HomeMy WebLinkAbout892 - Ordinances - ROLLER SKATES ORDINANCE NO. 892 ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, AMENDING CHAPTER 10.68 IN ITS ENTIRETY OF THE RANCHO CUCAMONGA MUNICIPAL CODE REGARDING ROLLER SKATES AND SIMILAR DEVICES THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA HEREBY ORDAINS AS FOLLOWS: SECTION 1. Chapter 10.68 of the Rancho Cucamonga Municipal Code is hereby amended in its entirety to read as follows: CHAPTER 10.68. — SKATEBOARDS AND SIMILAR DEVICES Sec. 10.68.010. — Definitions. As used in this chapter, the following words and phrases shall have the meanings respectively ascribed to them in this section: "Skate facility" means any facility owned and operated by the City of Rancho Cucamonga that is designed and maintained for the purpose of riding skateboards and other wheeled recreational devices, and which is identified by one or more signs as a skate park owned and operated by the City of Rancho Cucamonga. "Wheeled recreational device" means non-motorized bicycles, scooters, in-line skates, roller skates, or wheelchairs. Sec. 10.68.020. -- Use of skateboards and other wheeled recreational devices restricted. Other than with respect to non-motorized bicycles, it is unlawful for any person to ride in or by means of any skateboard or other wheeled recreational device upon any roadway. Sec. 10.68.030. -- Yielding the right-of-way. A. The driver of a motor vehicle, prior to driving over or upon any sidewalk or public crosswalk, shall yield the right-of-way to any person riding in, on or by means of any skateboard or other wheeled recreational device. B. Whenever any person is riding in, on or by means of a skateboard or other wheeled recreational device on a public sidewalk or public crosswalk, such person shall yield the right- of-way to any pedestrian. Sec. 10.68.040. -- Attaching to moving objects prohibited. A. It is unlawful for any person riding a skateboard or other wheeled recreational device to attach to any moving object, including, but not limited to, persons, bicycles, animals or motor vehicles. It is unlawful for any person operating a moving vehicle to permit any person riding in, on or by means of a skateboard or other wheeled recreational device to attach to the motor vehicle while the motor vehicle is in motion. Sec. 10.68.050. -- Use of skateboards and other wheeled recreational devices prohibited on private property in commercial zones where posted. Other than with respect to wheelchairs, it is unlawful for any person to ride a skateboard or other wheeled recreational device upon private property located in any commercially zoned area in the city, so long as such property is posted so as to give reasonable notice of such prohibition. Sec. 10.68.060. - Use of skateboards and other wheeled recreational devices prohibited on public property where posted. Other than with respect to wheelchairs, it is unlawful for any person to ride a skateboard or other wheeled recreational device upon any public property within the city where notice of such prohibition has been posted. Sec. 10.68.070. -- Skateboard ramps prohibited on public property where posted. It is unlawful for any person to place any skateboard ramp, half pipe and/or similar physical structure upon which skateboarding and/or skating is conducted, or which is used in conjunction with skateboarding and/or skating, upon any public property where notice of such prohibition has been posted. Sec. 10.68.080. -- Regulations applicable to skate facilities. A. City skate facilities are designed and maintained for the purpose of riding skateboards and other wheeled recreational devices. It shall be unlawful for any person to ride, propel oneself, or otherwise utilize, within any skate facility, any device other than a skateboard or other wheeled recreational device. B. Notwithstanding any other provision of this chapter, every person riding a skateboard, or utilizing other wheeled recreational devices at any skate facility must: 1. Wear a fully functional helmet, elbow pads, and knee pads while utilizing the skate facility; 2. Be supervised by an adult if under the age of 14; and 3. Comply with all posted rules and regulations. SECTION 2. The City Council declares that, should any provision, section, paragraph, sentence, or word of this Ordinance be rendered or declared invalid by any final court action in a court of competent jurisdiction, or by reason of any preemptive legislation, the remaining provisions, sections, paragraphs, sentences, and words of this Ordinance shall remain in full force and effect. SECTION 3. CEQA Findings. The City Council finds that the adoption of the proposed ordinance is exempt from the requirements of the California Environmental Quality Act ("CEQA") pursuant to Title 14, Chapter 3, California Code of Regulations (CEQA Guidelines), Section 15061(b)(3). It can be seen with certainty that there is no possibility that the adoption of this Ordinance No. 892 — Page 2 of 4 ordinance will have a significant effect on the environment because the ordinance standardizes language for existing regulations and amends rules of conduct for existing skate facilities. SECTION 4. The City Clerk shall certify to the adoption of this Ordinance and shall cause the same to be published in the manner prescribed by law.
