HomeMy WebLinkAbout337 - Ordinances ORDINANCE NO. 337 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RANCMO CUCAMONGA, CALIFORNIA, AMENDING SECTION 10.20.010 AND SECTION 10.20.020 OF THE RANC~O CUCAMDNGA CITY CODE, REGARDING PRIMA FACIE SPEED LIMITS UPON CERTAIN CITY STREETS A. Recitals (i) California Vehicle Code Section 22357 provides that this City Council may, by ordinance, set prlma facie speed limxts upon any portion of any street not a state highway. (ii) The City Traffic Engineer has conducted an engineering anu traffic survey, of certain streets within the City of Rancho Cucamonga whlch streets as specified in Part B of this Ordinance. (iii) The determxnations concerning prima facie speed limlts set forth in Part B, below, are based upon the engineering and traffic survey identified in Section A (ii), above. B. Ordinance NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCMO CUCAMDNGA DOES HEREBY ORDAIN AS FOLLOW S: SECTION 1: Section 10.20.010 hereby is amended to the Rancho Cucamonga City Code to read, in words and figures, as follows: 10.20.010 Increasin~ state speed limit in certain zone~. It is determined by City Council resolution and upon the basis of an engineering and traffic investigation that the speed permitted by state law upon the following streets is less than is necessary for safe operation of vehicles thereon by reason of the designation and sign posting of the streets as through highways and (or) by reason of widely spaced intersections, and it is declared' that the prima facie speed limit shall be set forth in tk~ls section on those streets or parts of streets designated in this section when signs are erected giving noti ce thereof: Declared Prima Facie Name of Street or Portion Affected Speed Limit (MPH) 1. Amethyst Street - Baseline to end 35 2. Arrow Route - Grove to Baker 45 3. Beryl Street - Base Line to 800' north of Lemon Avenue 40 4. HelLman Ave. -Alta Loma Drive to 500' north of Manzanita Drive 35 Ordinance No. 337 Page 2 5. Lemon Ave. - Beryl St. to Archibald Ave. 35 6. Lemon Ave. - Sapphire St. to Jasper St. 35 7. Ninth Street - Grove to Baker 35 8. Ramona Avenue - Foothill Blvd. to 19th St. 35 9. Sapphire Street - Lemon to Banyan 40 10. Vineyard Avenue - Carnelian to Church 40 (Ord. 169 Sl(part), 1982: Ord. 39B S1, 1980: Ord. 49 S5.0, 1978) (i) The twenty-five (25) miles per hour speed does not facilitate the orderly movement of vehicular traffic. (ii) The miles per hour as stated are the prima facie speeds which are most appropriate to facilitate the orderly movement of traffic and are speed limits which are reasonable and safe on saxd streets or portions thereof. (iii) The miles per hour stated are hereby declared to be the prima facie speed limits on said streets. (iv) The Traf=lc Engineer is hereby authorized and directed to install appropriate signs upon sald streets giving notice of the prima facie speed limit declared herein. SECTION 2: Section 10.20.020 hereby is amended to the Rancho Cucamonga City Code to read, in words and flgures, as follows: 10.20.020 Decrease of state low maximum speed. It is determined by City Council resolution and upon the basis of an engineering and trazZxc investigation that the speed permitted by state law is greater than is reasonable or safe under the conditions found to exist upon such streets, ann it is declared that the prima facie speed limit shall be as set forth in tn~s section on those streets or parts of streets designated in thls section when signs are erected giving notice hereof: Declared Prima Facie Name of Street or Portion Affected Speed Limit (MPH) 1. Hellman Avenue - 500' north of Manzanita to Valley View 40 21. Hellman Avenue - 6th to Foothill 45 22. Highland Avenue - Amethyst to Archibald 35 23. Highland Avenue - from Archibald Avenue to Hermosa Avenue 35 24. Highland Avenue - from Hermosa Avenue to 800' west of Haven 45 25. Hillside Road - from Ranch Gate to Amethyst Street 35 26. Lemon Avenue - Archibald Avenue to Haven Avenue 40 27. Lemon Avenue - Jasper St. to Beryl St. 35 28. San Bernardino Road - from Vineyard Avenue to Archibald Avenue 35 29. Sapphire Street - Banyan to end 45 30. Sapphire Street - 19th to Lemon 40 31. Spruce Avenue - Elm Avenue to Base Line Rd. 40 32. Tetra Vista Parkway - Church to Belpine 40 33. Turner Avenue - Eighth to Foothill 45 34. Turner Avenue (Hermosa Ave. ) - Foothill to Base Line Road 45 35. Victoria Avenue - from Etiwanda Avenue t o Rout e 15 40 36. Victoria Park Lane 35 37. Rancho Cucamonga 5/82 124 (i) Both sixty-five (65) miles per hour and fifty-five (55) miles per hour are speeds which are more than are reasonable or safe; (ii) The miles per hour as stated are the prima facie speeds which are most appropriate to facilitate the orderly movement of traffic and' are speed limits which are reasonable and safe on said streets or portions thereof; Ordinance No. 337 Page 4 (iii) The miles per hour stated are hereby declared to be the prima facie speed limits on said streets; and (iv) The Traffic Engineer is hereby authorized and directed to install appropriate signs upon said streets giving notice of the prima facie speed limit declared herein. SECTION 3: The Mayor shall sign this Ordinance and the City Clerk shall cause the same to be published within fifteen (15) days after its passage at least once in The Daily Report, a newspaper of general circulation published in the City of Ontario, California, and circulated in the City of Rancho Cucamonga, California.
