conclusion of said public hearing, the Planning Commission adopted its Resolution No. 91-94, thereby rec~.~extb~ that the City Council adopt Development District Amendment No. 91-01. (ii) On September 18, 1991, the City Council of the City of Rancho Cucamonga conducted a duly noticed public hearing and concluded said hearing prior to its adoption of this Ordinance. (iii) All legal prerequisites prior to the adoption of this Ordinance have occurred. Ordinance. NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does hereby ordain as follows: SECTION 1: Tnis Council hereby specifies and finds that all of the facts set forth in the Recitals, Part A, of this Ordinance are true and SECTION 2: Based upon substantial evidence presented to this Council during the above-referenced public hearing on September 18, 1991, including written and oral staff reports, together with public testimony, this Council specifically finds as follows: a) The amendment pertains to a + 8.3 acre parcel of land located at the northeast corner of Foothill Boulev-~rd and Rochester Avenue with a street frontage of + 900 feet along Foothill Boulevard and _+ 400 feet along Rochester Avenue and is presently vacant. Said parcel is currently designated as "OP" (Office Professional); and b) The property to the north is designated for residential uses and is developed with single family homes. The property to the west is designated for office and c~m~ercial uses and is vacant. The property to the south is designated for industrial uses and is developed with a single family residence. The property to the east is designated for utility and flood control facilities and is developed with such; and OrdinanceNo. 456 Page 2 c) This amendment does not conflict with the ;and Use Policies of the General Plan and will provide for development within the district in a manner consistent with the General Plan and with related development; and d) This amendment will promote the goals and objectives of the Land Use Element of the General Plan; and e) This amendment would not be materially injurious or detrimental to the adjacent properties and would not have a significant impact on the environment nor the surrounding properties. SECTION 3: Based upon the substantial evidence presented to this Council during the above-referenced public hearings and upon the specific findings of facts set forth in paragraphs 1 and 2 above, this Council hereby finds and concludes as follows: a) That the subject property is suitable for the uses permitted in the proposed district in terms of access, size, and compatibility with b) That the proposed amendment would not have significant impacts on the environment nor the surrounding properties; and c) That the proposed amendment is in conformance with the General Plan. SECTION 4: This Council hereby finds that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970, and further this Council hereby issues a Negative Declaration. SECTION 5: Based upon the findings and conclusions set forth in paragraphs 1, 2, 3, and 4 above, this Council hereby ordains that pursuant to Section 65850 to 65855 of the California Government Code, the City Council of the City of Rancho Cucamonga hereby approves Development District Amendment No. 91-01, changing the District designation from "OP" (Office Professional) to "FBSP" (Foothill Boulevard Specific Plan) as depicted in the attached "Exhibit A". SECTION 6: The City Clerk shall certify the adoption of this SECTION 7: The Mayor shall sign this Ordinance and the City Clerk shall cause the same to be published within fifteen (15) days after the passage at least once in the Inland Valley Daily Bulletin, a newspaper of general circulation published in the City of Ontario, California, and circulation in the City of Rancho Cucamonga, California.
