HomeMy WebLinkAbout409 - OrdinancesORDINANCE NO: 409 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, AMENDING TITLE 8 OF THE RANCHO CUCAMONGA MUNICIPAL CODE BY ADDING A NEW CHAPTER 8.26 ENTITLED "SERVICE CHARGES FOR FALSE ALARMS" AND PROVIDING FOR SERVICE CHARGES TO DEFRAY THE COSTS OF FALSE POLICE ALARMS A. Recitals. The City Council of the City of Rancho Cucamonga does hereby ordain as follows: SECTION 1: Chapter 8.26 hereby is added to Title 8 of the Rancho Cucamonga Municipal Code to read in words and figures, as follows: "Chapter 8.26 "SERVICE CHARGES FOR FALSE ALARMS "Sections: 8.26.010 8.26.020 8.26.030 8.26.040 Definitions. Response service charge. Billing. Enforcement. "8.26.010 De fi nit ions. following definitions shall apply: For the purposes of this Chapter, the "(a) 'Alarm system' shall mean any device designed for the detection of an unauthorized entry on premises or for alerting others of the commission of an unlawful act, which device, when actuated, emits a sound beyond the business premises or residential unit or dwelling protected by such device or transmits a signal or message to another location. "(b) 'False alarm' shall mean an activated alarm or alarm signal from any alarm system which is responded to within the City of Rancho Cucamonga by the San Bernardino County Sheriff's Department, but for which no emergency situation exists or where there is no evidence to indicate that there was an emergency situation as determined by the responding officer. 'False alarm' shall not include those alarms activated by extraordinary meteorological, atmospheric, or other conditions or means as determined by said Sheriff's Department. "(c} 'Fiscal year' shall mean the period from and including July 1 of any year to and including June 30 of the following year. "(d) 'Person' shall mean any individual, partnership, corporation, or other entity. Ord i nance No. 409 Page 2 "8.26.020 Response service charges. A service charge which is established by resolution of the City Council of the City of Rancho Cucamonga in order to defray costs incurred in providing law enforcement services in response to a false alarm shall be paid to the City, by each person who possesses premises, for each third and subsequent police response made to those premises generated by a false alarm during any fiscal year. "8.26.030 Billing. The City's Finance Department shall cause to be issued a monthly bill for the unpaid service charges accrued during the billing period and any prior periods. Such bill shall be due and payable within fifteen (15) days after the billing date. "8.26.040 Enforcement. The amount of any service charge shall be deemed a debt to the City. An action may be commenced in the name of the City in any court of competent jurisdiction for the amount of any unpaid service charges. All service charges shall be deemed delinquent fifteen (15) days after they are due and payable." SECTION 2: The City Council declares that, should any provision, section, paragraph, sentence or word of this Ordinance be rendered or declared invalid by any final court action in a court of competent jurisdiction, or by reason of any preemptive legislation, the remaining provisions, sections, paragraphs, sentences, and words of this Ordinance shall remain in full force and effect. SECTION 3: The Mayor shall sign this Ordinance and the City Clerk shall cause the same to be published within fifteen (15} days after its passage at least once in The Daily Report, a newspaper of general circulation published in the City of Ontario, California, and circulated in the City of Rancho Cucamonga, California.
