The City ofRancho Cucamonga has prepared Master Plan Amendment DRC2019-00231, as described in the title of this Ordinance. Hereinafter in this Ordinance, the subject Specific Plan Amendment isreferred toR3"the ADlSOdnnan[^ A. On October 4, 2017, the City Council approved Urgency Ordinance No. 919' an interim ordinance requiring a Conditional Use Permit for the establishment of any new hotel or the expansion of any existing hotel within the City to a||ovv staff time to study appropriate development standards and regulations for hotels and draft any necessary changes to the K8URiCipa| Code. Per State |aYv. an interim O[diO8UCe is effective for aperiod Of45 days from the date of adoption, unless extended at a public hearing prior to the end of the 45-day period. B. On November 15. 2017. the City Council approved Urgency Ordinance No. 923' which extended the interim ordinance's requirement for a Conditional Use Permit for the establishment of any new hotel or the expansion of any existing hotel within the City for an additional 10 months, 15 days, to provide staff additional time to study the issue and draft Municipal Code Amendment to address the impacts created by hotel development within the City. D, On April 10 and April 24. 2019. the Planning CU[DVO|SSiOn of the City of Rancho Cucamonga conducted 8 noticed public h88[|Dg with respect 1othe Amendment and, following the conclusion thereof, adopted R8s0|U1iOn No. 19-34. [ecornOneMdiOg that the City Council of the City ofRancho Cucamonga adopt this Amendment. E, [)OMay 15.2O19.the City Council o1the City QfRancho CUo8rnODgaconducted e noticed public hearing on the Amendment and continued the public hearing to a date certain. F On JUD8 5. 2019' the City Council of the City of Rancho Cucamonga continued v-,lith the noticed public hearing on the Amendment and COnClUded said hearing on that date. B, All legal prerequisites prior to the adoption of this Ordinance have occurred. SECTION 2. Based upon the substantial evidence presented tothis Council during the above -referenced public hearing, this Council hereby finds and concludes that the changes proposed to Title 17 (Development Code) in the Amendment are consistent with the General Plan goals, policies, and implementation programs. General Plan Land Use Policy lL-/./encourages the protection Of neighborhoods from the encroachment of incompatible nCUViU8s or land uses that may have a negative impact on the residential Wing environment. Regulating the operational standards for hotels that may be near residential neighborhoods will reduce potential impacts created by hotels. Land Use Gn8/LU-// raqUiFnS that ooDlnnuDitv aesthetics are maintained LhroUgh appropriate regulations. Establishing design guidelines for 'hotels will encourage better site design, improved architecture, and the use of higher quality building materials. Lastly, through partnerships designed tOreport and prevent criminal activity at hotels between hotel owners and operators, and City pO|ioe and Fire services, Public Safety Goal PS-4. which requires a high |8vn| nfpublic safety services throughout Rancho Cucamonga, can continue tobeachieved. SECTION 3. The Planning Department staff has determined that this Amendment im exempt from the requirements of the California Environmental {Jua|hvAct /CE{JA\ and the CiLV� (�E{]AGuidelines. The p jeotqualifies under the general rule that C '[}Aa' '||oa 'n|yk}projects, ' which have the potential for causing significant effects on the environment. Pursuant to 'State — CE{]A Guidelines Section 15061(B)(3), vvhmr8 it can be seen with Ced3iDtvthsdthnre i/ no possibility that the activity in question may have significant effect On the environment, the activity is not subject to CE[3A. The Amendment does not propose any physical change to the environment itself. The Amendment's requirement for hotel development applications to prepare a market feasibility study is a purely economic requirement. In addition, the occupancy standards and public safety standards are limited to the operation of hotels and do not affect the environment. The remaining development standards do not have the potential for causing significant effects on the environment because they pertain to improving the quality of the architectural design of hotels and not to the intensity of development. In sum, the Amendment vvnu|d impose more restrictive regulations on hotel development within the City hotel projects are rurrenUypernni�edbyright inrno3tzoning districts. On 8 CUS8'by-oas8 review Of each project, the appropriate oOYirDD[DGDta| document will b8prepared t0address project -specific innpact3.B@GudoD(hiSGvid8nCeandaUOf the evidence in the record, the City C0UDoi| concurs with the Planning Department staR's determination that the Amendment will not have a significant effect on the environment and is therefore exempt from further environmental review under CE[J/\, SECTION 4. The |GOd use labeled "Hotels and nlOte|S" in the R8Q|0na| Related COD101e[cia| schedule of Subsection 1.C. (Mixed Use COUl0SnC/a|) under Chapter 3 (Land Use) shall be modified as follows: "(8) Hotels, subject to Development Code Chapter 17.93," SECTION 5, In accordance with Municipal Code Section 17.02.020.F, this Ordinance shall apply to all pending project applications, iDC|UdiOQ those that have been deemed complete bvthe planning director, unless the project hasreoeivedaUnmceSaaryp!anningpenniba and entitlements prior to the effective date of this Ordinance. SECTION G. The City Council declares that, should any section, subsection, subdivision, sentence, clause, phrase, or portion of this Ordinance for any reason be held invalid affect the validity of the remaining portions of this Ordinance. The City QouDd| hereby declares that it would have adopted this Ordinance and each seodon, subsection, subdivision, senhance, clause, phrase, or portion thenaof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions thereof be declared invalid or unconstitutional. SECTION 7. Neither the adoption of this Ordinance nor the repeal of any other Ordinance of this City ShuU in any manner affect the prosecution for violations of ordinances, which violations were committed prior tothe effective dn1S hereof, nor be construed as @ waiver of any penalty orthe penal provisions applicable [oany violation thereof.
