HomeMy WebLinkAbout343 - Ordinances ORDINANCE NO. 343 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RANCliO CUCAMDNGA, CALI[ORNIA, AMENDING SELECTED SECTIONS OF CHAPTERS 10.52 AND 10.64 AND REFEALING CHAPTER 10.68 PERTAINING TO REGULATIONS ON THE PARKING OR STANDING OF VEHICLES THE CITY COUNCIL OF THE CITY OF RANCHO CUCAM3NGA DOES HEREBY ORDAIN AS FOLLOWS: SECTION I: Section 10.52.050 of the Rancho Cucamonga Municipal Code is amended to read, in words and figures, as follows: 10.52.050 Parkin~ Overweight Vehicles - Weight Limitation. A. No person shall park or leave standing any commercial vehicle, as the same is defined in the California Vehicle Code, h~ving a manufacturer' s gross vehicle weight rating of ten thousand (10,000) pounds or more on any street, or portion thereof, located in a residential district within the City. B. Where signs or markings have been placed directing compliance with the provisions of this subsection, no person shall park or leave standing on any public street, highway, parbay or property dedicated to public use in any residential district within the City, any vehicle, motor truck, trailer, semi-trailer or combination thereof, having a manufacturer' s gross vehicle weight rating of one and one-half (1-1/2) tons or more, or a width in excess of eighty (80) inches. C. Where signs or markings have been placed directing compliance with the provisions of this subsection, no person shall park or leave standing on any public street, highway, parbay or property dedicated to public use, in any commercial or industrial district of the City, any vehicle, motor truck, trailer, semi-trailer or combination thereof, having a manufacturer's gross vehicle weight rating of three (3) tons or more, or a width in excess of eighty ( 80 ) inches. D. The provisions of this section shall not apply to the following: 1. Public emergency vehicles; 2. Vehicles parked for the purpose of making pick-ups and deliveries while actively involved in such Ordinance No. 343 Page 2 3. Vehicles parked in connection with, and in aid to, the performance of a service to, or on, a property in the block where such vehicle is parked while actively involved in such service activity; and, 4. Public utility vehicles; and 5. Where signs have been erected authorizing temporary parking of such vehicles. SECTION 2: Section 10.52.060 of the Rancho Cucamonga Municipal Code is hereby amended to read, in words and figures, as follows: 10.52.060 Parkin8 of trailers or semi-trailers. A. No person shall park or leave standing any trailer or semi- trailer upon any publ ic street, highway, alley, parkway or property dedicated to public use, or any portion thereof, unless the trailer or semi-trailer is at all times while so parked and standing attached to a vehicle capable of moving such trailer or sere i- trail er. B. This section shall not apply to trailers or semi-trailers in the process of being loaded or unloaded while actively involved in " such activity or trailers or semi-trailers parked and left standing in connection with, and in aid to, the performance of a service to, or on, a property in the block in which such vehicle is parked while actively involved in such activity." SECTION 3: Section 10.52.080 of the Rancho uucamonga Municipal Code is hereby amended to read, in words and figures, as follows: 10.52.080 Penalty for Infractions- Tow Away. Any act or omission declared unlawful by the provisions of this Chapter is an infraction punishable by a fine not to exceed that set by the current uniform countywide bail schedule established pursuant to the terms of the California Vehicle Code. Any vehicle left parked or standing in violation of the provisions of this Chapter shall be subject to being towed away in accordance with those regulations set forth in the California Vehicle Code pertaining to the towing of vehicles from public streets and property. SECTION 4: Section 10.64.020 of the Rancho Cucamonga Municipal Code is hereby repealed. SECTION 5: Section 10.64.050 of the Rancho Cucamonga Municipal Code is hereby amended to read, in words and figures, as follows: Ordinance No. 343 Page 3 10.64.050 Penalty for Infractions. Any act or omission declared unlawful by the provisions of this Chapter is an infraction punishable by a fine not to exceed that set by the current uniform countywide bail schedule established pursuant to the terms of the Californla Vehicle Code. SECTION 6: Chapter 10.68 of the Rancho Cucamonga Municipal Code is hereby repealed. SECTION 7: The City Council declares that, should any provision. section, paragraph, sentence or word of this Ordinance be rendered or declared invalid by any final court action in a court of competent jurisdiction, or by reason of any preemptire legislation, the remaining provisions, sections, paragraphs, sentences, and words of this Ordinance shall remain in full force and effect. SECTION 8: The Mayor shall sign this Ordinance and the City Clerk shall cause the same to be published within fifteen (15) days after its passage at least once in The Daily Repor.t, a newspaper of general circulation published in the City of Ontario, California, and circulated in the City of Rancho Cucamonga, California.
