HomeMy WebLinkAbout360 - OrdinancesORDINANC~ NO. 360 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, AMENDING SUBSECTION 17.08.070-C AND 17.12,030-B, AND ADDING A NEW SUBSECTION 17.10.050-0 TO THE RAN(~O CUCAMDNGA MUNICIPAL CODE PERTAINING TO VEHICLE PARKING WITHIN RESIDENTIAL, COMMERCIAL/OFFICE AND INDUSTRIAL DISTRICTS A. Recitals. (i) On May 25, 1988, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing with respect to the following proposed amendment to Title 17 of the Rancho Cucamonga Municipal Code (hereinafter referred to ae the "Development Code") regarding regulations for vehicle parking within residential; commercial and industrial districts of the City. (ii) At the conclusion of said May 25, 1988, public hearing, Planning Commission adopted its Resolution No. 88-108 thereby recommending that this Council adopt the proposed Development Code amendments as set forth in this Ordinance. (iii) On June 15, 1988, the City Council of the City of Rancho Cucamonga conducted a duly noticed public bearing with respect to the proposed Development Code amendments as set forth herein and said hearing was concluded prior to the adoption of this Ordinance. (iv) All legal prerequisited prior to the adoption of this Ordinance have occurred. B. Ordinance. THE CITY COUNCIL OF THE CITY OF RANCliO CUCAMUNGA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: That all of the facts set forth in the Recitals, Part A, of this Ordinance are true and correct. SECTION 2: Subsection 17.08.070-C of the Development Code of the City of Rancho Cucamonga is hereby amended to read, in words and figures, as follows: Ce Vehlcle Parking. The parking of vehicles in all residential districts shall be subject to the following provisions: Ordinance No. 360 Page 2 The design guidelines and regulations for parking areas shall conform to the provisions of Chapter 17.12 of the Development Code; Vehicle parking shall be within carport or other required or paved parking area; the enclosed garage. authorized off-street All parking areas within public view from the street, public right-of-way or adjacent properties shall be paved with a permanent paving material· Such area shall be maintained in a useable condition free of potholes and broken sections sufficient to prevent mud and/or dust. without accumulation of loose material or other deterioration; Vehicles may be parked or stored in the side or rear yard provided that such area is screened from view from the street, public right-of-way and adjacent properties by a fence, wall, or equivalent screening material at least five (5) feet in height; Vehicle parking within side and rear yard areas shall be limited to five percent (JZ) of the total lot area or five hundred (500) square feet, whichever is greater, unless constructed pursuant to an approved Minor Developaent Review; Except as provided in Subsection 9 herein, vehicles perked within public view in required or authorized parking areas within the front yard, corner side yard or side yard abutting a street shall be parked or left standing for temporary periods of time not to exceed five (5) consecutive days; "Vehicles" as used in this section shall include, but not be limited to, commercial vehicles, automobiles. trucks, trailers, motor trucks, semi-trailers, motorcycles, mopads, campers, camper shells, boats or other large portable recreational and commercial equi~nent; and No commercial vehicle which exceeds a gross weight of one and one-half (1 and 1/2) tons, or exceeds a width of eighty (80) inches or exceeds a height of seven (7) feet or exceeds a length of twenty-five (25) feet; no special iz ed work related vehicle (e, g. towtruck, stakebed trucks, etc.) and no specialized work related portable equipment (e. g. cement mixers, trailers, etc.); shall be parked on any portion of a residential lot unless: (1) it is actively involved in making Ordinance No. 360 Page 3 pick-ups and deliveries; (2) in connection with. and in aid to the performance of a service to. or on. the property where the vehicle is perked. while actively involved in such activity; or (3) in conformance with the conditions of approval for a valid Home Occupation Permit as provided in Section 17.04.060 of the Development Code; No private. non-commercial vehicle which exceeds a gross weight of one and one-half (1 and 1/2) tons. or exceeds a width of eighty (80) inches, or exceeds a height of seven (7) feet or exceeds a length of twenty-five (25) feet; and no trailer. semi-trailer. boat or portable recreational equipment shall be parked or stored within the front yard. corner side yard or side yard abutting a street unless: (1) it is not a commercial vehicle and is parked for a temporary period of time not to exceed twenty-four (24) hours; (2) it is involved in loading or unloading activity; and (3) it is parked in compliance with any other applicable City ordinance; 10. Violation of any provision of this subsection shall be punishable as an infraction. SECTION 3: Subsection 17.12.030-B(8) of the Development Code of the City of Rancho Cucamonga is hereby amended to read, in words and figures, as follows: Any secondary paved driveway or extension of the primary driveway shall not be used for parking unless: (1) it connects the primary driveway access to a second access point with the street or public right-of-way (i.e. clrcular driveway) with a continuous pavement width not exceeding twelve (12) feet; (2) it is an extension of the primary driveway toward the nearest side or rear yard area; or (3) is constructed pursuant to an approved Minor Development Review. SECTION 4: Subsection 17.10.050-0 is hereby added to the Code of the City of Rancho Cucamonga to be read. in words and follows: Development figures. as Vehicle Parking. THe parking of vehicles in all commercial/ office and industrial districts shall be subject to the following provisions: The design guidelines and regulations for parking facilities shall conform to the provisions of Chapter 17.12 of the Development Code and any applicable provisions of the Industrial Specific Plan; Ordinance No. 360 Page 4 Vehicle parking shall be within buildings, garages or other required or authorized off-street paved perking facll ities. All parking facilities within public view from the street, public right-of-way or adjacent property shall be paved with a permanent paving material. Such area shall be maintained in a useable condition free of potholes and broken sections sufficient to prevent mud and/or dust, without accumulatlon of loose material or other deterioration; No vehicle shall be parked for the purpose of displaying such vehicle for sale or other commercial activity, including, but not limited to, lease, hire, advertising, etc. unless such vehicle is perked by, or with the written permission of, a business on the property which is permitted, licensed and approved to display vehicles for such purposes; No vehicle shall be parked for the purpose of repair or maintenance unless: (1) such work is performed on vehicles owned or operated by the on-site business within an enclosed building or yard area screened from view from the street, public right-of-way, adjacent properties and required off-street parking facilities with public access; or (2) in connection with a current on-site business permitted to perform repair or maintenance of vehicles and only during established business hours; No vehicle which is disabled, unlicensed, unregistered, inoperative or from which an essential or legally required operating part is removed or missing shall be parked within public view from the street; public right-of-way. adj scent properties or required off-street parking facilitles with public access; No commercial vehicle exceeding a gross weight of one and one-half (1 and 1/2) tons, or exceeding a width of eighty (80) inches, or a trailer or seml-trailer shall be parked within a commercial/office district unless: (1) it is screened from public view from the street, public right-of- way and adjacent properties; (2) it is actively involved in making pick-ups and deliveries; or (3) in connection with, and in aid to, the performance of a service to, or on, the property where the vehlcle is perked, while actively involved in such activity; Ordinance No. 360 Page 5 "Vehicles" as used in this section shall include. but not be limited to. commercial vehicles. automobiles. trucks, trailers, motor trucks, semi-trailers. motorcycles, mopeds, campers. camper shells, boats or other large portable recreational or commercial equipment; Violation of any provision of this subsectlon shall be punishable as an infraction· SECTION 5: The City Council declares that. should any provision. section. paragraph. sentence or word of this Ordinance be rendered or declared invalid by any final court action in a court of competent jurisdiction, or by reason of any preemptiv. legislation. the remaining provisions. sections. paragraphs. sentences. and words of this Ordinance shall remain in full force and effect. SECTION 6: The Mayor shall sign this Ordinance and the City Clerk shall cause the same to be published within fifteen (15) days after its passage at least once in The Daily Report. a newspaper of general circulation published_ in the City of Ontario, California. and circulated in the City of Rancho Cucamonga. California.
