HomeMy WebLinkAbout794 - OrdinancesORDINANCE NO. 794 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, AMENDING SECTION 10 20.020 OF THE RANCHO CUCAMONGA CITY CODE REGARDING PRIMA FACIE SPEED LIMITS ON CERTAIN CITY STREETS A Recitals (i) California Vehicle Code Section 22358 Provides that the City Council may, by ordinance, set prima facie speed limits upon any portion of any street not a state highway (n) The City Traffic Engineer has conducted an engineering and traffic survey, of certain streets within the City of Rancho Cucamonga which streets as speafied in Part B of this Ordinance (ni) The determinations concerning prima facie speed limits set forth in Part B, below, are based upon the engineering and traffic survey identified in Section A (u), above B Ordinance NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA DOES HEREBY ORDAIN AS FOLLOWS Section 1 Section 10 20 020 hereby is amended to the Rancho Cucamonga City Code to read, in words and figures, as follows 10 20 020 Decrease of state law maximum speed It is determined by City Council resolution and upon the basis of an engineering and traffic investigation that the speed permitted by state law is greater than is reasonable or safe under the conditions found to exist upon such streets, and it is declared the prima face speed limit shall be as set forth in this section on those streets or parts of streets designated in this section when signs are erected giving notice hereof (Ord 169 Section I (part), 1982, Ord 39 Section 5 1, (1978) Rancho Cucamonga 5/82124 Existing Posted Proposed Prima Facie Name of Street and Limits Speed Limit (mph) Speed Limit (mph) 1 Wardman Bullock/Youngs None 40 Canyon, Wilson Avenue to Koch Place Ordinance No 794 Page 2 of 3 Name of Street and Limits Valencia Avenue, Haven Avenue to Base Line Road Terra Vista Parkway, Town Center to Church Street Terra Vista Parkway, Mountain View to Church Street Bluegrass Avenue, Wilson Avenue to Banyan Street Existing Posted Proposed Prima Facie Speed Limit (mph) Speed Limit (mph) None 35 None 40 None 40 None 40 (i) Both sixty-five (65) miles per hourand fifty-five (55) miles per hour are speeds which are more than are reasonable or safe, and (u) The miles per hour as stated are the prima faae speeds which are most appropriate to facilitate the orderly movement of traffic and are speed limits which are reasonable and safe on said streets or portions thereof, and (up The miles per hour stated are hereby declared to be the prima facie speed limits on said streets, and (iv) The Traffic Engineer is hereby authorized and directed to install appropriate signs upon said streets giving notice of the prima facie speed limit declared herein Section 2 The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published as regwred by law Section 3 The Mayor shall sign this Ordinance and the City Clerk shall cause the same to be published within fifteen (15) days after its passage at least once in The Inland Daily Bulletin, a newspaper of general circulation published in the City of Ontario, California, and arculated in the City of Rancho Cucamonga Please see the /ol/owmg page /or formal adoption, certi~cahon and signaNres Ordinance No 794 Page 3 of 3 PASSED, APPROVED, AND ADOPTED this 6th day of August 2008 AYES: Gutierrez, Kurth, Michael, Spagnolo, Williams NOES• None ABSENT• None ABSTAINED: None ATTEST• 1 1 ~~ ~ ~l ~~~ Kath n L Sc6tt, CMC, Acting City Clerk I, KATHRYN L SCOTT, ACTING CITY CLERK of the City of Rancho Cucamonga, California, do hereby certify that the foregoing Ordinance was introduced at a Regular Meeting of the Councl of the City of Rancho Cucamonga held on the 16"' day of July 2008, and was passed at a Regular Meeting of the City Council of the City of Rancho Cucamonga held on the 6th day of August 2008 Executed this 7th day of August 2008, at Rancho Cucamonga, California // `1~i11~1~ ~ ~~d~ Kathryn L ott, CMC, Acting City Clerk
