HomeMy WebLinkAbout332 - Ordinances ORDINANCE NO. 332 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RANCliO CUCAMONGA, CALIFORNIA, ADOPTING VICTORIA PLANNED COMMUNITY AMENReNT 87-03. TO MODIFY THE COMMUNITY PLAN TEXT TO REQUIRE A CONDITIONAL USE PERMIT FOR CERTAIN COMMUNITY FACILITIES AS SPECIFIED IN THE COMMERCIAL STANDARDS AND COMMUNITY FACILITY SECTIONS OF THE VICTORIA The City Council of the City of Rancho Cucamonga. does ordain as follows: SECTION 1: The City Council hereby finds and determines the following: A. That the Planning Commission of the City of Rancho Cucemonga, following a public hearing held in the time and manner prescribed by law, recommends the Community Plan text amendment hereinafter described, and this City Council has held a public hearing in the time and manner prescribed by law and duly heard and considered said recommendation. -' B. That this Community plan text amendment is consistent with the General plan of the City of Rancho Cucamonga. C. That this Community Plan text amendment is consistent with the General Plan of the City of Rancho Cucamonga. D. This Community Plan text amendment will have no significant environmental impact as provided in the Negative Declaration filed herein. SECTION 2: The Community Plan text of the Victoria Planned Community is hereby amendment to read as follows: A. COMMERCIAL STANDARDS 2. Regional Canter a. The following general categories of uses shall be permitted: (1) Retail businesses, including, but not limited to: o department stores o drug stores o jewelry stores Ordinance No. 332 Page 2 o book stores o record stores o hi-fidelity equipment sales o clothing stores .- o musical instrument sales o shoe stores o candy stores o photography equipment sales (2) Service businesses. including, but not limited to: o watch and jewelry repair o beauty parlors o travel agencies o locksmiths o hanks and financial institutions o movie theaters (3) Administrative and professional offices. (4) Commercial recreation. (5) Restaurants. (6) Nurseries and garden supply stores, provided that fertilizer of any type shall be sold and stored in packaged form only. (7) Public Utility offices. (8) Wholesale business offices with samples on the premises, but not to include general storage. (9) Accessory structures and uses necessary or customarily incidental to the above uses as permitted by the Rancho Cucamonga Zoning Ordinance. (10) Permitted Community Facilities listed on Page 241. b. Uses permitted subject to specific approval of Conditional Use Permit: (1) Animal care facilities. not including kennels. (2) Parking lots and parking buildings. (3) Automobile service stations and car washes. (4) Automobile sales and service. Ordinance No. 332 Page 3 (5) Electric distribution switch stations. (6) Communication equipment buildings. (7) Public utility booster stations. (8) Commercial recreation. (9) Accessory structures and uses necessary or customarily incidental to the above uses as specifically provided for by the use permit and the Zoning Ordinance of the City of Rancho Cucamonga. (10) Conditionally permitted Community Facilities listed on Page 241. 3. Regional Related Land Uses a. The followlng general categories of uses shall be permitted: (1) Retail business. including but not limited to: o department stores ' o furniture stores o automobile sales o pet stores o motorcycle sales and service o home improvement center o hardware stores o grocery stores o clothing stores o meat markets or delicatessens (2) Service business. including but not limited to: o banks. financial institutions o automobile repair o blueprinting and photostating o cleaning and pressing business o laundries o locksmiths o mortuaries o mechanical auto wash o plumbing supply o movie theaters o photographic supplies or studios o equipment rental (3) Administrative and professional offices. Ordinance No. 332 Page 4 (4) Restaurants. (5) Commercial. (6) Aut~nobile service facilities. (7) Nurseries and garden supply stores, provided that fertillzer of any ~ype be stored and sold in packaged form only. (8) Public utility offices. (9) Hotels and motels. (10) Self-service laundry and self-service dry cleaning facilities. (11) Accessory structures and uses necessary or customarily incidental to the above uses as permitted by the Rancho Cucamonga Zoning Ordinance. (12) Permitted Community Facilities listed on Page 241. c. Uses permitted subject to a Conditional Use Permit: (1) Animal care facilities. (2) Public utility booster stations. (3) Parking lots and parking buildings. (4) Public utility exchange and substations. (5) Public buildings. (6) Accessory structures and uses necessary or custanarily incidental to the above uses as specifically provided for by the use permit. (7) Conditional permitted Community Facilities listed on Page 241. B. COMMUNITY FACILITIES The Community Facilities section of the Victoria Community Plan is established to provide for community support uses and those additional uses which are found to be compatible with the basic permitted uses by the Site Plan Review Process procedure. 1. Uses Permitted - The following uses shall be permitted within Residential and Commercial Land Use areas in Victoria: Ordinance No. 332 Page 5 a. Small Family Day Care in the home, providing care for six (6) or less persons. b. Public Park and Playground. c. General Open Space uses. d. Accessory structures and uses necessary or customarily incidental to the above as provided for in the Rancho CucamonSa Development Code. 2. Conditionally permitted Uses - The followins uses shall be permitted within Residential or Commercial Land Use areas in Victoria subject to the Conditional Use Permit process: a. Church. b. Club, lodge, fraternity and sorority. c. Convalescent center. d. Public facility.. e. Large Family Day Dare in the home, providing care for 7-12 persons. f. Child Care centers. g. Fire and police station. h. Outdoor recreation. i. Schools, private and parochial. j. Utility or service facility. C. The Amendment 87-03 to the Victoria Planned Community shall apply to any and all applications for Community Facilities for which complete applications were filed with the City after December 1, 1987. The Mayor shall sign this Ordinance and the City Clerk shall cause the same to be published within fifteen (15) days after its passage at least once in The Daily Report, a newspaper of general circulation published in the City of Ontario, California, and circulated in the City of Rancho Cucamonga, California.
