AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RANCEO
CUCAM3NGA, CALIFORNIA, APMNDING SUBSECTION 13.08.040B OF
THE RANC~O CUCAM3NGA MUNICIPAL CODE PERTAINING TO STORM
DRAINAGE FEES
THE CITY COUNCIL OF THE CITY OF RANCHO (]3CAMUNGA DOES HEREBY ORDAIN AS
FOLLOWS:
SECTION 1. Subsection 13.08.040B is hereby mended to read, in words
and figures, as follows:
"B". No fees shall be charged within the Victoria, Caryn and Tetra
Vista planned Community areas or the Assesanent District areas. All planned
local drainage facilities within the assessment district areas have been
completely constructed. However, in lieu of storm drain fee collections,
facilltles within the Victoria, Caryn and Tetra Vista planned communities shall
be constructed with develo[ment, at the developer's expense. The City Engineer
shall, in the exercise of his discretion, determine which facillties are to be
constructed with a partlcular dayeloquent as a condition of such develoIment.
Notwithstanding the foregoing, any property annexed within the Victoria, Caryn
or Tetra Vista planned communities after the effective date of this chapter
shall pay a storm drain fee in an amount equal to the local drainage ares fee
applicable to such annexed property prior to such annexation and in effect at
the time of develo~nent.
SECTION 2. The Mayor shall sign this Ordinance and the City Clerk
shall cause the same to be published within fifteen (15) days after its passage
at least once in The Daily Report. a newspaper of general circulation published
in the City of Ontario, California, and circulated in the City of Rancho
Cucamonga, California.
